RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF GARFIELD COUNTY, COLORADO

RE: Vacation of parts of streets and alleys in
the Townsite of Cooperton

RECITALS:
a) The Townsite of Cooperton, Garfield County, Colorado,
was originally platted by instrument hereinafter the
"Original Plat ") recorded in Town Plat Book 1 at Page 15,
Reception Number 7674;
b) The present property owners of Cooperton petitioned
the County Commissioners of Garfield County to approve
an Amended Plat (hereinafter the "Amended Plat ") of said
Townsite as an exemption from and not subject to regula-
tion under Garfield County Subdivision Regulations and
said exemption was granted by Resolution of the Commis-
sioners dated August 22, 1977. The Amended Plat was re-
corded August 23, 1977 as Document Number 280253;
c) In said Petition the petitioners further requested the
vacation of all streets and alleys, or portions thereof,
. which are shown on said Original Plat but are not inclu-
ded within the streets and alleys of said Amended Plat;
d) The matter came before the County Commissioners at a
public hearing held on August 22nd, 1977.
NOW THEREFORE, after having heard evidence at said public
hearing, the Board of County Commissioners of Garfield County does
hereby FIND that the streets and alleys as shown on the Original
Plat are not needed for any public purpose except insofar as they
are included within the streets and alleys shown on.the Amended
Plat; that said roadways are entirely within Garfield County and
not within the limits of any city or town, that said roadways do
not constitute the boundary line between two counties or the
boundary of any city or town, and that the requested vacation will

not leave any land in separate ownership without an established
public road connecting said land with another established public
road. Accordingly, it is hereby. RESOLVED pursuant to C.R.S. 1973,
43-2-303, that all portions of streets and alleys as shown on the
Original Plat and not included within streets and alleys on the
Amended Plat are hereby vacated; but there is reserved from said
vacation rights -of -way or easements for the continued use of existing
sewer, gas, water, or similar pipelines and appurtenances, for ditches
or canals and appurtenances, and for electric, telephone, and similar
lines and appurtenances.
