The use is proposed for one of two potential sites located on the overall South Canyon Park Land, City Owned Property. On July 11 , 2012 the Garfield County Planning Commission approved a Location and Extent Review for the Supplemental Site. Said approval included findings that the Supplemental Site conforms to the Comprehensive Plan and is consistent with intergovernmental agreements between the County and the City of Glenwood Springs. The Supplemental Site is located approximately Y. mile south of the Interstate 70, South Canyon Exit, in the vicinity of the County Road 134 Colorado River Bridge, just south of the Railroad Right-of-Way and east of the County Road. The Supplemental Site is located in Section 2, T6S, · R90W and on property also known by Assessor's Parcel No. 2183-113-00-020. A Director Determination is hereby issued approving the Application subject to findings that the City of Glenwood Springs Archery Practice Range -Public Use, Supplemental Site 2, has received a Location and Extent Approval from the County Planning Commission and is in general compliance with Article III, and other applicable Sections of the ULUR, and subject to the following conditions: 1. All representation of the Applicant contained in the application shall be considered conditions of approval unless specifically modified by the Director Decision. 2. Prior to operation of the facility, the parking area and access driveway shall be graveled and/or re-graded to address any drainage or ponding concerns. 4. Prior to operation of the facility, the Applicant shall install and maintain safety and rules of operation signage along with any additional fencing or delineation of the archery practice area, in compliance with recreational/archery range industry standards to ensure the safety of the participants and the public. 5. Prior to operation of the facility, the Applicant shall formalize an operational guideline document that addresses: (a) the requirement for providing temporary potable water and sanitation facilities (porta-potties) for special events; (b) policies for avoiding or dealing with emergency sanitary needs; (c) emergency response or communication procedures; and (d) safety signage or fencing consistent with City policies along the railroad right-of-way. 6. The City shall maintain ownership and management of the. site. It shall be kept in a clean and safe condition including operational policies addressing: (a) a carry-in and carry-out trash policy until such time as a more formal trash management plan is developed; (b) weed management for the site shall be provided including removal of noxious weeds consistent with the County's weed management policies/regulations; (c) periodic maintenance of parking areas and the access driveway including additional gravel and/or treatment with dust suppressing surface hardening chemicals; (d) unless modified by future applications or amendments the site shall remain a public facility not to be limited as in a private club; (e) the site shall be operated in accordance with all standard City of Glenwood Springs safety and insurance policies and insurance coverage by the City shall be maintained for the site and archery use. 7. Use of temporary shade shelters are permitted. Construction of future permanent shade structures, sanitary facilities or enclosures may be reviewed and considered non-substantial amendments to the approvals and reviewed accordingly. Any such structures will comply with the County's Building Permit requirements as applicable. 8. Operation of the site may include pathways to view historically significant ruins, interpretive signage, and other similar improvements. The archery practice range shall be operated and designed in a manner to not disturb or impact any historically significant ruins as may be further delineated and evaluated by the Glenwood Springs Historic Preservation Commission. 9. The site shall be operated on a seasonal basis consistent with the Applicant's representation with operations generally limited to Spring, Summer and early Fall periods. 10. Should the use be permanently discontinued, the site shall be reclaimed to a natural or historic condition. This may include re-vegetation, additional weed removal, site clean-up, and historic preservation. Improvements related to access to historic sites including parking areas may remain subject to ongoing management by the City. The ULUR requires notification to the Board of County Commissioners for their review and potential call-up of the application for review. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on July 26th The Administrative Permit will be issued upon expiration of that time if no request for further consideration is received. Background General Administrative Permit -Land Use Change Permit for an Archery Practice Range -Public Use City of Glenwood Springs Parks and Recreation South Canyon Practice Archery Range City of Glenwood Springs Tom Barnes, City of Glenwood Springs, Parks and Recreation Director Original Site: Generally situated in Section 15, T6S, R90W, approximately 3% miles south of the Interstate 70, South Canyon Exit and accessed by County Road 134. Supplemental Site: Generally situated in Section 2, T6S, R90W, Y. mile south of the Interstate 70, South Canyon Exit and accessed off County Road 134 at an existing driveway. Both sites are part of the overall 1800+ acre South Canyon City owned property (Assessor's Parcel #2183-113-00-020). Rural (R) In conjunction with a Location and Extent Review for a Public Archery Practice Range, the City of Glenwood Springs has concurrently applied for a General Administrative Permit for a Public Use in the rural zone district. The Location and Extent Application has previously been reviewed and detailed Staff Reports prepared dated April 25, 2012 and June 13, 2012 (copies are attached). At a public hearing held on July 11th , the Planning Commission approved the Location and Extent Review for the Supplemental Site, located Y. mile south of the 1-70 South Canyon Exit, south of the Colorado River and located on the east side of County Road 134. The approval was documented by Planning Commission Resolution No. 2012-02. A copy of the Resolution is attached. II. Authority -Applicable Regulations A. The Land Use Tables contained in Section 3-501 of the ULUR, designate Public Use within the Rural Zone District as requiring Administrative Review. B. Section 4-104 of the ULUR sets forth the Administrative Review Procedures. All requirements have been met, including the notice requirement to adjacent property owners within 200 ft. The Applicant has provided proof of mailing by submitting certified return receipts for the notice. C. The Application has been reviewed based on applicable portions of the ULUR concurrently with the Location and Extent Review process. III. Staff Analysis 1. Previous Staff Reports contain extensive details on the two sites, layout and improvements for the proposed practice archery range, comprehensive plan compliance, referral comments, and public comments. 2. Copies of all referral comments and public comments are attached with this supplemental Staff Report. The alternative Site 2 was proposed by the Applicant in response to public comments regarding the initial Site 1 including compatibility with surrounding properties, impacts on wildlife, operations, management, monitoring, and the fact that the site was an historic school site. 3. Supplemental Site 2 offers significant improvements including access, compatibility, operational enhancements, utilizing existing improvements and minimizing any additional site disturbance. The findings and recommendations in the June 13th Staff Report supports the Supplemental Site 2 as appropriate for the proposed use. 4. Some of the concerns noted in the previous Staff Report were recognized as General Administrative Permit issues and they were antiCipated to be addressed by Conditions of Approval associated with this site specific review. Key topics for which conditions of approval are appropriate are summarized below: • Access Permits and improvements for access off of County Road 134 • Parking Areas and Access Driveway • Coordination with Historic Preservation • Operations related to safety and signage • Operations related to sanitation and water • Overall site ownership and management • Public Usage • Operations related to seasonal and intermittent use 2 IV. Suggested Findings and Recommendations The Staff Analysis supports a finding that the City of Glenwood Springs Archery Practice Range -Public Use, Supplemental Site 2, is in compliance with Article III, and other applicable Sections of the ULUR, subject to the following conditions: 1. All representation of the Applicant contained in the application shall be considered conditions of approval unless specifically modified by the Director Decision. 2. We have rescheduled your public hearing with the Planning Commission and the date for your Director's Decision as noted below. The Applications will be processed concurrently and you will need to ensure that notice requirements for both reviews are met. LOCATION AND EXTENT In accordance with the ULUR, the Planning Commission will consider your application at a Public Hearing which has been scheduled for Wednesday, July 11, 2012. The meeting will begin at 6:30 p.m. and will be held in the County Commissioner's Meeting Room, Garfield County Plaza Building, 108 8th Street, Glenwood Springs, Colorado. As a matter of process, public notice for the hearing is required in accordance with the procedures contained in Section 4-103 (F), as outlined below, with the exception that "the timeline for publication, mailing and posting shall be not less than seven (7) nor more than thirty (30) days prior to the public hearing", pursuant to Section 4-112 (G). The Applicant shall be solely responsible for the public notice. F. Notice of Public Hearing. Certain land use change applications will require a public hearing. Unless otherwise provided by these Regulations, when a public hearing is required the following public notice shall be required. 1. Notice by Publication .... applicant shall have published a notice of public hearing in a newspaper of general circUlation in the area that the proposed land use change is located. Publication of said notice shall follow a form prescribed by the County. Notice to Adjacent Property Owners . .. . the applicant shall send by certified mail or by a nationally recognized ovemight courier, retum receipt requested, a written notice of the public hearing to the owners of record, as shown in the office of the County Clerk and Recorder or Assessor ... of all adjacent property within a 200' radius. Within the same time period written notice shall be provided to owners of mineral interests in the property (other than construction materials as defined in Section 34-32.5-10 CRS, as amended) in accordance with Section 24-65.5-101, et seq., CRS, as amended. (Resolution 2009-53) 3. Posting of Notice. . .. the applicant shall post a notice of the public hearing on the property. Such notice shall consist of at least one sign facing each adjacent road right-of-way, and located so as to be fully visible from the road right-of-way generally used by the public. Such signs shall be provided to the applicant by the Planning Department. (Reso 2009 -53) 4. The notice shall include the property's legal description, a short narrative describing the current zoning and proposed land use change, and an announcement of the date, time and location of the scheduled hearing, names of the owners of the property and their designated representative. 5. Proof of Notice. At the public hearing, the applicant shall provide proof of publication, proof of notification or attempt of notification of adjacent property owners, and proof of posting notice on the property. The applicant shall provide proof of notification or attempt to notice owners of mineral interest in the subject property. GENERAL ADMINISTRATIVE PERMIT In order to facilitate the timing of the concurrent review we have scheduled the date for the Directors Decision on your General Administrative Permit for July 3, 2012. As a matter of process, public notice at least 15 days prior to the Director's Decision is required by written notice by certified mail, return receipt requested, to the owners of record of all property adjacent to the property within a 200 ft. radius and the mineral owners of record in the office of the County Clerk and Recorder. The Applicant shall be solely responsible for the mailing of the notice. The Applicant shall present proof of the required notice to the Building and Planning Department prior to the Director's Decision. It shall be the obligation of the Applicant to correct any deficiencies in the public notice such that proper notice in form and substance can be established. Please note that the Location and Extent Review requires publication and posting in addition to mailed notice. A notice poster will be enclosed with the hardcopy mailing of this letter. Included for your convenience is the following summary of key dates. 1. Your Public Notice must be mailed return receipt requested by the Applicant by Monday, June 18th to meet the General Administrative Permit deadline. This mailing can include both notices for the Location and Extent (Planning Commission) and General Administrative Permit (Director's Decision). 2. Location and Extent Public notice must be submitted to the Rifle Telegram by noon, June 22"d for publication the following week on June 28th• (contact information for the paper is mborkenhagen@postindependent .com). 3. The notice poster needs to be posted on both potential sites visible from a public right-of-way by July 3rd. 4. The Applicant will provide the proof of notice (return receipts, proof of publication and posting) prior to the Director's Decision or Public Hearing. 5. The Director's Decision will occur on July 3rd. The Board of County Commissioners, Applicant, and Adjacent Property Owners have a 10 day period to request reconsideration of the Director's Decision. 6. The Planning Commission Public hearing will be held on July 11, 2012.
