This designation is applied to applications that meet the submittal requirements of the Land Use and Development Code (LUDC) and starts the `official review process' of your application. A Director Decision date has been set for November 22, 2013, at which time a decision will be issued on whether to approve, approve with conditions or deny the application. it is your responsibility as the Applicant to complete the required 30 -day public notice requirement. Please mail the attached Notice Form, certified mail with return receipt requested, to the adjacent properties within 200' of the subject lot (as included on the submitted list of owners within 200'). You must provide both proof of mailing and proof of receipt prior to the Director Decision on the application. The notice is required to be sent at least 30 days prior to the date of Director Determination (mailed not later than October 22, 2013). If this deadline is missed then a new decision date and re- notice will be required. Referral requests will be sent out to various local and state departments therefore five (5) additional copies of the CD will be required — this CD needs to include the scanned draft plat. If this is an issue for you please let me know as the County has scanning equipment for the larger documents that we could burn onto your existing CD. Just to reiterate the process as we move forward: 1. The Director Decision is set for November 22, 2013; 1 2. You must send the Public notice by the end of the day on Tuesday, October 22, 2013 . in order to meet the 30 day time requirement for notice; 3. On November 22, 2013 the Director will issue the decision and notify both the applicant and the Board of County Commissioners (BOCC) of the decision. The BOCC has the ability to "call -up" the application for a public hearing. We are required to give the BOCC 10 days to review and determine if the application should be called -up for hearing (December 2, 2013). 4. During the call up period you may obtain the mylar of the plat (with all corrections made based upon comments from the County Surveyor and planning staff) from your surveyor and obtain the following the signatures: a. Owner(s) — signatures must be notarized; b. Mortgage company, if applicable; c. Your surveyor; d. Treasurer; e. Title Company (or attorney). 5. Once the call -up period ends (without a request for call -up) the mylar can be scheduled for BOCC signature. The planner will obtain the remainder of the signatures including the County Surveyor, Board of County Commissioners and Clerk and Recorder. Once the 10 day call -up period has passed and no call -up is requested, the Applicant has 120 days to satisfy conditions of approval and submit the signed mylar. Once the plat is signed by the Board of County Commissioners it will be recorded, recordation fees will apply. Please contact me if you have any questions.
