Dear Michael and Jacque;
Thank you for submitting the additional documentation to make your Minor Subdivision
application technically complete. This designation is applied to applications that meet
the submittal requirements of the Land Use and Development Code (LUDC) and starts
the `official review process' of your application.
A Director Decision date has been set for November 22, 2013, at which time a
decision will be issued on whether to approve, approve with conditions or deny
the application.
it is your responsibility as the Applicant to complete the required 30 -day public notice
requirement. Please mail the attached Notice Form, certified mail with return receipt
requested, to the adjacent properties within 200' of the subject lot (as included on the
submitted list of owners within 200'). You must provide both proof of mailing and proof
of receipt prior to the Director Decision on the application. The notice is required to be
sent at least 30 days prior to the date of Director Determination (mailed not later than
October 22, 2013). If this deadline is missed then a new decision date and re- notice will
be required.
Referral requests will be sent out to various local and state departments therefore five
(5) additional copies of the CD will be required — this CD needs to include the scanned
draft plat. If this is an issue for you please let me know as the County has scanning
equipment for the larger documents that we could burn onto your existing CD.
Just to reiterate the process as we move forward:
1. The Director Decision is set for November 22, 2013;

2. You must send the Public notice by the end of the day on Tuesday, October 22,
2013 . in order to meet the 30 day time requirement for notice;
3. On November 22, 2013 the Director will issue the decision and notify both the
applicant and the Board of County Commissioners (BOCC) of the decision. The
BOCC has the ability to "call -up" the application for a public hearing. We are
required to give the BOCC 10 days to review and determine if the
application should be called -up for hearing (December 2, 2013).
4. During the call up period you may obtain the mylar of the plat (with all corrections
made based upon comments from the County Surveyor and planning staff) from
your surveyor and obtain the following the signatures:
a. Owner(s) — signatures must be notarized;
b. Mortgage company, if applicable;
c. Your surveyor;
d. Treasurer;
e. Title Company (or attorney).
5. Once the call -up period ends (without a request for call -up) the mylar can be
scheduled for BOCC signature.
The planner will obtain the remainder of the signatures including the County Surveyor,
Board of County Commissioners and Clerk and Recorder.
Once the 10 day call -up period has passed and no call -up is requested, the Applicant
has 120 days to satisfy conditions of approval and submit the signed mylar. Once the
plat is signed by the Board of County Commissioners it will be recorded, recordation
fees will apply.

TAKE NOTICE that Michael and Jacqueline Carter have applied to the Garfield County Director
of Community Development to request a Minor Subdivision on property situated in the County
of Garfield, State of Colorado; to -wit:
Legal Description: See Attached
Practical Description: 1501 and 1503 CR 245 (Buford Road)
Description of Request: To divide the parcel (outlined in blue below) into two lots — each of
the proposed lots will be 2 -acres and each will have one existing
single family home on it.
All persons affected by the proposed amendment are invited to comment regarding the
application. You may state your views by letter, or you may call the Community
Development Department at (970) 945 -8212 regarding the application. The Director will
give consideration to the comments of surrounding property owners, and others affected, in
deciding whether to grant or deny the request. The application may be reviewed at the office of
the Planning Department located at 108 8th Street, Suite 401, Garfield County Administration
Building, Glenwood Springs, Colorado between the hours of 8:30 a.m. and 5:00 p.m., Monday
through Friday.
The Director will issue a decision on this application on Friday, November 22, 2013
therefore any comments to be considered must be received prior to that date.

LEGAL DESCRIPTION
A parcel of land in the NE1/4 of Section 25, Township 5 South, Range 91 West of the 6th
Principal Meridian in
Garfield County. Colorado and being more particularly described as follows::
Beginning at the center 1/4 corner of said Section 25: thence North 00 °07'59" East a distance of
435.67 feet to a point on the Southwesterly right -of -way line of County Road No. 245; thence
Southeasterly following a curve to the left along said right - of-way line whose radius is 639.81
feet and whose central angle is 38 °09'07" for an arc length distance of 426.03 feet and whose
chord bears South 62 °09'05" East 418.21 feet; thence continuing along said right -of -way line
following a curve to the right having a central angle of 22 °27'01" and a radius of 650.52 feet for
an arc length distance of 254.89 feet and whose chord bears South 70 °00'08" East 253.27 feet;
thence continuing along said right -of -way line South 58 °46'37" East a distance of 254.94 feet;
thence continuing along said right -of -way line, along a curve to the left having a central angle of
01 °09'34" and a radius of 1316.73 feet for an are length distance of 26.65 feet and whose chord
bears South 59 °2124" East 26.65 feet to a point on the Southerly line of the NE1 /4 of said
