State Engineer We have reviewed the additional information regarding the above-referenced proposal to subdivide a 69.36-acre parcel intD six tracts, with one commercial tract, three large residential tracts fDr future subdivision, one public/quasi-public tract, and one designated access/utility tract. The applicant proposes to provide water and sewer service through the Consolidated Metropolitan District (the District). In a letter dated November 7,2005, Patricia K. Flood, P.E., of Wright Water Engineers indicates that the current annual water demand supplied by the District is 1157 AF, with total existing commitments, including the above-mentioned project, at 1947 AF. The current annual depletion amount is 666 AF, the annual depletion expected after completion Df the proposed development is 1121 AF, and the dry year augmentation requirement is 841 AF. Based on the cDntract for 1250 AF of water in Ruedi Reservoir, it appears that the District has sufficient water rights and augmentation sources to supply the proposed development. Therefore, pursuant to CRS 30-28-136(1 )(h)(II), it is our opinion that the proposed water supply will not cause injury to existing water rights so long as the District operates according to the terms and conditions of its current plan for augmentation.
