Staff requests a site specific reclamation plan and a seed mix. The submitted noxious weed map indicates the presence of the state and county listed noxious weed, spotted knapweed. Staff requests that the applicant remove and bag all mature, seeded spotted knapweed plants prior to any construction. The surface area to be reseeded has been quantified as 23.78 acres. Staff recommends a revegetation security of $59,450 (23.78acres x $2500/acre) The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards section in the Garfield County Weed Management Plan. Special Warranty Deed and Quit Claim Deed not including Reservoir Parcel Under the terms of the "Purchase and Sale Agreement" dated June 30, 2004 by and between Tom Brown and Union Oil, Union Oil granted unto Tom Bl'Own Fee title to the parcels of real property described in Schedules I-At through I-A47, subject to the reservations and restrictions set forth on the Special WalTanty Deed and any other surface interest owned by Union Oil further described on the form of a Quit Chlim Deed but not indncting the Reservoir Land as depicted 011 Exhibit A (please see the mar which shows the lands in question). Chevron Shale had tirst right of refusal to acquire the surface and water rights only from Union Oil as described in that certain Deed and Agrcement effective November 9, 199.'i hetween lInion and Chevron on the lands li sted on Exhibit A. Promptly following the execution of said Purchase and Sale Agreement, Union Oil gav!:: Chevron Shale 60 days wri[(en notice to ind icate their election to purchase said lands. If Chevron failed to respond or acquire these lands within 60 days receipt of this notice, it was agreed th at Union would sell those lands on Exhibit A to Tom Brown, Inc. in accordance with the ten11S uf the Purchase and Sale Agreement. The letter was dated and delivered in accordance with the terms of that certain Deed and Agreement effective November 9, 1995 to Chevron Shale on July 1, 2004. Under the terms of the Quit Claim Deed dated June II, 2004, it specifically states "except the fee interest to the surfuce rights to that parcel of real property, the legal description of which is attached as Exhibit A (the "Chevron Reservoir Right of First Refusal Pm'cel") and except watcr storage rights related to such parcel." It further states in the next paragraph that "Grantor and Grantee agree and intend that this instrument shall convey to Grantee all of Grantor's interest in and to o il, gas and other minerals in and under the lands described above (including those under the land described on the attached Exhibit A". Assignment anel Assumption AgrC'C'mC'nt (R('servoir Parcel 11) On September 21, 2004, Unioll Oil exccuted the "Assignment and Assumption Agreement (Reservoir Parcel II)" and assigned to Tom Brown all right, title and interest to the parcel of lands described in Exhibit A. Please note that Exhihit A now clescribr_~ these lallds as the "Reservoir Parcel", not "Chevron Reservoir Right of First Refusal Parcel and Water Rights" as they originally were on the Quit Claim and Special Warranty Deed. Special Warranty Deed induding Rl'.s~r\'olr Parcel A Special Wan'anty Deed was also executed and assigned to Tom Brown on September 24, 2004 to include those lands described in Exhibit A. Therefore, Tom Brown was originally assigned the mineral rights but later assigned the surface and water rights in accordance with the terms of Chevron's First Right of Refusal. These plants compete aggressively with native vegetation and tend to spread quickly because environmental factors that normally control them are absent. Disturbed soils, altered native vegetation communities, and areas with increased soil moisture often create prime conditions for weed infestations. The primary vectors that spread noxious weeds include humans, animals, water, and wind. The Colorado Noxious Weed Act (State of Colorado 2005) requires local governing bodies to develop noxious weed management plans. Both the State of Colorado and Garfield County maintain a list of plants that are considered to be noxious weeds. The State of Colorado noxious weed list segregates noxious weed species based by priority for control: I. List A species must be eradicated whenever detected. 2. List B species' spread should be halted; may be designated for eradication in some counties. 3. List C species are widespread and the State will assist local jurisdictions which choose to manage those weeds. The Garfield County Weed Advisory Board has compiled a list of21 plants from the State list considered to be noxious weeds within the county (Appendix A). The Garfield County Weed Advisory Board has duties to: I. Develop a noxious weed list; 2. Develop a weed management plan for designated noxious weeds; and, 3. Recommend to the Board of County Commissioners that identified landowners submit an integrated weed management plan for their properties (Garfield County 2002). 3.2 Observations Noxious weeds observed in the project area include musk thistle (Carduus nutans-State B List), cheatgrass (Bromus tectorum -State C List), bull thistle (Cirsium vulgare -State B List), spotted knapweed (Centaurea maculosa -State B List), common mullein (Verbascum thapsus -State List C) (Figure 1; Appendix B), field bindweed (Convolvulus arvensis -State List C) and halogeton (Halogeton glomeratus -State List C). Musk thistle and spotted knapweed are listed by Garfield County. No other state listed weeds were observed. In areas where soil disturbances have created growing conditions that favor non-native vegetation, several unlisted nuisance weed species are present. Biological control agents are available but ineffective in popUlations less than 5 acres in size. * Type: A = annual; B = bwnl11al; P = perenl11al; Bold = Garfield County LIst WestWater Engineering Page 4 of9 May 2013 • Prior to delivery to the site, equipment should be cleaned of soils remaining from previous construction sites which may be contaminated with noxious weeds. • Equipment and material handling should be done on established sites to reduce the area and extent of soil compaction. • In all cases, temporary disturbance should be kept to an absolute minimum. • Top soil, where present, should be segregated from deeper soils and replaced as top soil on the final grade, a process known as live topsoil handling. • If stored longer than one growing season, topsoil stockpiles should be seeded with non-invasive sterile hybrid grasses. • Wetland vegetation, if encountered, should be live-handled, like sod, temporarily watered if necessary, and placed over excavated sub-soil relative to the position from which the wetland sod was removed. • Cut-off collars should be placed on all wetland and stream crossings to prevent back washing (seed vector) and to ensure that soil moisture conditions are not impacted after construction so that native plants can re-establish from the existing seed bank. • If working in weed infested sites, equipment should be cleaned of potentially seed-bearing soils and vegetative debris prior to moving to uncontaminated terrain. • After construction, disturbed areas outside the footprint of the development should be immediately reseeded with an appropriate seed mix. Herbicides: Many of the listed noxious weed species in Colorado can be controlled with commercially available herbicides. Annual and biennial weeds are best controlled at the pre-bud stage after germination or in the spring of the second year. Selective herbicides are recommended to minimize damage to desirable grass species. It is important that applicators adhere to concentrations specified on herbicide containers. Herbicides generally do not work better at higher concentrations. Herbicide failures are frequently related to high concentrations that result in top kill before the active ingredient can be transported to the roots through the nutrient translocation process. If directed on the herbicide label, a surfactant or other adjuvant should be added to the tank. Grazing: In the event grazing is allowed in the project area, it should be deferred in reclaimed areas until revegetation of desirable species has been successfully established and seeded plants have had the opportunity to reproduce. Monitoring: Areas where noxious weed infestations are identified and treated should be inspected over time to ensure that control methods are working to reduce and suppress the identified infestation. The sites should be monitored until the infestations are eliminated. These inspections can then be used to prioritize future weed control efforts. 3.8 Commercial Applicator Recommendations A certified commercial pesticide applicator licensed in rangeland and/or right-of-way/industrial weed control (depending on site characteristics) is a necessary choice for herbicide control efforts. An applicator has the full range of knowledge, skills, equipment, and experience desired when dealing with tough noxious weeds.
