At a regular meeting of the Board of County
Commissioners for Garfield County, Colorado, held at the Commissioners
Meeting Room at the Garfield County Courthouse in Glenwood Springs on
the 12th day of May A.D. 19 86 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 86 -46
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARF.IELD COUNTY
SUBDIVISION REGULATIONS FOR SUSAN G. MACKIE.
WHEREAS, Susan G. Mackie has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30- 28- 101(10)(a) -(d), as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted April 23, 1984, Section 8:00 through
8:60 for the division of a 33.55 acre tract as described in Book 639, Page
165 through 167, as filed in the Office of the Clerk and Recorder of
Garfield County, Colorado, into two tracts of approximately 21.44 acres,
and 12.11 acres, more or less, which proposed divided tracts are more
particularly described as follows:
TRACT A: See attached legal description for Lot A.
TRACT B: See attached legal description for Tot B.
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that the
proposed division does not fall within the purposes of Part 1, Article 28,
Title 30, Colorado Revised Statutes 1973, as amended, for the reason that
the division does not warrant further subdivision review; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, proof of a
legal and adequate source 'of water on each of said tracts, that there is
adequate ingress and egress to said tracts, that the location of septic
tanks will be permitted by the Colorado Department of Health, that the
requested division is not part of an existing or larger development and
does not fall within the general purposes and intent of the subdivision
regulations of the State of Colorado and the County of Garfield, and
should, therefore, be exempted from the definition of the terms
'subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30 -28- -101
(10) (a) -(d), as amended; and

NOW THEREFORE, BE IT RESOLVED that the division of the above
described tracts "A" and "B" from the above described 33.55 acre tract is
hereby exempted from such definitions and said tract may be divided into
tracts "A' and "}3 ", and conveyed in the form of such tracts "A" and "B ",
all as is more fully described above, and that a copy of the instrument or
instruments of conveyance when recorded shall be filed with this
Resolution.

A tract of land situated in Lot-5 of Section 13, Township 7 South, Range 88 West of the 60 Prt
cipal Meridian, Garfield County, Colorado, and being more particularly described as fo lows:
Beginning at a point whence a brass cap found in place and properly marked for the Nor heast Cc
ner of said Section 13 bears N 18 °14'19" E 1444.67 feet; thence South 745.83 feet to a point or
a fence as built and in place; thence S 88 °48'41" W 787.51 feet on said fenceline to a fence cc
ncr; thence S 88 °48'41" W 24.33 feet to a point on the Easterly boundary line of Hawk idge Sut

A tract of land situated in the 02 of Lot 13, Section 18, Township 7 South. Range 87 West of
6th Principal Meridian and also in Lot 5, Section 13, Township 7 South, Range 88 West of the
Principal Meridian and being more particularly described as follows:
Beginning at the Northwest Corner of said Lot 13 (also being the Northeast Corner of said Lot
whence a brass cap found in place and properly marked for the Northwest Corner of said Section
18 (also being the Northeast Corner of said Section 13) bears N 02 °03'24" W 804.85 feet; thenc
N 88 °46'49" E 294.15 feet along the Northerly boundary line of said Lot 13; thence S 01 °13'15"
700.00 feet; thence S 22 °51'19" W 660.85 feet to a point on a fence as built and in place; the
S 88 °48'41" W 533.50 feet on said fenceline; thence North 745.83 feet; thence N 07 °31'03" E
600.00 feet to a point on the Northerly boundary line of said Lot 5; thence 5 86 °10'03" E 403.
