DESCRIPTION OF THE PROPOSAL PC 2/9/05 MLB CRS 30-28-110(1)(d) review of road acquisition by the Town of Parachute Town of Parachute A. Re uest. The Town of Parachute is planning on expanding their water treatment facility that is located adjacent to town, on the west side of the bridge across the Colorado River. The 40' long and 34' wide expansion will be attached to the west end of the existing treatment plant. Enclosed in the new building will be a below - grade chlorine contact chamber, along with some exterior piping, electrical and mechanical improvements. The reason for the improvements is to increase the plant's treatment capacity and to meet new Drinking Water Quality standards that went into effect at the beginning of the year. II. MAJOR ISSUES AND CONCERNS A. Zoning: CRS 30-28-110(1)(d) states the following: O T s Regional planning commission approval required when recording (1) (a) Whenever any county planning commission or, if there is none, any regional planning commission has adopted a master plan of the county or any part thereof, no road, park, or other public way, ground, or space, no public building or structure, or no public utility, whether publicly or privately owned, shall be constructed or authorized in the unincorporated territory of the county until and unless the proposed location and extent thereof has been submitted to and approved by such county or regional planning commission. (b) In case of disapproval, the commission shall communicate its reasons to the board of county commissioners of the county in which the public way, ground, space, building, M. structure, or utility is proposed to be located. Such board has the power to overrule such disapproval by a vote of not less than a majority of its entire membership. Upon such overruling, said board or other official in charge of the proposed construction or authorization may proceed therewith. (c) If the public way, ground, space, building, structure, or utility is one the authorization or financing of which does not, under the law governing the same, fall within the province of the board of county commissioners or other county officials or board, the submission to the commission shall be by the body or official having such jurisdiction, and the commission's disapproval maybe overruled by said bodyby a vote of not less than a majority of its entire membership or by said official. In the case of a utility owned by an entity other than a political subdivision, the submission to the commission shall be by the utility and shall not be by the public utilities commission; however, the commission's disapproval may be overruled by the public utilities. commission by a vote of not less than a majority of its entire membership. B. Other issues: The property on which the Town's water treatment facility is located is in the County. Given that the property is adjacent to the Town and annexable, staff would suggest that the Town should initiate annexation, to avoid the need for this type of review for future modifications. It should be noted that the existing and proposed treatment expansion are located in an area that may be subject to flooding by the Colorado River. The County has no floodplain mapping for the area, since FEMA has not approved floodplain management maps for the majority of the main stem of the Colorado River in Garfield County. Technically, there are no local regulations that would affect this proposed construction. RGCE's submittal includes: • Cover letter • Two (2) sets of drawings with the Cover sheet, General Notes, Site Plan, Grading and Erosion Control Plan, Architectural Plan, and Building Elevations In summary, the WTP expansion includes a 34' x 40' pre -fabricated metal building addition, a below -grade chlorine contact chamber (beneath the building addition), some exterior piping, electrical and mechanical improvements. The building expansion will contain two new filter units, interior piping, and other treatment improvements.
