PROJECT DESCRIPTION
Existing Use: Agriculture and rangeland and undeveloped
Proposed Use (From Use Table 3 -503): Compressor /Pipeline Pump Station
Description of Project: To build a compressor station adjacent 10 the existing pipeline to better distribute natural gas in the area
The compressor station will be situated within a 4.237 acre site and consist of a compressor building, utility building, and a control
building. Electricity will be supplied to the site and access will be by an existing agriculture road off of CR 115. This access road
crosses two (2) parcels owned by the Nieslanik family and the point of access onto CR 115 iS proposed to be improved with the
development of this land use. A worker will be be at the facility once a day for up to a four (4) hour period.

PAYMENT AGREEMENT FORM
GARFIELD COUNTY ( "COUNTY ") and Property Owner ( "APPLICANT ") J &S Nieslanik, LLLP
agree as follows:
1. The Applicant has submitted to the County an application for the following Project: Spring
Valley Compressor Station
2. The Applicant understands and agrees that Garfield County Resolution No. 98 -09, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.

Dear Mr. Nieslanik,
As the current owner of the property, the two (2) Garfield County applications (Land Use
Change Permit /Limited Impact Review and Location and Extent) must be signed by J &S
Nieslanik LLLP. For submission to Garfield County. In addition, as the property owners,
J &S Nieslanik LLLP, must also sign an agreement to pay fees associated with the
applications. A statement of authority (SOA) must also be filled out and notarized for
proof to the county that you have authorization to sign on behalf of J &S Nieslanik LLLP.
This letter serves as confirmation for J &S Nieslanik LLLP. That Rocky Mountain
Natural Gas LLC, the lessee of the 5.297 acre property identified in Section 3 Township
7 South Range 88, also in Section 34, Township 6 South, Range 88 West. Garfield
County, Colorado, which the Spring Valley Compressor Station will be constructed on
and owner of the Spring Valley Compressor Station facility, shall be responsible for
paying all fees required by Garfield County for all of the planning and building permit
applications as related to our proposed Spring Valley Compressor Station.
Should J &S Nieslanik LLLP. Receive invoices from Garfield County that relate to these
applications, please forward them to me and I will see that they are promptly paid,
