Main Street Aspen, CO 81611 Re: Cowgill Subdivision Preliminary Plan Dear Stan: Garfield Coiinty BUILDING & PLANNING DEPARTMENT Thank you for the valid development application made on behalf of Ursula Cowgill submitted on May 20, 2003. The purpose of this letter is to notify you that the application has been deemed technically non- compliant for the following reasons: l . Pursuant to Section 4 :50(D) of the Subdivision Regulations, the Preliminary Plan map shall include "Names, addresses and phone numbers of owners(s), applicant (s), planner(s) and engineer(s) for the proposed subdivision... ". The "Planner ", Stan Clauson Associates, LLC., shall be identified on the map. 2. Pursuant to Section 4:50(H) of the Subdivision Regulations, "Proposed easements for drainage, irrigation, and access" shall be delineated on the Preliminary Pan map. According to the Geologic Evaluation prepared by CTL/Thompson, Inc., submitted with the application, "irrigation ditches are along and/or through the building envelopes... ". No irrigation ditches are represented on the Preliminary Plan maps. Please identify these ditches on the maps as applicable. 3. Per our conversation this week, it was my understanding that you had spoken to Kelly Woods of the CDOW regarding obtaining written comments regarding wildlife habitat on the subject property to be submitted with the application. I under that Ms. Woods would not provide comments until she received an application from Garfield County, which is standard practice. However, pursuant to Section 4 :70(D), Wildlife, of the Subdivision Regulations, please provide a general statement as to the wildlife habitat on the property. If you are unsuccessful obtaining the wildlife habitat designations on the subject property from CDOW, you may contact the County's GIS Department to obtain this mapping. 4. Pursuant to Section 4 :80 of the Subdivision Regulations, the drainage plan for the subdivision shall I be "the same scale as the Preliminary Plan ". Please submit a 24" X 36" Drainage Plan map in accordance with section 4:80. 5. It does not appear that Section 4:92(D) of the Subdivision Regulations has been addressed. According to the Geologic Evaluation Investigation prepared by CTL/Thompson, Inc., submitted with the application, percolation testing was not preformed due to winter conditions. According to section 4:92(D), testing shall be preformed and the results shall be submitted to the County. Fire Protection: According to the attached letter dated October 10, 2002, from Fred Jarman regarding Sketch Plan, it was suggested by the Planning Commission that at Preliminary Plan, "Fire protection will need to be addressed " Please refer to section 9:70 of the Subdivision Regulations regarding fire protection. 7. Please note that Garfield County considers shared accesses, serving more than one residence, as public roads. Pursuant to Section 9 :34 of the Subdivision Regulations, "all streets are dedicated to the public but all streets will be constructed to standards consistent with [the Subdivision] Regulations and repair and maintenance shall be the responsibility of the incorporated Homeowners Association of the subdivision." Therefore, the shared driveway(s) shall not be identified as easements but rights -of- -way. % 8. Pursuant to section 4:93 of the Subdivision Regulations: "All utility and road plans shall be marked "Not for Construction". " None of the map submitted with the application are Labeled as such. ✓ 9. Please provide a letter of authorization from the Applicant granting Stan Clauson Associates, LLC, permission to act on her behalf. yr 10. Please read, sign and submit the attached required Application form for subdivision. In addition, please read and sign the attached "Agreement for Payment" form. J11. Please resubmit the attached "Submittal Form for Land Use Reviews" by the Colorado Geologic Survey ( "CGS ") which, along with the check submitted in the amount of $485, will be sent with the complete application to CGS. Section 3:22 of the Garfield County Subdivision Regulations states that if the application is deemed technically non - compliant, you shall be notified in writing of the additional information needed and the application shall be suspended in the review process until such information is provided. Thus, this application has been suspended in the review process. You may request a conference with me not later than ten (10) working days after receipt of this letter if you are in need of further information. The applicant shall have six (6) months after the date of this letter to remedy the deficiencies noted herein, otherwise the application will be considered terminated.
