I . DESCRIPTION OF THE PROPOSAL
The Location and Extent process is required as a companion application with a request to vacate a
County Road . The Applicants have reconstructed County Road 103 and the intersection at State
Highway 82 as conditioned in Resolution 2011-77 which approved the ongoing use of a concrete batch
plant for LaFarge (now Oldcastle SW Group) at the existing Powers Pit. The Applicants have also entered
into a 'Road Construction Agreement for Construction of Improvement to County Road 103 ' with the
Board of County Commissioners regarding the required engineering and construction of the proposed
improvements. The construction is complete and Ex hibit J identifies co rre spo nden ce from CDOT
regarding the accepta nee of the certification of the construction.
The Location and Extent process is required to review certain public and quasi-public projects to
determine if the project is in general conformance with the Comprehensive Plan.

The site is located 1.78-miles east
of the Town of Carbondale and
north of SH 82.
The Powers Gravel Pit is located on
the east side of CR 103 and the
Blue Gravel Pit is located on the
western side of CR 103.

SECTION 4-111 LOCATION AND EXTENT

Location and Extent Review of certain public and quasi-public projects is mandated by State law
including, but not limited to, C.R.S. §§ 30-28-110, 22-32-124{1)(a) and 22-32-124{1.5)(a). In the
event of any conflict between these procedures and applicable State law, State law sha ll govern.
1. The entity charged with authorizing and financing a public project, or the board
of education for the applicable school district, shall submit an application for
Location and Extent Review. Except if it is a utility owned by an entity other
than a political subdivision, then the application must be made by the utility, not
the Public Utilities Commission.
a. The following Projects sha ll be subject to Location and Extent Review:
a. Roads, parks, or other public way, ground, or space;
b. Public Building s or structures;
c. Public utilities, whether publicly or privately owned, unless the Public
Utility project is a designated activity of State interest subject to
permitting pursuant to C.R.S . § 24.65.1 -501; and
d. The acceptance, widening, removal, extension, relocation, narrowing,
vacation, abandonment, change of use, sa le, lease, or acqu isition of l and
for any road, park, or other public way, ground, place, property, or
structure; and
e. Public and charter schools;

right-of-way pursuant to section 4-108 may be comb in ed with any request being
processed through this section.
B. Review Process.
Applications for a Location and Extent Review sha ll be processed according to Table 4-102,
Common Review Procedures and Required Notice, with the following modifications:
1. The Planning Commission sha ll eith er approve or disapprove the application for
a Lo cation and Extent Review based on general conformance with the
Comprehensive Plan.

2. In the event the Planning Commission finds the application is not in general
conformance with the Comprehensive Plan and disapproves the application, the
following apply:
a. For public and charter school projects, the Planning Commission may
request a Public Hearing before the board of education, pursuant to
C.R .S. § 22-32-124(1)(a) or (1.S)(a).
b. For all other projects, the Applicant may appeal the disapproval to the
applicable governing body in accordance with C.R.S. § 30-28-llO(l)(b)
or (c).
C. Review Criteria.
The Planning Commission shall determine whether the project is in general conformance with
the Comprehensive Plan .
V . STAFF DISCUSSION
The Applicant has provided an analysis that demonstrates the Location and Extent of the public
improvements are in generally conformance with the Garfield County Comprehensive Plan.
VI. FINDINGS
1. That proper public notice was provided as required for the hearing before the Planning Commission.
2. That the hearing before the Planning Commission was extensive and complete, that all pertinent
fa cts, matters and issues were submitted or could be submitted and that all interested parties were
heard at that meeting.
3. That for the above stated and other reasons the Location and Extent for the Vacation and Relocation
of CR 103 is in the best interest of the health, safety, convenience, order, prosperity and welfare of
the citizens of Garfield County.
4. That the application is generally consistent with the Garfield County Comprehensive Plan 2030, as
amended.
VIII. PLANNING COMMISSION DELIBERATION AND DECISION
The Planning Commission is the decision-maker on this request and has the option to approve or
disapprove the request for Location & Extent.

organized. The following comment was generated:
• The application materials do not provide anything to show that the improvements to the
intersection of Hwy 82 and CR 103 have been completed to the satisfaction of Garfield County
and CDOT. The Applicant should provide evidence as to the completeness and acceptance of
the intersection construction.

This letter Is written to formally notify COOT of the completion of the CR 103/SH 82 Intersection which was
constructed under the COOT Access Permit number 312039.
We conducted a preliminary walk thru on September 12, 2013 and created a small punch list based on that
walk thru. You had a final walk thru on October 22, 2013 and agree with Soprls Engineering that all required
Improvements, Including the final punch list Items are complete and In place. Therefore, to the best of my
knowledge, the construction was completed In accordance with the Intent of the COOT approved plans and
specifications dated March 15, 2013.
Per the conditions of our access permlt(s), enclosed with this letter Is a "Compliance of Construction and
Materials" from CTL Thompson, Inc. dated October 24, 2013 for your records.
Thank you for taking the time to conduct site visits and working closely with our team on this project. The
project was a great success thanks to all of the effort put Into It by all players, Including you and others at
COOT.
I appreciate your help, and I will look forward to receiving the CDOT's letter of approval to start the two
year warranty period.

CTL I Thompson, Inc. has provided construction observation and materials
testing for work performed for the new intersection of State Highway 82 and Garfield
County Road 103. The work consisted of aggregate base course (ABC) placement
and hot Bituminous asphalt pavement.
Our construction observations for ABC began on July 8, 2013 (Daily Report
No. 30) and concluded on August 7, 2013 (Daily Report No. 43). Asphalt testing
began on July 25, 2013 (Report No. 1) and concluded on August 7, 2013 (Report
No. 7).
In our opinion, the items observed and tested are in general conformance
with the project and Colorado Department of Transportation specifications. We
appreciate the opportunity to work with you on this project. If you have questions or
we can be of further service, please call.
