The Application is for your property located at 0088 Wildlife Way adjacent to Exit 109 (Canyon Creek) on Interstate Highway 70 (Assessor's Parcel Number 2123-351-00-072). The Application will be reviewed in accordance with the Garfield County Unified Land Use Resolution of 2008 as amended (ULUR) and in particular Section 4-112 contained therein addressing Location and Extent Reviews. This letter is to inform you that as of this date, your application has been deemed technically complete. As the initial review by the County Attomey's Office is ongoing additional legal comments may be anticipated during the review process. Please understand that a determination of technical completeness shall not be viewed as a recommendation of approval, finding of an adequate application, or a finding of general compliance with any goal or objective of the ULUR or the Garfield County Comprehensive Plan 2030. The Application will be reviewed by Staff and a Staff report will be generated and sent to you. In accordance with the ULUR, the Planning Commission will consider your application at a Public Hearing which has been scheduled for the Wednesday, May 11,2011 Planning Commission Agenda The meeting will begin at 6:30 p.m. and will be held in the County Commissioner's Meeting Room, Garfield County Plaza Building, 108 8th Street, Glenwood Springs, Colorado. (970) 384-3470 thirty (30) days prior to the public hearing." pursuant to Section 4-112 (G). The Applicant shall be solely responsible for the public notice. Please review the following notice requirements from Section 4-103 (F). F. Notice of Public Hearing. Certain land use change applications will require a public hearing. Unless otherwise provided by these Regulations, when a public hearing is required the following public notice shall be required. 1. Notice by Publication. . .. applicant shall have published a notice of public hearing in a newspaper of general circulation in the area that the proposed land use change is located. Publication of said notice shall follow a form prescribed by the County (Note: Publication is required in the Rifle Telegram with a deadline of Friday at noon for publication the following Thursday) 2. Notice to Adjacent Property Owners . .. . the applicant shall send by certified mail or by a nationally recognized overnight courier, return receipt requested, a written notice of the public hearing to the owners of record, as shown in the office of the County Clerk and Recorder or Assessor ... of all adjacent property within a 200' radius. Within the same time period written notice shall be provided to owners of mineral in interests in the property (other than construction materials as defined in Section 34-32.5-10 CRS, as amended) in accordance with Section 24-65.5-101, et seq., CRS, as amended. (Resolution 2009 -53) 3. Posting of Notice. . .. the applicant shall post a notice of the public hearing on the property Such notice shall consist of at least one sign facing each adjacent road right-of-way, and located so as to be fully visible from the road right-of-way generally used by the public. Such signs shall be provided to the applicant by the Planning Department. (Reso 2009 -53) 4. The notice shall include the property's legal description, a short narrative describing the current zoning and proposed land use change, and an announcement of the date, time and location of the scheduled hearing, names of the owners of the property and their designated representative. 5. Proof of Notice. At the public hearing, the applicant shall provide proof of publication, proof of notification or attempt of notification of adjacent property owners, and proof of posting notice on the property The applicant shall provide proof of notification or attempt to notice owners of mineral interest in the subject property 2 I have enclosed an appropriate public notice form and will provide a poster for the Public Hearing as noted above, for your convenience. These documents are provided to you as a courtesy. The Applicant must verify that all the information in these documents is correct. It shall be the obligation of the Applicant to correct any deficiencies in these documents such that proper notice in form and substance can be established. Please submit 17 additional copies of the completed Application with supplemental materials no later than Monday. April 25th These copies are required for distribution to the Planning Commission and referral agencies.
