Dear Jimmy,
This office is in receipt of the Orchard Unit Area Plan submittal. In review of the project
with the County Attorney's Office, it appears that while you have asked the County to
review the project, it is such a project that does not fall within the County's regulatory
jurisdiction based on the diameter and lengths of the pipelines proposed in the plan. As
such, the County will not formally review the proposal. However, as a courtesy, I have
attached - comments received from referral agencies which responded to the referral.
These are not to be considered requirements but suggestions for your project. Please stop
by a pick up the remaining copies of the application from this office at your earliest
convenience.

RE: Review of Special Use Permit for Orchard Unit
Dear Fred:
This office has performed a review of the documents provided for the Special Use Permit
(SUP) of the Orchard Unit. The following comments, questions, or concerns were generated:
1. In review of the permit applications to the Army Corps of Engineers, there are no
wetlands that will be disturbed by any of the pipelines as they cross the creeks and
drainages. No supporting documentation was included. How was it determined that no
wetlands were present?
2. Right of entry agreement with the Union Pacific Rail Road appears to have expired as of
7/27/05.
3. It could not be found in the application whether or not there are anticipated impacts to
adjacent properties from items mentioned in Section 5.03.07(B) of the Zoning Ordinance.
4. The Vegetation and Noxious Weed Management Plan seem to be directed toward the
compressor location and does not specifically mention pipeline construction. Does this
plan need to be modified to include areas disturbed by pipeline construction?

Re: Comments on the Encana Orchard Mesa Area Plan

In the last two years revegetation efforts in Garfield County has resulted in a proliferation of yellow sweet
clover more than any other plant species. While yellow sweet clover isn't a noxious weed, it is a
troublesome plant; it moves into disturbed areas and finds its way onto roadsides causing maintenance and
site distance issues.
I have concerns that the seed mixes mentioned in the SUP applications and what is actually used are
sometimes different mixes. I am requesting that the applicant provide actual seed tag labels listing the
species used and the percentage of Pure Live Seed. They should save every tag and make them available
to the Vegetation Management office so we can verify that they planted the amount they committed to.
I am recommending a revegetation security in the amount of $2000 per acre. This would be for the surface
area disturbed on private lands. The applicant will need to quantify the surface area disturbed on private
land only.
It is recommended that the applicant mulch the disturbed area after reseeding. If using straw or hay, it must
be certified weed -free.

The above listed referrals were presented to the Town of Parachute Board of Trustees at their
regularly scheduled meeting February 9, 2006. 1 must continue to express the Board's and my
concerns related to the ongoing development within the areas near the Town of Parachute that
utilize Highway 6/24 and the 1 -70 Interchange in Parachute. Any and all growth in the Parachute
/ Battlement Mesa area have a direct impact on this interchange. The Town of Parachute sees this
as an impact that should be shared.
The additional growth related to the natural gas industry is the generator for added commercial and
residential development in the Town of Parachute, Battlement Mesa and the adjoining county areas.
To continue to accommodate this growth the local, county and state roads must be considered.
The addition industry operations continue to create a problem with mud on the streets within Town.
Today it's mud tomorrow it's dust. The Town staff and board members have been inundated with
calls and complaints regarding dirt! Whether it is on the road ways as mud or in the air as dust, it
is an issue that must be addressed.
The Town is aware of the county's grading and drainage report requirements for development and
would encourage the strict enforcement of these requirements, as well as the followup on -site to
assure that the watersheds are protected and erosion and sediments are addressed.
