A RESOLUTIO N CONCERNED WITH THE AP PROVAL OF A SPE ~IAL US E PERMI T APPLICATION BY
ROBERT , EDl~ARD AND \.JANDA TEMPL ETON AND A & K LEASING.
WHEREAS , The Board of County Commis sioners of Garfield Co unty has received an
appli cation fro m Robert, Edward, a nd Wanda Temp l eton and A & K Leasing for a special
use perm it for a commercial park with three uses; specifically, 2 units of employee
housing, storage and ma i ntena nce facility for a refuse trucking operation and a
business office for s am e on the following described tract of land:
A port i on of land situa t ed i:n the SW12 NE ~ Sect ion 11, T6S, R93l~ of
the 6th Principal Meridian in Garfiel d Co unty , Co l orado , contain ing
8. 18 acres , mo re or less.
WHER EAS, p ursuant to required pub lic notice, the Board cond uc te d a public hearing
on the 22nd day of March, 1982, up on the quest i on of whether the above described
spec i al use permit should be granted or denied, at wh i ch hearing the pub li c and interested
persons were g i ven the opportun ity to express thei r opin i on s regard i ng the issuance
of said specia l us e per mi t; and
WHER EAS , the Bo ard on the basis o f the e videnc e produced at the aforementioned
hear i ng, has ma de the f ollowing de t erminati ons of fact:
1. The proposed us e is con1pa ti ble wi th the uses existing and pe r mitted in the
district in which it is to be located, provided that certa i n hereina f t e r contained
cond iti ons be complied with .
2 . That neither the i mpact on traffic vo l ume and safety or on utilities, or
any ot her impa ct of the specia l use will be injuri ous to the estab li shed neighborhood
or zone district in which the special use i s to be located .
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado ,
that a special use per~it be and hereby i s authorized permitting the use of th e above
described tract of l and fo r a commerci al oark wi th three uses; spec i fical l y , 2 units
of em ployee housing, storage and ma intenance fac ili ty for a refuse trucking operation
and a bus iness office for same, upon the followirig specific conditions:
1. That the use of the tract of l and comply with all present and future regulations
of Garfie ld relating to a commercial park i n the zone d i strict in wh ich the property
is now or may later be located ;
2 . That, pr i or to the i ssuance of the authorized special use permit , the above
describ ed tract of land sh a l l be severed from any other tract of land upon wh i ch
there may exist a pri nc i pal use, unless such ot her such pr incipal use has been
terminated at the time of the issuance of the special use permit;
3. All proposals of the app li cant shall be considered conditions of approval
unless stated otherwise;
4 . The s pe c ial use may be subject to review by the County Comm i ssioners once
every six mo nths;
5. The applicant sha l l submit recommendat ions from the Rifle Fire Protection
Dist rict to the Planning Department prior to the Public He aring and sha l l abide by
these recommendat io ns as a condition of approval of the special use permit;
6 . The ex i sting driveway will be abandoned~and access to the dwellin g units
will be provided of f t he common access dri ve ;···
7. The appl icant shall prov i de approp riate dust abatement measu r es for the
grave lled access;
8. All outside storage areas for truck parking shall be fenced and screened
with a six foot chain-link fence. If vehicles are parked .P<:(tside, no fencing is
required; tn
9. The new 24 foot access drive shall also provide for utility easements;
10. Easements shall be designated for the existing irrigation ditches;
11. Screening and landscaping shall be developed along the eastern boundary
of the property (paralleling the driveway), and immediately to the south of the
service center. This screening and landscaping plan shall be subject to review
by the Planning Department.
12. The applicant shall submit proof of notification of adjoining property
owners prior to issuance of the special use permit.
