Supplemental Site: Generally situated in Section 2, T6S, R90W, ~mile south of the Interstate 70, South Canyon Exit and accessed off County Road 134 at an existing driveway. Both sites are part of the overall 1800+ acre South Canyon City owned property (Assessor's Parcel #2183-113-00-020). Rural (R) I. SUPPLEMENTAL INFORMATION After further analysis and review including public inpuUcomments the City updated their request to include an alternate site, still located on City owned property and in the South Canyon Parklands area. The alternate location is detailed in the Supplemental Submittals dated May 2012 and included with your packet. The site was included after additional review by City Staff and representatives of the City's Historic Preservation Committee. Details on the original site are contained in the April 25 Staff Report. Information on the supplemental site and relevant Staff analysis is contained in this report. The Supplemental site is on the east side of the County Road, adjacent to and south of the Railroad Right-of-Way and in the general vicinity of the original South Canyon mine load-out facilities. It is improved with an existing dirt access drive, parking area, and turnaround area. It is fairly level along the north portion of the site sloping up to the south and eventually having steep slopes along the south edge of the proposed archery area. The site has a variety of shrubs and grasses with a large tree located near the parking area. Adjacent uses include the Railroad Right-of-way, open space, and located further south on the City Property a gun club/shooting range and a city landfill. Vicinity Map The general dimensions and attributes of the archery practice area will remain the same as summarized below: a. Approximately 5 targets set out at 10 yd. intervals up to a maximum of 50 yds. b. The targets will be positioned with a hillside backstop. c. A temporary fabric shade structure will be installed when the facility is in use during the summer and removed during the off season. d. A gravel parking area separate from the County Road will be provided and sized to serve approximately 5 vehicles. e. The archery range will be located adjacent to the parking area and at the Supplemental Site accessed by a short walking pathway. 2 f. The overall range area will be approximately 70 yds. by 70 yds. (on an approximately 1% acres site). g. No change is proposed for services as the site will not require utilities. h. Potable water will be individually provided by participants and for special events. i. Sanitary facilities are proposed to be provided only for special events through the use of a portable toilet. j. The sites will be signed with appropriate safety rules and operational procedures and the City will maintain ownership, oversight, and maintenance of the facility. View of the Supplemental . Site Archery Range Area II. COMPREHENSIVE PLAN The Supplemental site remains in the same Comprehensive Plan Designation of Residential Medium High Density (RMH). The same Comprehensive Excerpts remain relevant to both sites including the Recreation, Opens Space and Trails Vision noted below. Section 5 -Recreation, Open Space, and Trails Vision Open spaces, recreational trails and parks are available throughout the county and access to public lands and river corridors have been preserved and enhanced. Recreation and tourism industries are encouraged and supported in appropriate locations throughout the county. 3 Ill. STAFF ANALYSIS FUTURE LAND USE MAP EXCERPT FROM COMPREHENSIVE PLAN A. Staff supports a finding of general conformance with the Comprehensive Plan based on the excerpts noted above and in the April 251h Staff Report. Some operational issues (i.e. support infrastructure, water and sanitation) will be addressed in the General Administrative review. B. The Supplemental site is located within the City of Glenwood Springs Area of Influence and the City is the Applicant and Property Owner. Other than coordination of development review no other intergovernmental agreements appear to apply to the area of the site. City and County approvals exist for other uses within the South Canyon Parkland Area including the existing Gun Club Shooting Range. C. The Supplemental site has several attributes that support its designation as the preferred site including: (1) improved access; (2) better suited for monitoring and maintenance; (3) opportunities for joint venture with historic preservation; (4) no new county road access points; and (5) existing grading for parking. 4 View of the Site Looking West Towards the Parking Area D. The Supplemental Application materials were also referred to several County Departments and the Bureau of Land Management (BLM). Supplemental comments from the County Departments included: (1) Road and Bridge had no objections to either site with the need for a driveway access permit and concrete or asphalt apron at the access point noted; (2) Environmental Health had no new comments (previous comments addressed sanitation needs); (3) Vegetation Management noted the need for weed management in particular regarding Scotch Thistle. No comments have been received from the BLM at this time. E. While the County had previously been contacted by neighboring property owners regarding the original site, no comments have been received regarding the supplemental site. The Applicant's updated their notice lists and have completed public notice requirements in accordance with code requirements. Evidence of proper notice will be reviewed at the public hearing. Should additional written comments be received they will be presented to the Commission. F. Previous concerns regarding compatibility with historic sites were noted the Applicant did additional research on the Supplemental Site. A letter from representatives of the City of Glenwood Springs Historic Preservation Commission has been provided along with mapping of the historic use of the Supplemental Site. Avoiding any impacts to the historic features or ruins on the site and compatibility with potential future historic enhancements such as an access trail and interpretive elements are part of the current archery range proposal. 5 Historic Mapping Provided by the Glenwood Springs Historic Preservation Commission South Canon Station Historic Site South Canon Station ( 1902 • 0 1919)· Consisled ollhe Colorado Mldand Railroad loading yard, tipple, electric powerhouse, poet olftce (1905), and poes~bly an ice house. Concerns regarding impacts on wildlife, operations issues including trash, vegetation preservation, and weed management will be addressed in the County's General Administrative Review process and are anticipated to include conditions regarding City Operations and Management Plans for the site. Issues including infrastructure and safety provisions, designated practice stations, fencing and signage are anticipated to also be addressed in the administrative review process. H. The improvements have been designed for minimal site disturbance and will utilize existing areas already impacted for access and parking. Should the use be discontinued the site can be reclaimed or maintained for historic access and interpretive uses. 6 IV. SUGGESTED FINDINGS Approval of a Location and Extent Review for either site should include the following findings in accordance with Section 4-112 and 7-102 of the ULUR which are supported by the Staff analysis: (1) The City of Glenwood Springs South Canyon Archery Practice Range is in general conformance with the applicable provisions of the Garfield County Comprehensive Plan; and (2) The Location and Extent review has been applied for by the City of Glenwood Springs owner of the property and is consistent with intergovernmental agreements regarding application review . . As noted in the Staff Analysis the ongoing administrative review is available and appropriate for addressing specific operational and compatible use issues. While that application is not reviewed by the Planning Commission, evidence and testimony presented at this hearing can be included in the Director's deliberation on the administrative application. The Director's Decision is currently scheduled for consideration on June 14th after the Planning Commission's decision on the Location and Extent Review. V. SUGGESTED RECOMMENDATION A. A draft resolution including the suggested findings noted above and the general . provision outlined below will be provided for consideration by the Planning Commission. A motion by the Planning Commission should designate which of the proposed sites is approved and should include authorization for the Chairman to sign the Resolution. • The Planning Commission approval is based upon the representations of the Applicant contained in the application submittals and made during the Planning Commission public hearing. B. This also is a good spot for this. I have no objections to this site either. This site will also need a driveway permit from Road and Bridge. The difference on the driveway permit for this site is that this one will not need a culvert but will need an concrete or asphalt apron at the approach to CR 134 to protect the edge of road. The archery range and parking lot will be built in an area that has had heavy infestations of the county listed noxious weed, Scotch thistle. In the past, the City's Parks Department has had a successful treatment program for noxious weeds in South Canyon. Will the responsibility for weed management on this site fall under the Parks Department? If not, who will be responsible and what are their plans for weed management? South Canyon was primarily a coal mining area with some_ ranching. The school population wis constantly changing as miners came and went. The community at one time had many houses, a boarding house for the miners, a saloon and a general store. Now there are a few homes and the area is used for the grazing <if cattle. Elsa did her own janitor work before leaving the school at night as well as preparing the lessons and seat work for all eight grades to use during the following day. She took the day's lessons home each night to grade so they could be returned to the pupils the nel.t day. Although the day was long and hard, Elsa has fond memories of the life of a country school teacher. She feels each child received individualized instruction and she shared a compassion and concern for learning with each child. She did not attend .a country school while growing up, but she wishes she had. EXHIBIT I o 4769 134 Road Glenwood Springs, CO 81602 April19, 2012 GARFIELD COUNTY PLANNING AND ZONING Mr. Glenn Hartman: This letter expresses my concerns about the proposed archery range in South Canyon. First, let me state that I do approve of the concept. It is time that the City of Glenwood acknowledges the need for a public shooting range, but to construct a facility only for archers seems discriminatory. Presently, individuals with guns have only the "private" Glenwood Gun Club which ties up over 300 acres of city parklands. My concerns are twofold: first-the process, and secondly-the location. As a major and the senior property owner in South Canyon I did not receive the certified notice of the proposal as my name was "not on the County Assessor's list." After learning of the project on April16 (from my neighbors who had received a certified letter), I contacted Glenn Hartman and later Tom Barns of the City of Glenwood, and I did receive a written notice from Mr. Barns. I also visited the County Assessor's office and learned that my name and property location and description are and have been accurately on file! In comparing the notice I received with the copy my neighbor received, it is apparent that the last paragraphs differ greatly. My notice lists a public hearing on April 25, while my neighbor's lists a May 3 deadline for input with no mention of a hearing date. Based on this discrepancy and the time frame involved, perhaps the project needs to be put on hold until.2!! parties receive the same information. -x:-~ a..z;/~~v<-After reviewing the application itself, I would find the proposal more favorable is some rationale was offered as to the need for the facility as well as the choice of location. Why was this site, the furthest from the existing gun range, chosen? Could this archery range be combined with the existing gun range where a gravel parking lot is in place, a maintained road is already built, and limited restroom facilities exist? Maybe the locked gate at the gun range could be moved down toward the creek and the archery facility could be built on the east side of the road. I certainly am not in favor of the construction of an unsightly chain link fence surrounding the archery site! As I have expressed to Mr. Hartman and Mr. Barns, the proposed site has historical significance as the site of one of the school locations for South Canyon District 36. The large ugly tree was indeed planted by my mother Elsa Miklish who taught school there. To the Hood family the tree has historical and sentimental significance. It appears from the map that the tree will not be affected by the range; however, we would like some assurance that the actual school site and the tree are noted and preserved. This area is also known as the sledding hill and is used by many people during the winter. These individuals have ample parking at the turn around by the cattle guard or on the side of the extra wide road. Is the construction of a gravel parking lot, which according to the application will be used only sporadically, necessary? The application notes that no culverts are required. Why build a parking lot that is accessed by a ditch? The issues of safety and trash have been a long-standing bone of contention between the residents of South Canyon and the City of Glenwood. People shoot from the side of the road because there is nowhere else to fire a gun; as I stated earlier, access to the gun club is not easily obtained. Most shooters are careful and courteous, and they clean up after themselves. For those who leave trash shooters as well as individuals needing to dispose of appliances and other junk-nothing much happens. We rarely see City of Glenwood crews cleaning; we see the County supervised work force or the Richardson family and other residents cleaning up the mess. There is no assurance that this facility will be adequately policed or maintained. As residents we do not need yet another unsightly area that requires our attention! The proposed location is designed to attract shooters. Set up a target and they will come. Arrows are as lethal as bullets. The horses and cows owned by Hood Ranch are safely up the canyon a couple of miles. The Richardson animals, however, are pastured next to the proposed range. This is an obvious safety concern for both the animals and the people tending to them. In summary, I am asking that the request for an archery range be reworked due to the issues of safety, trash, historical preservation, environmental aesthetics and the fact that a shooting facility already exists in the canyon. If the plan to construct a mountain bike trail is still viable, dangerous activities such as shooting should be confined to one easily supervised area. Yours truly, ~~/>i/dC~d Charlotte A. The archery site is part of the overall 1800+ acre South Canyon City owned property (Assessor's Parcel #2183-113-00-020). Rural (R) I. BACKGROUND-DESCRIPTION OF PROPOSAL The proposal is located on approximately 1% acre site within the overall 1800+ acre South Canyon Park Lands property. The site is currently a meadow along the west side of the County Road. It slopes moderately up away from the road. The meadow is bordered by Gambel Oak and similar native vegetation. The City proposes to construct a public archery practice range consisting of approximately 5 targets set out at 10 yd. intervals up to a maximum of 50 yds. from the shooting line. The targets will be positioned with a hillside backstop. A temporary fabric shade structure will be installed when the facility is in use during the summer and removed during the off season. A gravel parking area separate from the County Road is anticipated and will be sized at approximately 2500 sq.ft. serving up to 5 vehicles. The archery range will be located adjacent to the parking area. The overall range area will be approximately 70 yds. by 70 yds. The facility will operate seasonally primarily from April to October with targets to be removed when the facility is not in use. No permanent structures are proposed and the only site disturbance will be for the construction of the parking area. The parking area will connect to the County Road by a short driveway and will be sized to allow vehicles to turn around so that entry and exiting movements will be in a forward manner (i.e. avoid any backing movements onto the County Road). The site is not proposed to be served by central utilities including water and sanitation. Potable water will be individually provided by participants and for special events. Sanitary facilities are proposed to be provided only for special events through the use of a portable toilet. The site will be signed with appropriate safety rules and operational procedures. The City will maintain ownership, oversight, and maintenance of the facility. VICINITY MAP II. AUTHORITY -CRITERIA A. The Colorado Revised Statutes (§30-28-110(1)(a)) requires that ... Whenever any county planning commission ... has adopted a master plan of the county ... no road, park, or other public way, ground, or space, no public building or structure, or no public utility, 2 whether publicly or privately owned, shall be constructed or authorized in the unincorporated territory of the county until and unless the proposed location and extent thereof has been submitted to and approved by such county planning commission. More specifically, (CRS §30-28-11 0(1 )(d)) requires that the acceptance, widening, removal, extension, relocation, narrowing, vacation, abandonment, change of use, or sale or lease of or acquisition of land for any road, park, or other public way, ground, place, property, or structure shall be subject to similar submission and approval, and the failure to approve may be similarly overruled. B. Sections 4-112 and 7-102 of the ULUR address Location and Extent Review including the criteria for the Planning Commission review and approval. Excerpts from the ULUR criteria are provided below: SECTION 4-112 H. Conformance with Comprehensive Plan. The Planning Commission shall determine whether the project conforms to the Comprehensive Plan. The findings of the Planning Commission shall be communicated to the applicant. SECTION 7-102 COMPLIANCE WITH COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS. The land use change is consistent with applicable provisions of the Garfield County Comprehensive Plan and any intergovernmental agreements between the County and a municipality that applies to the area where the use will occur. C. The current review by the Planning Commission is for the Location and Extent application and focused on the criteria and process noted above (broad Comprehensive Plan/Intergovernmental Agreement topics). A concurrent review through the County's General Administrative Permit process for a Public Use in the Rural Zone District is also being processed by the County. The administrative review addresses more of the site specific and operational concerns and is reviewed by the Director of the Building and Planning Department, Fred Jarman. For a public use or building, the approval of a Location and Extent request in the initial step toward obtaining other land use approvals (i.e. General Administrative Permits). 3 Project Location Map Ill. COMPREHENSIVE PLAN A. The South Canyon site is located in an area designated as Residential Medium High density (RMH). Most of the surrounding properties are also designated RMH or Public. While the focus of this designation is on residential use, the proposed site and surrounding City owned South Canyon Park Lands are utilized for open space and public uses with no residential development anticipated at this time. B. Selected excerpts from the text of the Comprehensive Plan 2030 are provided below and reflect the general conformity of the City's proposal with the Comprehensive Plan. In particular items from Section 4, Economics, Employment, Tourism and Section 5, Recreation, Open Space and Trails are provided. 4 FUTURE LAND USE MAP EXCERPT FROM COMPREHENSIVE PLAN Section 4 -Economics, Employment and Tourism Issues: * The growth of tourism in Garfield County continues to diversify the county economy. Tourism based commercial activities are an important part of the commercial economic sector, and tourism based employment provides jobs for Garfield County residents. Policies: 6. The county recognizes that the tourism industry is an important part of the regional economy and the County recognizes that the tourism industry is enhanced by (1) open space and scenic vistas (2) public trails and other recreational opportunities (3) public access to public lands (4) a healthy environment and habitats for hunting and fishing (5) green belts and open area between communities (6) clean air and water (7) local foods and local produce. Strategies and Actions: 5. Where appropriate, encourage diverse tourism related development in order to sustain it as an economic and employment base in Garfield County. 6. Ensure that tourism development is compatible with adjacent land uses and preserves the natural environment of the county. 7. Encourage commercial/tourism development in areas where existing infrastructure (water /wastewater facilities) are currently available and where affordable housing is convenient. 5 Section 5-Recreation, Open Space, and Trails Vision Open spaces, recreational trails and parks are available throughout the county and access to public lands and river corridors have been preserved and enhanced. Recreation and tourism industries are encouraged and supported in appropriate locations throughout the county. Issues: i1f In comprehensive plan public meetings and a 2008 survey, strong public support was indicated for the County to take a more active role in both trails and open space. * Recreational opportunities are an important part of tourism in Garfield County. Goals: 3. Provide opportunities for the tourism industry to utilize recreational resources as well as to preserve recreation resources for local access. Policies: 3. Open space dedications must include provision for maintenance. 5. Encourage development that contributes to the continuation and enhancement of commercial tourism in or near recreation areas. Strategies and Actions: 1. Work with municipalities, and other organizations to collaboratively develop a Colorado River trail and preservation plan. IV. STAFF ANALYSIS A Staff supports a finding of general conformance with the Comprehensive Plan based on the excerpts noted above while identifying there may be some operational issues with provision of appropriate support infrastructure for the facility (water and sanitation). B. The site is located adjacent to the City of Glenwood Springs Area of Influence and the City is the Applicant and Property Owner. Other than coordination of development review no other intergovernmental agreements appear to apply to the area of the site. C. The Application was referred to several County Departments and the Bureau of Land Management (BLM). Comments from the County Departments are attached and noted: (1) the need for a driveway access permit and coordination of driveway improvements; (2) the need to address sanitation or portable toilet facilities for the site; and (3) no vegetation or weed concerns. No comments have been received from the BLM at this time. D. The County has been contacted by adjoining property owners and a newspaper article on the proposed site noting its history as a school site has been submitted and is 6 attached as an exhibit. Verbal comments received expressed concerns about impacts (wildlife), operations (trash), and preservation of a prominent historic tree located in the center of the meadow. Should additional written comments be received they will be presented to the Commission. E. The improvements have been designed for minimal site disturbance. Should the use be discontinued the site can be reclaimed and/or the parking area closed off to prevent use. The General Administrative Permit process should address operational issues including infrastructure and safety provisions. Designated practice stations, fencing and/or signage may be appropriate to protect users and address overall operations and safety concerns. F. Public Notice for the Planning Commission's hearing is required by the ULUR. The Applicant should provide proof of compliance with the notice requirements at or prior to the hearing. V. SUGGESTED FINDINGS Approval of a Location and Extent Review should include the following findings in accordance with Section 4-112 and 7-102 of the ULUR: (1) The City of Glenwood Springs South Canyon Archery Practice Range is in general conformance with the applicable provisions of the Garfield County Comprehensive Plan; and (2) The Location and Extent review has been applied for by the City of Glenwood Springs owner of the property and is consistent with intergovernmental agreements regarding application review. As noted in the Staff Analysis the ongoing administrative review is available and appropriate for addressing specific operational and compatible use issues. While that application is not reviewed by the Planning Commission, evidence and testimony presented at this hearing can be included in the Director's deliberation on the administrative application. VI. SUGGESTED RECOMMENDATION A draft resolution including the suggested findings noted above and the general provision outlined below will be provided for consideration by the Planning Commission. It comprised an area of 16.05 square miles in Section 21, 22, 27 and 28, T6S R90W and Section 36 T5S R90W. South Canyon was primarily a coal mining area with some ranch· ing. The school population was constantly changing as miners came and went. The community at one time had many houses, a boarding house for the miners, a saloon and a general store. Now there are a few homes and the area is used for the grazing of cattle. Signs of the coal mine remain. The school was located a short distance before the second cattle guard on the right hand side of the road as you drive south and on a little fiat. The school burned down in 1947 when Aina Bailey was teacher and students then went tp the private home of Frank DeBoy through 1954 when Mary Skaggs was the teacher. All that remains at the site is a big elm tree planted by Elsa Liden Miklish and her pupils in an observance of Arbor Day while she was teaching there plus some of the charred remains of the school. The school had no water or electricity. It had a pot belly stove for heat. It had art orga~donated by Mrs. Blair, County Superintendent, that had been in the county courthouse. The first teacher of record was W.B. Harrison and the first school board was James Duce, president; James Dalrymple, secretary; and David Penman, treasurer. Other teachers at South Canyon School included: Lettie Walters, Fannie (McReynolds) Wonderly, Margaret Lucksinger, Livia Doyle, Verbania Randall, Dorothy MarOlt, Vakntine Crook, Elizabeth Cozza, Cecile Hart, Gussie Hahnewa!d, Ora Ware, Ena -Murcray, Emogene Collier, Mayne Flynn, Anna Duboff, Pauline FawcctL, Gladys Prertderast, and a Ms. Waggoner. Mrs. Elsa Miklish started her day with raising the flag and reciting the Pledge of Allegiance with her students. She taught reading, writing, mathematics, science, geography, civics, history, health, music, art, crafts and put on special programs and parties at Christmas, Halloween, Valentine's Day, Easter and Arbor Day as well as observing president's birthday's. The school did not have a large play area but games such as Hide'n Seek, Ante-Over, Kick-the-Can, Red Rover, Run-Sheep-Run, Fox 'n Geese, or work-up softball gave the children exercise during recess and noon. Elsa did her own janitor work before leaving the school at night as well as preparing the lessons and seat work for all eight grades to use during the following day. She took the day's lessons home each night to grade so they could be retumed to the pupils the ne).t day. Although the day was long and hard, Elsa has fond memories of the life of a country school teacher. She feels each child received individualized instruction and she shared a compassion and concern for learning with each child. She did not attend .a country school while growing up, but she wishes she had. The creation of this "silent sport" facility will provide a safe location for local archers to practice and learn the activity, and the lot will allow for easy access to the practice site. The use of portable toilets and trash receptacles has been discussed with minimal support. The actual use of the site is normally limited to 60-90 minutes, and we do not encourage food being brought in during the classes or training. The reality is these items will be used for target practice, much like signs have been treated historically. If a special event was held on site we would contract for portable restrooms for the event only. The cooperation between the county and city on this project has been appreciated. The site is safe, provides good opportunity for this recreational pursuit, and the proposal is consistent with activity allowed in county Comprehensive Plan. We look forward to approval and completing this project in May of June of this year. Thanks again for your assistance!
