The Association may maintain errors and omissions insurance for its officers and directors in addition to liability and casualty insurance coverage, all of which shall be asses~ed to the Owners as a common expense of the Association. 5. Lot Development Regulations. (a) Building Envelopes. (I) Number and Location of Buildings. No buildings or structures shall be placed, erected, altered or permitted to remain on any Lot other than one (1) single-family dwelling house, including an attached garage, an accessory dwelling unit (which may be subject to County review and approval), and the following permissible accessory components or buildings or structures. (i) One (I) guest house; (ii) One (I) detached garage; (iii) Other buildings within each Building Envelope depicted on the Master Plat approved by the Architectural Committee; and (iv) Fencing and othernon-residential improvements outside of th~ Building Envelopes as may be permitted by the Architectural Committee. Nothing herein shall preclude separate kitchen facilities in a single-family dwelling house and in any guest house or structure. The building site plans for all such buildings and structures shall be subject to approval by the Architectural Committee. In approving or disapproving the building site plans, the Architectural Committee shall take into consideration the number of . buildings or structures, the locations and heights with respect to topography and finished grade elevations, the effect thereof on the native setting and surroundings of the Prehm Ranch, and any (impact on views and privacy ofthe Lots. lfthe Architectural Committee shall be ofthe opinion that the placing of a single-family dwelling together with all of the accessory buildings or structures authorized herein on a Lot would not be in keeping with the overall purpose ofthese covenants, the Architectural Committee, in addition to its other powers and duties hereunder, shall have the authority to limit the number of permitted accessory buildings or structures on any Lot. (2) Principal Residence to be Constructed First. No guest house, garage or other outbuildings shall be constructed on any Lot until after commencement of construction of the principal dwelling house on the same Lot, except as otherwise specifically permitted by the Architectural Committee. (J) Architectural Committee. The Architectural Committee shall mean the Board of Directors of the Prehm Ranch Owners Association, Inc. as said Board of Directors is' presently constituted and shall be constituted from time to time in the future or Committee members appointed from time to time by the Board of Directors. Said Architectural Committee shall have and exercise all of the powers, duties and responsibilities set out in this instrument. Architectural Committee members may, but need not be, Owners. (2) Approval by Architectural Committee. No improvements of any kind, including but not limited to dwelling houses and structures, barns, stables, outbuildings, swimming pools, tennis courts, ponds, parking areas, fences, walls, garages, drives, antennae, flag poles, curbs and walks, shall ever be erected, altered or permitted to remain on any lands with the Prehm Ranch, nor shall any excavating, clearing or landscaping be done in conjunction therewith on any lands within the Prehm Ranch, unless complete architectural plans and specifications and a site plan showing the location and orientation thereof and proposed site improvements, grading and clearing plans for such erection or alteration and landscaping are approved by the Architectural Committee prior to commencement of such work. The Architectural Committee shall consider the materials to be used on the external features of said buildings or structures, including exterior colors, harmony of external design with existing structures within the Prehm Ranch, location and height with respect to topography and finished grade elevations and harmony of landscaping with the natural setting and native trees, brushes and other vegetation within the Prehm Ranch. The complete architectural plans and specifications must be subrnitted in at least two (2) complete sets, and must include at least four (4) different elevation views. One (1) complete copy of plans and specifications shall be signed for identification by the Owner and left with the Architectural Committee. In the event 'the Architectural Committee fails to take any action within forty-five (45) days after complete architectural plans for such work have been submitted to it, then all of such submitted architectural plans shall be deemed to be approved. In the event the Architectural Committee shall disapprove any architectural plans, the person or legal entity submitting the same may appeal the matter at the . next annual or special meeting of the members of the Prehm Ranch Owners Association, where an affif11)ative vote of at least a majority of the members' votes entitled to be cast at said Members' (meeting shall be required to change the decision of the Architectural Committee. (3) Variances. Where circumstances, such as topography, soil conditions, location of property lines or Building Envelopes, location of trees and brush, or other matters require, the Architectural Committee, by an affirmative vote of a majority of the members of the Architectural Comrnittee, may allow reasonable variances as to any of the covenants and restrictions contained in this instrument and may allow reasonable modifications in the placement of utilities outside the easements reserved on the Master Plat on such terms and conditions as it shaH require; provided that no such variance shaH be finally allowed until thirty (30) days after the Architectural Committee shall have mailed a notice of such variance to each member of the Prehm Ranch Owners Association. Bow'd of County Commissioners FROM: Fred Jarman, AICP, Director of Building and Planning DATE: March 31, 2010 RE: Administrative Pelmit The Unified LWld Use Code of 2008 requires BOCC notification regarding Director Detennination of issuance of Administrative Pemlits. Attached is the necessary information regarding an appLication for an Accessory Dwelling Unit (ADU) on Lot 5 at The Preserve at Prehm Ranch. On March 31, 2010 the Director issued a Determination conditionally approving the request. The Board of County Commissioners has the ability to call-up the application for public hearing if it is deemed necessary. Pursuant to the regulatory requirements the request for call-up should be received by our office by within 10 calendar days (April 12, 2009). REOUEST Mr. John Schneider requests a pennit for an Accessory Dwelling Unit (ADU) in the Rural Zoning District on Lot 5 at The Preserve at Prehm Ranch. This parcel is 35.751-acres, with water provided via a second well approved by the Colorado Division of Water Resources and property tested for quality and quantity under the provisions of the Unified Land Use Resolution of 2008, as amended. An Individual Sewage Disposal System has been designed to accommodate this use. 2. DESCRIPTION OF THE PROPOSAL The applicant requests an Administrative Pennit to allow for an Accessory Dwelling Unit (ADD) on Lot 5 at The Preserve at Prehm Ranch. The ADD will be a new residential structure containing less than 1,500 square feet of finished floor area and the minimum lot size requirement has been met. 3. APPLICABLE REGULATIONS The Land Use Table contained in Alticle III of the Land Use Resolution of 2008 (ULUR), as amended designates an ADU as a Use Permitted Subject to Administrative Review. Section 7-801 stipulates requirements that must be met in order to apply for the General Administrative Permit. Those requirements include a minimum lot size of 2 acres or twice the minimum lot size in zone districts where the minimum lot size is less than 2 acres. The subject property is 35.751 acres therefore compliant with this requirement. In addition, the maximum square footage for an ADU in the rural zone district is 1,500 square feet which is not exceeded in the current request. . Section 4-104 stipulates the Administrative Review Process and Section 7-801 provides applicable standards for an ADU. All requirements have been met, including the requirement for notice to the adjacent properties, which the applicant has completed; submitting certified return receipts for that notice. 4. REFERRAL COMMENTS The Glenwood Springs Fire Department commented on the proposed Accessory Dwelling Unit and offered recommendations for constrution of the residence to driveway distance and landscaping considerations to reduce wildfire hazard. A copy of these recommendations have been forwarded to the applicant and is attached as Exhibit A. Garfield County Road and Bridge recommended conditions for proper permitting of oversize/overweight vehicles during condition which is attached as Exhibit B. A condition has been added for proper pennitting of oversize/overweight vehicles utilizing the County's roadway network. 5. RECOMMENDATION Staff finds that the proposed ADU is in compliance with Article III, §4-104, §4-501 and §7-801 of the Garfield County Unified Land Use Resolution of 2008 as amended and recommends that the Director approve the General Administrative Permit to allow an ADU on a property legally described as Lot 5 at The Preserve at Prehm Ranch, with the following conditions: 1.
