Industrial Operations: The Dalbo, Inc. operations at 2250 County Road 319, Rifle,
Colorado could best be described as a facility that includes a truck maintenance shop with
a truck wash, a storage yard for our rental tanks, our local business office, and a Kcl
mixing and storage tank plant.
We would like to expand our operations at this site as follows:
• Increase the size of our office from 1040 sq. ft. to 2080 sq. ft.
• Build a covered outdoor parts storage on the east side of the maintenance shop,
and expand our current parts storage by an additional 25' X 15'.
• Change the use of our wash bay building to an additional maintenance shop.
• Build a new outdoor truck wash bay 100' east of the 12,000 gallon LPG tank.
• Do any necessary electrical work to upgrade facility
• Approve an additional 1000 barrel tank at the tank farm for future needs when
necessary.
• Increase the number of trucks operating at our facility to 80.
• General grading and drainage will not change, but a grading and drainage plan is
included.
I have included the questions we have been asked to respond to; from the standards in
Section 5.03.07 for Industrial Operations:
(A) Existing lawful use of water through depletion or pollution of surface run -off,
stream flow or ground water;
We are using the water well we drilled for our water supply at the office
and maintenance shop. We have also been using a septic system for the
restrooms. The surface runoff that occurs is from rain water or snow melt and
it travels in the same general direction it did before we before we had our
storage yard. The diesel tank has a concrete containment around it. The fuel
line from the diesel tank is double wall piping to protection from leaks. All of
the above items have been built or installed per state and local guidelines to
insure that the environment is protected.
(B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise,
glare or vibration, or other emanations;
Our facility is somewhat isolated from any residential neighbors. We have
an Encana pipe yard and evaporation pond to the south of us. There are no
residential areas within 1 mile or more, depending on the direction. About a
half mile to the north we have some gas wells and industrial buildings.
We do not create any vapors. We use water from time to time to settle the
dust in our storage yard and we have our own truck which handles the dust
control. The diesel trucks do create some smoke when they are first started,
but this soon declines when they warm up. With the open space around us, it
would seem that any smoke would not create any hazard or nuisance. When
the trucks are started they do produce some noise but the busy county road in
front of our yard seems to create and deafen any noise we create. Our yard
lights produce light and they are on a light sensor. The lights were designed
to shine down and in on our property. Vibrations or other types or noise
should be held to a minimum because all mechanical work is done inside our
shop. We are unaware of any nuisances or complaints that have been issued
about our facility.
(C) Impacts on wildlife and domestic animals through the creation of hazardous
attractions, alteration of existing native vegetation, blockade of migration
routes, use patterns or other disruptions;
We own 35 acres at our facility. We are using about 20 acres and do not
intend to use the 15 acres we have left undisturbed. We have installed a field
fence and pipe fence around our yard. Deer and elk can travel around our
yard and small animals can travel through the fences if they desire. When we
purchased our property the field fence was already installed on our south and
east property lines to keep the cattle on the land owner's property. The native
vegetation was sagebrush and cheat grass. We spray yearly to control the
cheat grass. We do not believe we have impeded any migratory routes, or
changed any animal's patterns.
(D) Affirmatively show the impacts of truck and automobile traffic to and from
such uses and their impacts to areas in the County;
Prior to our purchasing this property our drivers where driving their larger
work truck into and out of the area to work, which probably had a greater
effect on state, federal, and county roads. We believe that when we started
parking the larger work trucks at our yard and had our employees drive their
personal vehicles to work it greatly reduced the impact and safety on state and
county roads. In discussions with Jake Mall, one of the county road
managers, he was in favor of our location because it would reduce the amount
of traffic on county roads.
(E) That sufficient distances shall separate such use from abutting property which
might otherwise be damaged by operations of the proposed use(s);
As previously noted, our facility is somewhat isolated from any residential
neighbors. We have an Encana pipe yard and evaporation pond to the south
of us. There are no residential areas within 1 mile or more, depending on the
direction. About a half mile to the north we have some gas wells and
industrial buildings. It would seem that we are compatible with surrounding
operations and that there is no adverse effect on abutting properties.
(F) Mitigation measures proposed for all of the foregoing impacts identified and
for the standards identified in Section 5.03.08 of this Resolution
We believe that our site plan, layout of operations, and strong
management team have successfully mitigated any adverse impacts on
surrounding properties.
(2) Permits may be granted for those uses with provisions that provide adequate
mitigation for the following:
(A) A plan for site rehabilitation must be approved by the County Commissioners
before a permit for conditional or special use will be issued;
Site rehabilitation would consist of
• All frac tanks would be hauled away.
• All vacuum trucks would be driven away.
• All KCL storage tanks could be removed.
• Building and structures would stay and be sold for other industrial
use.
• We would comply with all prevailing COGCC and Garfield County
regulations governing final reclamation.
(B) The County Commissioners may require security before a permit for special
or conditional use is issued, if required. The applicant shall furnish evidence
of a bank commitment of credit, bond, certified check or other security
deemed acceptable by the County Commissioners in the amount calculated by
the County Commissioners to secure the execution of the site rehabilitation
plan in workmanlike manner and in accordance with the specifications and
construction schedule established or approved by the County Commissioners.
Such commitments, bonds or check shall be payable to and held by the County
Commissioners;
We will comply with any bonds, commitments or other security if
necessary.
(C) Impacts set forth in the impact statement and compliance with the standards
contained in Section 5.03.08 of this Resolution.
We will comply with Garfield County, State of Colorado, or any
Governmental standards necessary.
Section 5.03.08 Industrial Performance Standards
Industrial Performance Standards: All industrial operations in the County shall comply
with applicable County, State, and Federal regulations regulating water, air and noise
pollution and shall not be conducted in a manner constituting a public nuisance or
hazard. Operations shall be conducted in such a manner as to minimize heat, dust,
smoke, vibration, glare and odor and all other undesirable environmental effects beyond
the boundaries of the property in which such uses are located, in accord with the
following standards;
(1) Volume of sound generated shall comply with the standards set forth in the Colorado
Revised Statutes at the time any new application is made.
We will comply with any volume of sound generated statutes.
(2) Vibration generated: every use shall be so operated that the ground vibration
inherently and recurrently generated is not perceptible, without instruments, at any
point of any boundary line of the property on which the use is located;
We will comply with vibration generated statutes.
(3) Emissions of smoke and particulate matter: every use shall be operated so as to
comply with all Federal, State and County air quality laws, regulations and
standards;
We will comply with emissions of smoke statutes.
(4) Emission of heat, glare, radiation and fumes: every use shall be so operated that it
does not emit heat, glare, radiation or fumes which substantially interfere with the
existing use of adjoining property or which constitutes a public nuisance or hazard.
Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or
other such operations which may be required by law as safety or air pollution control
measures shall be exempted from this provision;
We will comply with air pollution control statutes.
(5) Storage area, salvage yard, sanitary landfill and mineral waste disposal area:
(A) Storage of flammable or explosive solids or gases shall be in accordance with
accepted standards and laws and shall comply with the national, state and
local fire codes and written recommendations /comments from the appropriate
local protection district regarding compliance with the appropriate codes;
Any flammable solids or gases will be stored in accordance with accepted
laws and standards.
(B) At the discretion of the County Commissioners, all outdoor storage facilities
may be required to be enclosed by fence, landscaping or wall adequate to
conceal such facilities from adjacent property;
We will comply with County Commissioners per this regulation.
(C) No materials or wastes shall be deposited upon a property in such form or
manner that they may be transferred off the property by any reasonably
foreseeable natural causes or forces;
No materials or waste will be stored or deposited on our property.
(D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above
and the following standards:
1. The minimum lot size is five (5) acres and is not a platted subdivision.
Our lot size is 35 acres.
2. The equipment storage area is not placed any closer than 300 ft from any
existing residential dwelling.
The closest residence is about 1 mile away.
3. All equipment storage will be enclosed in an area with screening at least
eight (8) feet in height and obscured from view at the same elevation or
lower. Screening may include berming, landscaping, sight obscuring
fencing or a combination of any of these methods.
We will comply with any screening necessary.
4. Any repair and maintenance activity requiring the use of equipment that
will generate noise, odors or glare beyond the property boundaries will be
conducted within a building or outdoors during the hours of 8 a.m. to 6
p.m., Mon.-Fri.
All repairs will be conducted inside our buildings and the normal hours
of operation will be during daylight hours.
5. Loading and unloading of vehicles shall be conducted on private property
and may not be conducted on any public right -of -way.
All loading or unloading will take place on our property.
(E) Any storage area for uses not associated with natural resources shall not
exceed ten (10) acres in size.
Our storage area is associated with natural resources.
(F) Any lighting of storage area shall be pointed downward and inward to the
property center and shaded to prevent direct reflection on adjacent property.
Our lighting will be downward and inward to protect from glare onto
adjacent property.
(6) Water pollution: in a case in which potential hazards exist, it shall be necessary to
install safeguards designed to comply with the Regulations of the Environmental
Protection Agency before operation of the facilities may begin.
We will comply with any EPA regulation concerning water pollution.
