O. Box 299, Parachute, Colorado 81635, (Grantee): WITNESSETJ, that the Grantor, for and in consideration of the sum of Ten Dollars and Other Good and Valuable Consideration, the receipt and sufficiency of which is hereby acknowledged, has granted, bargained, sold and conveyed, and by these presents does grant, bargain, sell, convey and confirm, unto the Grantee, its successors and assigns forever, ali the real property together with improvements, if any, situate lying and being in the County of Garfield and State of Colorado described as follows: Lot 1, Block 1, River Bluff Filing 6, a part of Battlement Mesa PUD, as recorded on July 18, 1983 at Reception No. 344070 SUBJECT To THE RESERVATION BY GRANTOR of all Grantor's interests in minerals and mineral rights, including oil and gas rights, lying in, on or under said Parcels and water and water rights, ditch and ditch rights associated with or appurtenant to said Parcels. SUBJECT TO A DEED RESTRICTIOI' that Grantee, by the acceptance of this conveyance, agrees for itself, its successors and assigns, their use of the above described real property shall be restricted to those uses described in the current PSR zone text for the Battlement Mesa PUD for a period of twenty (20) years from the date of this instrument. Likewise, this conveyance is subject to easements, restrictions, reservations and rights of way of record, or situate and in use, including those set forth on Exhibit A attached hereto and made a part herof. TOGETHER with all and singular the hereditaments and appurtenances thereto belonging, except as reserved hereinabove, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the estate, right, title, interest, claim and demand whatsoever of the Grantor, either in law or equity, of, in and to the above bargained premises. To HAVE AND TO HOLD the said premises above bargained and described with the appurtenances, unto the Grantee, its successors and assigns forever. The Grantor, for itself, its successors and assigns, does covenant and agree that it shall and will WARRANT AND FOREVER DEFEND the above- bargained premises in the quiet and peaceable possession of the Grantee, its successors and assigns, against all and every person or persons claiming the whole or any part thereof, by, through or under the Grantor.
