BACKGROUND -DESCRIPTION OF PROPOSAL A. The Colorado Division of Wildlife (DOW) in conjunction with the Colorado Wildlife Heritage Foundation have submitted an Application to the Garfield County Planning Commission for Location and Extent approval for the construction of a new DOW Service Center for Area 8. The Application has been submitted in accordance with Section 4-112 of the Garfield County Unified Land Use Resolution of 2008 as amended (ULUR). The property is located at the southwest quadrant of Exit 109, Interstate 70 (Canyon Creek Exit), south of the eastbound off ramp. It is located approximately four miles west of Glenwood Springs and three miles east of New Castle. The new Service Center will include an office building, shop building, parking lot and access drive connecting to the existing interchange/frontage road. The office will be approximately 4,400 sq.ft. in size and the shop approximately 3,200 sq.ft. (based on site plan drawings). The facility will operate with approximately 16 full-time employees and will provide public contact services, information, licensing, office and support/shop spaces. It is estimated (per the submittals) that only 3 or 4 of the employees report to the office during peak traffic hours, while other employees are primarily in the field and report to the office only sporadically. The property is comprised of 2.09 acres and is located between the eastbound offramp and the Union Pacific Railroad Right-of-Way, north of the Colorado River. The property is generally level with modest slopes up to the off-ramp and it is currently vacant. The Property is zoned Commercial Limited. The facility will be served by a private well for water and an individual septic disposal system for waste water. The Applicant has also applied to the Colorado Department of Transportation (COOT) for necessary access permits to serve the site. Construction of an access drive will be required and is shown on the site plans. 5 0 , 10 SCALE IN IotM.ES II. AUTHORITY -CRITERIA A. The Colorado Revised Statutes (§30-28-110(1)(a)) requires that ... Whenever any county planning commission ... has adopted a master plan of the county ... no road, park, or other public way, ground, or space, no public building or structure, or no public utility, whether publicly or privately owned, shall be constructed or authorized in the unincorporated territory of the county until and unless the proposed location and extent thereof has been submitted to and approved by such county planning commission. More specifically, (CRS §30-28-110(1)(d)) requires that the acceptance, widening, removal, extension, relocation, narrowing, vacation, abandonment, change of use, or sale or lease of or acquisition of land for any road, park, or other public way, ground, place, properly, or structure shall be subject to similar submission and approval, and the failure to approve may be similarly overruled. B. Sections 4-112 and 7-102 of the ULUR address Location and Extent Review including the criteria for the Planning Commission review and approval. Excerpts from the ULUR criteria are provided below: 2 SECTION 4·112 H. Conformance with Comprehensive Plan. The Planning Commission shall determine whether the project conforms to the Comprehensive Plan. The findings of the Planning Commission shall be communicated to the applicant. SECTION 7·102 COMPLIANCE WITH COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS. The land use change is consistent with applicable provisions of the Garfield County Comprehensive Plan and any intergovernmental agreements between the County and a municipality that applies to the area where the use will occur. III. COMPREHENSIVE PLAN A. The property is designated by the Comprehensive Plan 2030 as Commercial and is bordered by areas designated as Residential Medium High Derisity (R-MH). The Comprehensive Plan designation is consistent with the existing zoning and the proposed use of the property. B. Selected excerpts from the text of the Comprehensive Plan 2030 are provided below and reflect the general conformity of the proposed Service Center with the goals, policies, objectives and strategies contained in the Plan. In particular Sections on Natural Resources, Economics, Employment, Tourism and Recreation, Open Space, and Trails support the activities of the DOW and the current proposal for a new Service Center. Excerpt from Section 4 -Economics, Employment, Tourism Policy #6. The county recognizes that the tourism industry is an important part of the regional economy and the County recognizes that the tourism industry is enhanced by (1) open space and scenic vistas (2) public trails and other recreational opportunities (3) public access to public lands (4) a healthy environment and habitats for hunting and fishing (5) green belts and open area between communities (6) clean air and water (7) local foods and local produce. Excerpt from Section 5 -Recreation, Open Space, and Trails f/f Recreational opportunities are an important part of tourism in Garfield County. Excerpt from Section 8 -Natural Resources Issues: 1{1 Tourism is an integral component of the economy of Garfield County. 3 Therefore, it is important, for economic development, to respect the natural environment that brings residents and visitors to the county. 1/J Many of the natural resources in the county are also under the jurisdiction of other agencies and extend beyond county boundaries. Therefore, a cooperative approach is required. iff The continuity of wildlife corridors, preservation of riparian and other wildlife habitat, and protection of native fish species, such as the cutthroat trout, are all important to watershed health. Threats include development pressure in sensitive areas from industry, land use, and roads. Goals: 1. Ensure that natural, scenic, ecological, and critical wildlife habitat resources are protected and/or impacts mitigated. Figure B: Comprehensive Plan 2030 Future Land Use Map C. Comprehensive Plan 2030 Future Land Use Map: The mapping shown above illustrates areas designated for Commercial (red), Residential Medium to High Density (tan) Flood Plain -River (blue) and Conservation Easement (teal). The large red border shown east of the site is the limit of the Town of New Castle Three Mile Area of Influence. 4 IV. STAFF ANALYSIS A. In support of the finding of compliance with the Comprehensive Plan the Applicant has included in the submittal material the report "The Economic Impacts of Hunting, Fishing and Wildlife Watching in Colorado" prepared by BBC Research and Consulting. The activities and public services provided by the DOW and available through the proposed Service Center are critical elements associated with the findings of the report. The report estimates that in 2007, Garfield County had 579 jobs generated by Hunting and Fishing Economic Impacts (Exhibit IV-2, pg. 16). B. The Application was referred to the City of Glenwood Springs and the Town of New Castle in accordance with the ULUR and intergovernmental agreements between the City and Town and Garfield County. No comments have been received at this time but will be presented if received prior to the public hearing. Figure C: DOW Service Center Area 8 Site Plan .:., . C. The Applicant has documented adequate infrastructure and permits to service the site including a Division of Water Resources Well Permit, ISDS Permit from Garfield County, COOT Access Permit Application, and a Soils/Foundation Study. A detailed 5 traffic study submitted with the Application reflects that the level of service for critical movements is projected to maintain Levels of Service A and B with the proposed Service Center. D. The Applicant's site plan exceeds the County's off-street parking and loading zone requirements and provides an extensive area for trailer parking. It is suggested that any outside lighting including shop and parking areas be consistent with the County's policies for directing the lighting inward and downward toward the interior of the site. E. The Application was referred to several County Departments, CDOT and to the Glenwood Springs Fire Protection District that serves the Canyon Creek Area. No comments have been received at this time. Comments will be presented to the Planning Commission if received prior to the public hearing. It is suggested that the Applicant work with the fire district in regard to any appropriate fire protection improvements or provisions. F. Public Notice for the Planning Commission's hearing is required by the ULUR. The Applicant should provide adequate proof of compliance with the notice requirements at or prior to the hearing. V. SUGGESTED FINDINGS Approval of a Location and Extent Review should include the following findings in accordance with Section 4-112 and 7-102 of the ULUR: (1) The Colorado Division of Wildlife Area Service Center is consistent with the applicable provisions of the Garfield County Comprehensive Plan; and (2) The Location and Extent review was referred to the neighboring municipalities consistent with intergovernmental agreements .. VI. SUGGESTED RECOMMENDATION A draft resolution including the suggested findings noted above and the general provision outlined below will be provided for consideration by the Planning Commission. It is understood that the application is intended to comply with the Comprehensive Plan and Intergovernmental Agreement The following questions, concerns, or comments were generated: 1. The proposed site is near the Colorado River and associated floodplain. The application materials do not show the floodplain delineation or elevation. This should be verified. 2. Items that are typically required to show compliance with. the Garfield County Unified Land Use Resolution were not included in the application materials therefore compliance was not evaluated (such as a 24-hour well pump test, a water chemistry analysis, septic system design, a drainage report, an erosion control plan, etc.) 3. The site access is a road that is to be constructed on CDOT right-of-way. The applicant show evidence of obtaining a new access pelmit but any agreements or permission with COOT was not included with the application. Feel free to call if you have any questions or comments. EXHIBIT J I have reviewed the packet you sent and have no issues at this time. The applicants may need to be advised that if staff and visitors total 25 or more people 60 days or more per year that the potable water system becomes a public water supply regulated by CDPHE. In addition, future applications will need more information about water usage and wastewater flows to determine if the 1505 is regulated by Garfield County or by COPHE. I suspect it will be Garfield County 1505 permit (as there is already and 1505 permit application in the submittal) but no flow information or 1505 design was included for review. This is a condition the applicant will need to find a solution to that is acceptable to the Glenwood Springs Fire Department staff. This condition is not unique to this site. This area of our Fire District does not have a good water source to provide adequate fire flows for buildings constructed in the area or planned to be built in this area. Others who have built in this area have addressed this condition in one of two ways or both. Two solutions are: • Install a tank on site to hold an amount of water that is acceptable to the Fire Department. • Install an automatic fire suppression system in the service center office building. By doing so the size of the water storage tank can be reduced. Ingress/egress: The ingress/egress routes shown on the site drawings in the application materials look adequate for our engines to navigate the site. But if this application is approved to moves forward the architect or engineer shall provide the Fire Department Staff with a site plan showing via a computer program like Auto-Turn that our engines can easily navigate the site. The information on the turning radiuses of our equipment can be found on our website www.glenwoodfire.com. For this application these are the only comments we have.
