Water lmpoundment -Terminal Pond and Fill Station (File No. LAEA-7795)
Dear Lisa and Ray:
Thank you for the additional information you provided on the legal desc.ription and
location for your Water lmpoundment -Terminal Pond and Truck Filling Station
Application. Your Application is being reviewed in accordance with the Garfield County
Land Use and Development Code, Section 4-111 Location and Extent Review. We
have reviewed your Application Materials and our completeness review included input
from the County Attorney's Office. Several items that need to be addressed prior to a
determination of completeness are outlined as follows:
In accordance with the Garfield County Land Use and Development Code, please
respond to the following items:
1. Please provide a deed documenting ownership by Chevron USA Inc.
2. A recorded Statement of Authority for Kevin McCarty needs to be provided.
3. The Application needs to be amended to reflect that the Application is submitted
by both or either of the Colorado River Water Conservation District and the Bluestone
Water Conservancy District. Application by the Bluestone Committee was not deemed
acceptable by the County Attorney's Office unless more documentation is provided
establishing the Committee's authority to act on behalf of the two Districts. Please
ensure that an authorized representative signs the Application form. If you have
questions regarding this determination please feel free to contact us.
4. The Appl,ication needs to include ownership and address information on any
owners of mineral rights on the subject property proposed for the facility.
5. While the vicinity map shows the entire 1,068 acre Chevron Property it needs to
identify the location of the facility within the overall property.
6. The site plan needs to be supplemented as follows:
• A larger size scalable copy needs to be provided with the Application submittals.
This will improve the legibility of the site plan.
• The legal description included appears to be for the entire 1,068 acre property. A
description for the area of the actual proposed facility (approximately 2.5 acres in
size) needs to be provided.
7. While not completeness items the following topics will likely be considerations in
our review process and the Applicant may wish to more fully address them at this time.
• The site plan shows improvements and/or structures associated with the truck
filling portion of the facility some of which appear to be located immediately
adjacent to the County Road Right-of-Way. Compliance with applicable setback
provisions of the Land Use and Development Code may be a consideration in
our review and should ideally be demonstrated by the site plan.
• The Application indicates that the facility will reduce truck traffic on adjacent
County Roads. In order to demonstrate consistency with the Comprehensive
Plan Section 3, Transportation, the Application should provide additional traffic
documentation to support this representation including traffic implications and
estimates in immediate vicinity of the facility.
• Noxious weed topics are noted in the Application. Plans for weed control and
mitigation should be provided as part of the demonstration of compliance with
Article 6, Agriculture of the Comprehensive Plan.
Once the above completeness topics (#1 -#6) are addressed we can finalize our
completeness review and begin scheduling your review and public hearings. Please
include in any updates to your submittals previously provided information on the legal
description, site location (latitude/longitude), and overall project mapping.
Also, once determined to be complete, you will need to provide additional copies of the
submittal materials to send to referral agencies. Please note that the Garfield County
Land Use and Development Code requires that the technical completeness issues be
resolved within 60-days of the date of this letter, otherwise the application will be
deemed withdrawn unless a request for extension is submitted and approved.
