HomeMy WebLinkAbout1.04 Mineral Estate & Adjacent Land Owners MEMORANDUM MARCH 18, 2014 TO: GLENN HARTMANN, SENIOR PLANNER FROM: RAY TENNEY SUBJECT: BLUESTONE MANAGEMENT COMMITTEE LOCATION AND EXTENT REVIEW – WATER TERMINAL FACILITY (FILE NO. LAEA-7795) – IDENTIFICATION OF MINERAL INTEREST OWNERS Referencing the January 22, 2014 completeness review letter this memo services as the response to identified issue 4: Ownership and address information for owners of mineral interests on the property proposed for the facility. As noted in the completeness review comments the facility is proposed for a small portion of a now aggregated 1068 acre parcel (parcel no. 2443-124-00-006). The portion affected by the proposed project is in the N ½ of the NE ¼ of Section 18 and the SE ¼ of the SE ¼ of Section 7, T8S, R97W of the 6th PM. In researching requirements for notice to holders of mineral rights we find in CRS 24-65.5-103 a requirement that the notice provisions apply to development proposals AND specifically exclude water pipeline projects and related appurtenances from the notice requirement (see definition of “Application for Development” 24-65.5-102(2)(a)). None the less we engaged in the following efforts to identify mineral interest holders on the subject property: 1- Commissioned a title commit for the subject parcel. 2- Performed an on line search of the Garfield County Assessor’s electronic record data base for mineral interest holders – no results available. 3- Physically visited the Garfield County Clerk and Recorders office to obtain records of mineral interests required to be kept by each Colorado county under CRS 24-65.5-103 – advised by staff no such records kept in Garfield County. 4- Physically visited the Garfield County Assessor office and was assisted by staff in viewing records of mineral interest holders dating from 2010. These records are not readily available to the public on line or at the kiosk at the Assessor’s office and must be retrieved by Assessor’s office staff . From this information we have complied below the list of mineral interest holders for the affected property carried on the Garfield County Assessor tax roles as of 2010. We were advised Page 2 of 2 at the Assessor’s office mineral interests have not been taxed since 2010 and these are the latest records available. Robert L.
