I. REQUEST 1 DESCRIPTION OF PROPOSAL
Chevron is seeking approval to amend Condition 18 of Resolution 2009 -41 to allow the existing
Temporary Produced Water Management Facility to operate for one (1) year from the date of permit
expiration on July 7, 2011. Within this year, the
existing temporary facility will be upgraded to ensure
continuous and uninterrupted produced water
handling in the Piceance Basin Natural Gas
Development area. The condition to be amended
reads as follows: The Special Use Permit for the
Temporary Produced Water Management System
shall expire 12 months from the issuance of permit,
subject to a review at that time to consider for
extension of another 12 months."

Under the present Unified Land Use Resolution 2008,
as amended, the request to change a specific
condition of approval constitutes a substantial change
and requires the Board of County Commissioner's
review and approval through a public hearing.
Background History
In 2009, the Applicant received Board of County
Commission (BOCC) approval to install and operate
a Temporary Produced Water Management Facility on a portion of well pad 598 -35 -BV and is
documented in Resolution 2009 -41 and Special Use Permit (Exhibit G).
The Applicant applied for a time extension and additional frac tanks in 2010 and received Garfield
County approval (administratively) to extend the permit term for a period of 12 months with a revised
expiration date of July 7, 2011 and permitting of 14 additional frac tanks to be stored on -site. See
the Land Use Change Pe_ rmit and site plan attached as Exhibit H. At the time of this request,
Chevron was planning for the installation of a permanent Produced Water Management Facility to
replace the Temporary Water Management Facility.
In 2010 a Limited Impact Review application was submitted for a permanent Produced Water
Management Facility and approved by the BOCC in February 2011. However, due to unfavorable
economy for the near -term natural gas market, the project funding for the permanent facility is not
available at this time. Consequently, the Temporary Produced Water Management Facility will need
to be in use longer than expected and the reason for this application.
In order to for the temporary facility to operate more efficiently, Chevron has submitted an
application to Garfield County to upgrade the facility. This application was deemed as a non -
substantial change and the Director's Determination is under review of the Applicant, BOCC, and
adjacent property owners within 200 feet of the subject parcels. The review period or the "appeal
period" ends June 20, 2011. If no objections are filed within this time period the Director's
Determination shall become final.
II. SITE DESCRIPTION
The Temporary Produced Water Management Facility is located in the central portion of the Clear
Creek Valley approximately 2.5 miles northwest of the end of County Road 211 and within the
Chevron Piceance Basin Natural Gas Development area. The facility occupies approximately 0.86
acres of an existing 3.4 acre well pad situated in Parcels 2137 - 321 -00 -008 and 2139 - 163 -00 -014
and within Resource Lands - Gentle Slopes zone district. The subject parcels and adjacent
properties have historically been used for cattle grazing, mining, and natural gas extraction.

III. REVIEW AGENCY AND OTHER COMMENTS
Comments have been received from the following agencies /community groups.
Garfield County Road and Bridge Department: No comment received.
Garfield County Vegetation Manager: No comments received.
Consulting Engineer - Mountain Cross Engineering, Inc. (Exhibit I): This consultant's review
generated no comments.
Garfield County Environmental Health (Exhibit J): This department doesn't have any issues with
the application.
Colorado Department of Transportation (Exhibit K): This agency has no comment on this
application.
Colorado Department of Public Health and Environment: No comments received.
Colorado Division of Wildlife (Exhibit L): This agency indicated that impacts to wildlife will be
"negligible ".
DeBeque Fire District: No comments received.
Town of DeBeque: No comments received.
IV. DISCUSSION
Chevron USA Inc. is requesting Garfield County to amend Condition No. 18 of Resolution 2009 -41
for a one (1) year time extension, commencing July 7, 2011, to continue to operate the existing

facility until the approved permanent produced water management facility is operating. Staff
suggests that a two (2) year time extension be given in order to allow time for the permanent facility
to be built and eliminate another public hearing before the BOCC requesting another time extension.
V. RECOMMENDED FINDINGS
1. Proper posting and public notice was provided as required for the public hearing before the
Board of County Commissioners.
2. The public hearing before the Board of County Commissioners was extensive and complete, that
all pertinent facts, matters and issues were submitted and that all interested parties were heard
at that hearing.
3. The above stated and other reasons, the proposed Land Use Change Permit has been
determined to be in the best interest of the health, safety, morals, convenience, order, prosperity
and welfare of the citizens of Garfield County.
4. The application has met the requirements of Amendment of a Major impact or Limited Impact
Permit Approval (Section 4 -501) of the Garfield County Unified Land Use Resolution of 2008, as
amended.
5. The proposed Land Use Change Permit for a time extension is consistent with the applicable
provisions of the Garfield County Comprehensive Plan of 2030.
VI. STAFF RECOMMENDATION
Staff recommends the BOCC approve the request for a Land Use Change Permit through the
Special Use Permit Amendment process to amend Condition 18 of Resolution No. 2009 -41 to allow
a two (2) year time extension for the temporary produced water management facility to operate with
an amended expiration date of July 7, 2013.
VII. RECOMMENDED MOTION

Recitals
A. Garfield County is a legal and political subdivision of the State of Colorado for
which the Board of County Commissioners (Board) is authorized to act,
B. On the 2 "d day of January, 1979, the Board adopted Resolution 79 -01 concerning a
Zoning Resolution for the County of Garfield, State of Colorado.
C. Pursuant to Section 9.03,04 of the Zoning Resolution of 1978, an application for a
Special Use Permit shall be approved or denied by the Board of County Commissioners after
holding a public hearing thereon in conformance with all the provisions of the Zoning
• Resolution.
D. • The Board held a public hearing on the 13th day of April, 2009, upon the
question of whether the above- described Special Use Permit should be granted or denied,

at which hearing the public and interested persons were the opportunity to express
their opinions regarding the special use permit.
E. The Board of County Commissioners closed the public hearing on April 1317-x,
2009, and acted on. the basis of substantial competent evidence produced at the
aforementioned hearing.
Resolution
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Com.rnissioners of Garfield County, Colorado, that the Special Use Permit is approved
based on the following findings:
A. The forgoing Recitals are incorporated by this reference as part of this Resolution.
B. Proper public notice via publication pursuant to Section 9.03.04 of the Zoning
Resolution of 1978, as amended, was provided as required by law for the hearing
before the Board of County Commissioners.
C,• An application for a special use permit was made consistent with the requirements
of Section 5.03 of the Garfield County Zoning Resolution of 1978, as amended.
D. The public hearing before the Board of County Conunissioners was extensive and
complete; all pertinent facts, matters and issues were submitted; and all interested
parties were heard at that hearing.
E. The proposed Special Use Permit is in compliance with the recommendations set
forth in the Comprehensive Plan for the unincorporated areas of the County.
F. The proposed Special Use Permit is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of Garfield County.
G. The Special Use Permit for the Temporary Produced Water Management System
proposed by Chevron USA, Inc., shall require that the following conditions be
satisfied:
1. That all representations of the Applicant, either within the application or
stated at the hearing before the Board of County Commissioners, shall be
considered conditions of approval unless explicitly altered by the Board.
2. That the operation of the facility be done in accordance with all applicable
Federal, State, and local regulations governing the operation of this type of
facility,
3. That the Applicant shall comply with the fire protection provisions included in
the rules and regulations of the Colorado Oil and Gas Conservation

Commission (COGCC) and the International Fire Code as the Code pertains
to the operation of this facility.
4, Vibration generated: the Temporary Produced Water Treatment System shall
be so operated that the ground vibration inherently and recurrently generated
is not perceptible, without instruments, at any point of any boundary line of
the property on which the use is located.
5. Emissions of smoke and particulate matter: the Temporary Produced Water
Treatment System shall he so operated so as to comply with all Federal, State
and County air quality laws, regulations and standards.
6. Emission of heat, glare, radiation and fumes: the Temporary Produced Water
Treatment System shall be so operated that it does not emit heat, glare,
radiation or fumes which substantially interfere with the existing use of
adjoining property or which. constitutes a public nuisance or hazard,
7. Volume of sound generated shall comply with the standards set forth in the
Colorado Revised Statutes, COGCC Series 800.
8. No storage of heavy equipment or materials is permitted after the construction
period.
9. No human habitation of this site is allowed at any time.
10. Any lighting shall be pointed downward and inward to the property center and
shaded to prevent direct reflection on adjacent property.
11. Water pollution: .in a case in which potential hazards exist, it shall be
necessary to install safeguards designed to comply with the Regulations of the
Environmental Protection Agency before operation of the facilities may begin.
All percolation tests or ground water resource tests as may be required by
local or State Health Officers must be met before operation of the facilities
may begin.
12. Prior to the issuance of the Special Use Permit, a plan that includes adequate
design for the spill containn.Zent basin for the produced water tanks on site
shall be provided to the Garfield County Project Engineer,
13. A maximum of ten (10) frac tanks may be installed on the site under this
Special Use Permit.
14. Prior to the issuance of the Special Use Permit, a reclamation security of
52500 per acre shall be submitted for the .86 -acre site disturbance, as per the
Garfield County Vegetation Manager. if the use as a water treatment system is
ended, reclamation shall be initiated within 60 days and ni.eet the requirements

set forth in the reclamation plan in place on t11.0 date the Special Use Permit
issued, or the site reclamation standards in place at the time of use cessation;
whichever is more stringent. The reclamation standards at the date of permit
issuance are cited in Section 4.06, 4,07 and 4.08 of the Garf eld County Weed
Management Plan (Resolution #2002 -94).
15. Dust mitigation on the sites and access roads must he performed to prevent
fugitive dust,
16. Prior to issuance of the Special Use Permit, written confirmation by a certified
wildlife biologist shall be provided to the Garfield County Planning
Department to ensure that no active nest sites are within a distance considered
by the Colorado Division of Wildlife (chart, page 19 of the Biologic Survey
section) to be adversely affected by human activity.
17. Bear -proof refuse containers shall be required on the site.
18. The Special Use Permit for the Temporary Produced Water Management
System shall expire 12 months from the issuance of permit, subject to a
review at that time to consider for extension of another 12 months.

Jim,
The Construction Permit for the uncontrolled emissions at the existing Water Management Facility is
attached. A revised Air Pollutant Emission Notice (APEN) was tiled with the CDPHE -APCD last month
for a General Construction Permit (GP05) for the produced water storage tanks proposed in SUAA-
6786. The APEN notification will allow for construction of the facility without having to wait for the
final permit. Chevron will self - certify compliance with the General Permit conditions within 180 days of
operation and once the certification is received and approved, the CDPHE will then finalize the permit.
Note that the air permit regulations have changed since this facility was originally installed and
Produced Water storage tank batteries and vapor recovery units are now covered under the General
Construction Permit (GP05) rather than the Construction Permit as the existing facility was issued
