ACKNOWLEDGMENT OF SATISFACTION
SUBDIVISION IMPROVEMENTS AGREEMENT
KNOW ALL MEN BY THESE PRESENT that:
WHEREAS, T.O. Ranch Holdings, LLC (hereinafter "owner "), entered into a Subdivision
Improvements Agreement with the Board of County Commissioners of Garfield County, Colorado
(hereinafter "Board"), recorded in Book 1354 at Page 884 as Reception No. 603360 of the Garfield
County records on May 5, 2002, and amended by a document recorded in Book 1354 at Page 894 as
Reception No. 603361 of the Garfield County records on May 14, 2002 for the improvements of the
T.O. Ranch subdivision; and
WHEREAS, the obligations of the Owner have been satisfied, as verified in attached
statement from Ron Liston, Land Design Partnership, dated October 1, 2003, that work has been
completed consistent with improvements described in the Subdivision Improvements Agreement.
NOW THEREFORE, at the request of the Owner and in consideration of the premises and
prior agreements, the Board hereby acknowledges the satisfaction of the Subdivision Improvements
Agreement entered into by Owner and the Board for the release of security in the amount of
$3,000.00 for work completed consistent with improvements described in the Subdivision
Improvements Agreement.

Re: T.O. Ranch Subdivision
Request release of Revegetation Surety
Dear Mark:
On September 30, 2003, I inspected the areas disturbed by site improvement construction at the
T.O. Ranch Subdivision and found these areas to be well established with grasses consistent with
the revegetation (landscape improvements) referenced in the T.O. Ranch Subdivision
Improvements Agreement. Please consider this letter as certification that said revegetation is
complete, the seeded grasses are established and no further revegetation efforts are required.
My qualifications as a "landscape professional" include a degree in landscape architecture and
thirty years of landscape architectural experience in Garfield County.
On behalf of T.O. Ranch Holdings, LLC, I request that Garfield County release the remaining
surety requirements of the Subdivision Improvements Agreement. T.O. Ranch Holdings, LLC
provided the required surety in the form of a cash payment and I therefore request that Garfield
County issue a chock payable to T.O. Ranch Holdings, LLC m the full amount of the original
surety payment.

imposed by contract or other means, including commonly accepted industry practices.
