RESOLUTION NO. PC -2013
A RESOLUTION CONCERNED WITH A LOCATION AND EXTENT APPLICATION,
PUSUANT TO C.R.S. § 30 -28 -110 FOR THE PARACHUTE BATTLEMENT MESA PARKS
AND RECREATION DISTRICT — COMMUNITY PARK
(CASE NO. LAEA 7669)
Recitals
A. Garfield County is a legal and political subdivision of the State of Colorado for
which the Board of County Commissioners is authorized to act.
B. Pursuant to law, the Board of County Commissioners of Garfield County has ap-
pointed the Garfield County Planning Commission.
C. The Parachute Battlement Mesa Parks and Recreation District (the "Applicant ")
in conjunction with Garfield County School District 16 and Community Holdings West
Inc. has applied to the Planning Commission as Case No. LAEA -7669 (the "Petition ") for
a location and extent review of the proposed Parachute Battlement Mesa Community
Park. The proposal is for creation of an approximately 6.15 acre park with a variety of
improvements including but not limited to an educational water feature, mountain bike
course, fitness stations, walking/jogging trails, themed playground, xeric landscaping,
demonstration garden, restrooms, a music pavilion, and parking areas.

D. The affected property is located at 0364 Sipprelle Drive, Parachute/Battlement
Mesa and is also known by Assessor's Parcel Number 2407- 084 -00 -182. The park is on
approximately 6.15 acres of the overall site which is more fully described on the attached
Exhibit A.
E. Pursuant to Section 4 -111 of the Garfield Land Use and Development Code as
amended and C.R.S. § 30- 28- 110(1)(a) the Planning Commission is required to review
the proposed location and extent of a public building, structure, park, or space to deter-
mine whether the proposal conforms with the County's Master Plan.
F. In accordance with state law, the Planning Commission has adopted a Master
Plan. The Master Plan applicable to this Petition is the Garfield County Comprehensive
Plan of 2030, as amended ( "Comprehensive Plan").
G. The Planning Commission opened a public hearing to consider the Petition on
September 11, 2013.
H. The Planning Commission closed the public hearing on September 11, 2013 to
make a final decision.
I. The Planning Commission, on the basis of substantial competent evidence pro-
duced at the aforementioned hearing, has made the following determinations of fact:
1. Proper notice of the public hearing on the Petition was provided as re-
quired by Sections 4- 111(B) and Table 4 -102 of the Garfield County Land Use
and Development Code as amended.
2. The Planning Commission determined that the Parachute Battlement Mesa
Community Park is in general conformance with the Comprehensive Plan.
3. The findings of the Planning Commission were communicated to the Ap-
plicant.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of Garfield
County, as follows:
1. The foregoing Recitals are incorporated by this reference.
2. That portion of the location and extent is described on Exhibit A reflecting the
proposed Parachute Battlement Mesa Community Park Site.
3. The location and extent request for the Parachute Battlement Mesa Community
Park is approved based on the Applicant's representations.
