Please submit this information in narrative form and be sp~ific . 2] If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well pennit and any other legal water supply infonnation, inducting a water allotment contract or an approved water augmentation plan. 3] A map drawn to scale portraying your property, all structures on the property, and the County or State roadways within one (1) mil e of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. 4] A vicinity map, showing slope of your property, for which a U.S .G.S. 1:24,000 scale quadrang le map will suffice. 5] A copy of the appropriate portion ofa Garfield County Assessor's Map showing all public and private landowners adjacent to your property. Include a list of all property owners and their addresses. 6] Attach a copy of the deed and a legal description of the prop erty. If you are acting as an agent for the property owner, you must attach an acknowledgment fro m the property owner that you may act in his/her behalf. 7] For a ll applications pertaining to airports, the oil and gas indu stry, power generation and/or transmission indu s try, or any other classified industrial operation, you must submit an impact statement consistent with the requiremen ts of Sections 5 .03 , paragraphs 1thru3; 5.03 .07, inclusive; and 5 .03 .08, inclusive. The consideration of this proposed Special Use will require at least one (I) public hearing, for which public notice must be provid e d . The Planning Department will mail you information concerning this hearing(s), approximately 30 days prior to the scheduled hearing. WlffiREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Snyder Oil Corporation for allowing the construction and operation of a produced water evaporation pit on the following described tract of land: Located on a portion of land in Section 26, T6S, R93W of the 6th P.M., off of CR 319. (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 6th day of November, 1995, upon the question of whether the above-described Special Use Permit should be granted or denjed, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREASJ the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the folJowing determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that aJI pertinent facts, matters and issues were .submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners. shall be considered conditions of approval. 2. That the operation of the facility be done in accordance with any federat state or local regulations governing the operation of this type of facility. 3. That the operation of this facility be in accordance with the provisions allowed within the Surtllce Lease Agreement signed by the applicant (Lessee) and the land owner (Lessor). 4. The applicant comply with the provisions of the National Fire Code as the Code pertains to the operation of this type of facility. 5. The construction of the facility, specifically the evaporation pit. be done in a manner to mitigate any problems which may occur due to the possible shrinking or swelling of the soils on-site. 6. The issuance of this Special Use Perm.it is subject to an annual ..-eview of the water chem.istry of the water contained within the evaporation pit, at such time when free-standing water is within the pit. This analysis will be presented to the Planning Department on the first day of July, 1996, and every July I thereafter, for the duration of the operation. The analysis of this water will be al the sole cost of the applicant/owner. Jf'this water is determined, through thls analysis, to be hazardous or toxic. based on applicable standards2 then the applicant/operator is required to submit an additional Special Use Permit application, with appropriate fees. to address and mitigate the potential hazard(s). 7. The County reserves the right to retain outside expertise~ at the expense of the applicant/operator of the facility. in an effort to conduct tests or analyses of the physicaJ nature~ water chemistry or groundwater properties on and away from the site. 8. A sufficient monetary security, determined by the Board of County Commissioners, to ensure rehabilitation of the site once operation has ceased, shall be provided to the County by the applicant. 9. That the proposed lease parcel is subdivided from the parent parcel either by the appropriate action of the Board of County Commissioners or the recording of a deed of at least 35 acres of land surrounding the leased area. in the name of the applicant. 10. This facility is for the sole use ofthe applicant. If any other entities are to be added as users then these "entities would be subject to an additional Special Use Permit ..-eview. I I . The applicant/operator will consult with appropriate authorities as to the planting and care of suitable landscaping plants. 12. Licensing of all out-of-state vehicles and equipment to be used on this project within the County of Garfield, State of Colorado. 13. An emergency plan will be filed with the County and the appropriate fire district. 14. Location of the aeration system pump and motor will be done in a manner to shield surrounding landowners from noise produced by these mechanical components. Carney 'BALLARD 1/12/99 Garfield County Building and Planning D epartment Attention: Mark Bean 109 8th Street, Suite 303 Glenwood Springs, CO 81601 RE: Re so lution No. 96-21 Gentlemen: PETROLEUM LLC Ballard Petroleum LLC (Ball a rd) has entered into an agreement with Snyder Oil Corporation (Snyder) whereby Ballard is acquiring a ll of Snyder's oil and gas interests in the Grass Mesa, Hunter Mesa and Divide Creek Unit's all or a portion of which lie within Garfield Co unty . As a part of the acquisition, Ballard is acquiring the Benzel Water Di sposal Facility located in the SWNE of Section 26, Township 6 South, Range 93 West. The construction and operation of this water di sposal facility was authorized under Resolution No. 96-21 adopted by the Board of Co unty Commissioners of Garfield County effective April 16, 1996. The Be nzel Water Disposal Facility has been in continuos operation fo r the p ast 2+ years with Snyder as operator of the facility. The transfer of operations and r espo nsibility from Snyder t o Ballard will be seamless. Ballard will continue the practices and pro ced ures establi s hed by Snyder for the continued operation of the Benzel Water Disposal Facility. It is Ballard's inte ntion to remain in compliance with all 14 items set out in the April 16, 1996 Reso luti o n.
