GENERAL SUBMITTAL REQUIREMENTS [The following general application materials are required for all Limited Impact Review Applications in Garfield County. Application materials and review standards that are specific to an individual use (Community Facility, Parking Lot, Library, etc,) are detailed in Sections 3-301 of Article III and Article VII of the Unified Land Use Resolution (ULUR) of 2008.] A. Submit a completed and signed Application Form, an application fee, and a signed Agreement for Payment form. B. A narrative explaining the purpose of the application and supporting materials that address the standards and criteria found in Articles III and VII of the Unified Land Use Resolution of 2008. C. Copy of the deed showing ownership. Additionally, submit a letter from the property owner(s) if the owner is being represented by another party other than the owner. If the property is owned by a corporate entity (such as an LLC, LLLP, etc.) Please submit a copy of recorded "Statement of Authority" demonstrating that the person signing the application has the authority to act in that capacity for the entity. D. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing the subject property and all public and private landowners adjacent to your property (which should be delineated). In addition, submit a list of all property owners, private and public, and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the County Assessor's Office. You will also need the names (if applicable) of all mineral interest owners of the subject property, identified in the County Clerk and Recorder's records in accordance with §24-65.5-1 01, et seq. (That information may be found in your title policy under Exceptions to Title). E. Vicinity map: An 8 % x 11 vicinity map locating the parcel in the County. The vicinity map shall clearly show the boundaries of the subject property and all property within a 3-mile radius of the subject property. The map shall be at a minimum scale of 1 "=2000' showing the general topographic and geographic relation of the proposed land use change to the surrounding area for which a copy of U.S.G.S. quadrangle map may be used. F. A copy of the Pre-Application Conference form from the original PreApplication Conference. G. Submit 3 copies of this completed application and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the application has been deemed technically complete. I. Limited Impact Review Process The following section outlines and describes the Limited Impact Review process for the variety of uses that are governed by the Board of County Commissioners by the Unified Land Use Resolution of 2008 (ULUR). Please refer to Articles III and VII in the regulations themselves for a higher level of detail. [The following process is required for applications for land use changes that are subject to Limited Impact Review as defined in Table 3-501 or 3-502 in Article III.] A. Outline of Process. The Limited Impact Review process shall consist of the following procedures: 1. Pre-Application Conference (4-103 (A)) 2. Application (4-103 (B)) 3. Determination of Completeness (4-103 (C)) 4. Evaluation by the Director/Staff Review (4-103 (E)) 5. Public Hearing and Decision by the Board of County Commissioners (4-103 (G)) B. Submittal Materials: The following materials shall be submitted with a Limited Impact Review application and are more fully defined in Section 4-502 of Article IV of the ULUR. The Director may waive or alter any of these requirements if they are determined to be inappropriate or unnecessary to determining if the application satisfies applicable standards. 1. Limited Impact Review Amendment Process Any proposal to change conditions of approval or a site plan approved under these Regulations as a Limited Impact Review permit shall require application to the Director for Amendment of a Limited Impact Permit Approval. The Director shall review the application to determine whether the proposed change constitutes a sUbstantial change to the Limited Impact Permit approval pursuant to Section 4-107 of Article IV. A. Outline of Process. The review process for a proposed Amendment of an Approved Limited Impact Review shall consist of the following procedures. 1. Pre-Application Conference (4-103 (A)) 2. Application (4-103 (B)) 3. Determination of Completeness (4-103 (C)) 4. Evaluation by the Director/Staff Review (4-103 (E)) 5. Decision by Director (4-104(B)(5)) 6. The maximum square footage of structures less than 10,000 sq. ft. over 100% and structures over 10,000 sq. ft. by 10%, if a maximum has been specified in a permit or approval. c. Projected traffic such that a highway access permit or an amendment to a highway access permit is required as a result of the change. d. OWNER and COUNTY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. OWNER agrees to make payment of the Base Fee, established for the PROJECT, and to thereafter permit additional costs to be billed to OWNER. OWNER agrees to make additional payments upon notification by the COUNTY when they are necessary as costs are incurred. 4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board of County Commissioners for the consideration of an application or additional COUNTY staff time or expense not covered by the Base Fee. GENERAL PROJECT DESCRIPTION Applicant seeks allowance to construct a compressor station along an existing pipeline. Parcel is zoned Rural therefore a Compressor Station is permitted through a Limited Impact. The end result, if approved, is the issuance of a Land Use Change Permit for a Compressor Station. Compressor Station issues have historically been performance-standard related such as noise, vibration, and dust. Analysis is required to be submitted, such as a noise study, and adequate plans to alleviate or mitigate any potential impacts. State emission permits, stormwater management, erosion and sediment control. .. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS ~Garfield County Unified Land Use Resolution Sections: General submittal requirements include demonstration of ownership and proper authority to act on behalf of the surface owner. Due to the entities involved the County will require that recorded Statements of Authority be in place that designates what individual may sign for any corporation, LTD, trust, etc. It appears that the County wiU require those Statements for BJM, LTD and Antero Resources. A copy of Antero's lease may suffice to demonstrate their ability to apply to the County. Upon completion of 'the construction of the pipeline and facilities, the easement shall be deemed to be 25 feet in width. Within a reasonable time following completion of construction, Grantee will complete a survey of the easement as constructed and will execute for recording a written document with the correct legal description attached. The exact location of the right-af-way and easement conveyed shall be determined by the construction of Granteels pipeline and shall thereupon be established as being 10 feet on one side of the centerline and 15 feet on the other side. An Easement and Right of Way Conveyance shall then be recorded in the form attached to this instrument as Appendix "B". Upon execution of this Agreement, a Memorandum re easement shall be recorded in the form attached to this Agreement as Appendix "C". 2. In connection with the grant of that right-af-way and easement, the parties agree: 2.1 Northwest shall pay Grantors and Grantors accept the sum of $3,250 for the grant of right-af-way and easement. In addition, and upon completion of installation of the piepline, Northwest shall pay Grantors reasonable compensation for loss of crops due to construction of the pipeline and meter house. 2.2 Each party who signs this Agreement warrants that he or she has the requisite authority to sign on behalf of the party designated. -2- " , • • :.--' /.< .... The portion used for this purpose, however. shall not exceed 45 feet in total width. 2. The grant of right-of-way and easement herein by Grantors shall carry with it the grant of all rights necessary to operate and maintain the facilities over the right-of-way and easement hereby granted to Grantee, its successors and assigns, and the Grantee may assign the right-af-way and easement herein granted either in whole or in part, subject to the terms of the grant, and such right-of-way and easement shall be convenants running with the land and be binding upon Grantors, its successors and assigns. 3. In connection with construction, operation, inspection, replacement, repair and maintenance of the pipeline and facilities by Grantee (the "Work"), Grantee shall restore and repair any roads, ditches and fences to the condition comparable to which existed just prior to Grantee's Work, and Grantee shall compensate Grantor for any other damages actually incurred by Grantors in connection with Grantee's Work. 4. Grantee ~ay at any time, and upon permanent abandonment of said right-af-way and removal of improvements constructed, if any, upon the surface of the Property, shall execute and record a reconveyance and release hereof, whereupon the right-of-way and easement and all rights and privileges herein mutually granted shall be fully cancelled and terminated. 5. Grantors reserve the right to use and enjoyment of said property except for the purposes herein granted, but such use shall not hinder, conflict or interfere with Grantee's surface or subsurface rights hereunder or disturb its pipeline or facilities and no road, reservoir, excavation, obstruction or structure shall be constructed, created or maintained on, over, along or within said right-of-way without Grantee's prior written consent. 6. The: additional right-or-way and right of access shall in no case endure for a period in excess of one hundred eighty (180) days from lhe date hereof of the completion of initial installation, which ever period is the shorter. 4. Grantor is the owner of the surface of certain lands, part of which is described on Exhibit A (the "Lands"). B. Grantee wishes to receive a non-exclusive pipeline easement and right of way across the Lands; such easement and right of way is more particularly described on the attached Exhibit A (the "Easement"). C. Grantor wishes to grant a non-exclusive pipeline easement and right of way to Grantee and Grantee wishes to accept the Easement and use the Easement pursuant to the terms of this Agreement. GRANT OF EASEMENT AND AGREEMENT Now therefore, for and in consideration of$1 0.00 and other good and valuable consideration the receipt and sufficiency of which are hereby acknowledged, Grantor and Grantee agree as follows: I. Grant of the Easement. Grantor hereby grants, sells and conveys to Grantee, its successors and assigns, a free and unobstructed easement and right of way as described on Exhibit A, to lay, construct, inspect, maintain, repair, operate, alter, replace, relocate, change the size of, abandon in place and remove at will, in whole or in part, a single pipeline for the transportation of oil, gas, petroleum and other gases, fluids or substances which can be transported through a pipeline and all appurtenant facilities thereto, including without limitation, all drips, valves, fittings, meters, aerial markers, graphite and steel anodes and other devices for the control of pipeline corrosion, and similar appurtenances as may be necessary or convenient in the operation of said pipeline over, across, under and upon the lands described in Exhibit A. 2. The Easement. The Easement shall be 50 feet wide during construction, reverting to 25 feet in width following construction, as described oil Exhibit A. The pipeline shall be buried a minimum of 48 inches deep on Grantor's property and the location of such pipeline shall be marked using signs displaying Grantee's name and emergency contact infonnation at appropriate intervals along the pipeline route. 3. Grantee's Use of the Easement. Grantor shall not construct nor pennit to be constructed, any house, building or any other structure or facility on the Easement without the express prior consent of Grantee, such consent not to be lUlreasonably withheld. Grantor agrees not to change the grade, remove dirt from the surface of the Easement or impound water over the Easement without the prior approval of Grantee, which shall not be unreasonably withheld. Any wires, cables, conduit, fiber optics, pipelines or other utilities that Grantor installs, or allows others to install, within the Easement shall be no closer to Grantee's pipeline than 5 feet horizontally nor closer than 2 feet above or below Grantee's pipeline. Grantor shall also provide Grantee with access to any additional lands required to make any repairs to the pipeline following the initial construction, and Grantee shall reimburse Grantor for the actual cost of any damages incurred on Grantor's property during such repair work. 4. Covenants Running With the Land. This Agreement, together with the other provisions of this grant of Easement , shall constitute covenants TlUlning with the land, binding upon Grantor, its heirs, legal representatives, successors and assigns, for the benefit of Grantee, its successors and assigns. Grantee's rights herelUlder may be assigned in whole or in part to one or more assignees. 5. Surface Damage Payments. The initial consideration paid by Grantee to Grantor includes any and all damages that may be sustained by original construction of the pipeline( s) within the Easement, including without limitation, cutting trees and damages to land, trees, buildings, fences and growing crops. As soon as reasonably practical following any construction or following any repairs made to the Pipeline(s), Grantee shall promptly repair or replace any fences and restore any affected area to the natural grade and reseed all such affected areas with site-appropriate native grasses. 6. Weed Control. Grantee shall be responsible for controlling all noxious weeds on the Easement. 7. Special Warranty of Title. Grantor hereby binds himself, his heirs and legal representatives, successors and assigns, to warrant and forever defend all and singular the above described Easements and rights, unto Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same, or any part thereof by through and lUlder Grantor. 8. Notice of Termination of Easement. Grantee shall notify Grantor in writing when it wishes to tenninate the Easement and abandon any of the pipeline(s) located in the Easement. At such time, Grantee and Grantor shall determine whether the pipelines shall be abandoned in-place by purging the pipelines with inert gas, water or mud and Grantee shall assign the pipeline(s) to Grantor in an instrument that will be placed of record. At such point, Grantee shall have no further liability associated with the pipeline(s). 9. Prohibited Activities. WHEREAS, Grantor owns certain property (the "Lands") located in the SW/4 Section 30-T6S-R92W Garfield County, Colorado that Grantee is interested occupying for the purpose of installing, constructing, operating and maintaining certain gas handling facilities for collecting, separating, compressing, dehydrating, treating andlor processing gas produced from wells into Grantee' II pipeline system; and WHEREAS, Grantor desires to grant an exclusive easement to Grantee for such purposes; NOW, TIIEREFORE, in consideration of the mutual promises contained herein, the receipt and sufficiency of which is hereby acknowledged, the parties enter into this Easement Agreement ("Easement") as follows: 1. Grant of Easement. Grantor hereby grants to Grantee, its successors and assigns, a free and unobstructed easement described on Exhibit A, to lay, construct, inspect, maintain, repair, operate, alter, replace, relocate, change the size of, abandon in place and remove at will, in whole or in part, pipelines for the transportation of oil, gas, petroleum and other gases, fluids or substances which can be transported through a pipeline and all appurtenant facilities thereto, including without limitation, all drips, valves, fittings, meters, aerial markers, graphite and steel anodes and other devices for the control of pipeline corrosion, and similar appurtenances as may be necessary or convenient in the operation of said pipeline(s) over, across, under and upon the lands described in Exhibit A, for the purposes of installing, constructing. operating and maintaining certain gas bandling facilities for collecting, separating, compressing, dehydrating, treating and/or processing gas produced from wells into Grantee's pipeline system. Grantee shall have the right to expand or contract the size of the Easement during the term of the Easement, at its sole discretion, as long as such expansion or contraction is confined to the five (5) acre site described on the attached Exhibit A. 2. Term of Easement. The term of the Easement sha1l be perpetual, from and after the Effective Date, until cancelled in writing by Grantee. 3. Purpose of Easement. Grantee shall have the full, free, and exclusive use of the surface of the Lands during the term of this Easement, together with the right of ingress and egress to and from the Lands, and from, over, and across other lands owned by Grantor. The route of the access road to the Lands shall be agreed upon between Grantor and Grantee, and Grantee shall construct and maintain such access road from County Road 333 to the Lands at its sole cost and risk. 4. Equipment Ownership and Termination. All equipment, fixtures, and facilities placed on the Lands by Grantee, shall be and remain the property of Grantee. Grantee shall notify Grantor in writing if it wishes to terminate the Easement Upon notification of termination of this Easement, Grantee shall have a reasonable time, not to exceed 180 days, in which to remove all of Grantee's equipment, fixtures, and facilities. However, Grantee shall be allowed to abandon in-place all below ground piping by purging such piping with inert gas, water or mud and assigning such piping to Grantor. Following the termination of this Easement, Grantee shall restore the Lands, within reasonably acceptable industry standards, to its original condition as required by all applicable rules, orders, laws and regulations. 5. Taxes. Grantor shall pay the real e$tate taxes on the Lands. Grantee shall pay all business property, personal property, ad valorem or other similar taxes assessed against any structure, material, equipment, fixtures, and facilities placed on the . Lands by Grantee. 6. Site MaintePlII\ce. Grantee shall construct and maintain a security fence around the perimeter of the Easement area where any of the above ground equipment is located. The fencing material shall be approved by the Grantor. The access gate sha11 be kept locked and secure when Grantee's personnel are not present. The color used for painting the facilities and used on the side of any buildings housing the equipment shall also be approved by Grantor. The access road(s) to the site shall be properly graded, drained, graveled and maintained by Grantee for the term of the Easement. Grantee shall keep the Easement free and clear of all debris, litter and noxious weeds. Grantee sha11 operate and maintain the Easement and ail equipment located on the Easement in accordance with all applicable rules, laws, orders and regulations. 7. Access to Records. Grantor sha11 have access to Grantee's construction, operation and maintenance drawings and records, including II\1Y required reports, notices, plans, tests or other docwnents during Grantee's normal business hours in the office where Grantee maintains such records. However, Grantor Illlly be required to sign a Confidentiality Agreement prior to revie~ such data or information if such information requested by Grantor is not within t4e public domain. Assignment. This rights granted herein may be assigned in whole or in part. 9. Covenant Running with the Land. This Easement, and all of its terms and provisions shall extend to and be binding on the heirs, devisees, executors, administrators, representatives, successors and assigns of Grantor and Grantee and shall be a covenant running with the Land. 10. Liability and Indemnification. Grantee covenants and agrees to fully defend, protect, indemnify and hold harmless Grantor, its officers, directors, partners, principals, employees and agents, from and against any and all claims, demand or cause of action and any associated liability, Cost or expense (including but not limited to reasonable attorney fees and costs incurred in defense of Grantor and its agents), for any damages or losses incurred in connection with Grantee's construction, operation or maintenance activities located on the Easement or upon any of the equipment located thereon. 11. Application of Law. This Easement sball be applied and construed in accordance with Colorado law, without regard to the conflicts of laws principles thereof. Additionally, Grantee shall comply with all applicable rules, orders and regulations of the Colorado Oil &, Gas Conservation Commission ("COGCC,,), or its successor organj 7lItion, in connection with Grantee's operations upon the Lands for the term of the Easement. 12.
