Kim Antonelli A tract of land located in a portion of Section 4, T.6S., R92W; more practically described as a tract of land located approximately one (1) mile northwest of Silt off of C.R. 229. 2.03ACRES Well Individual Sewage Disposal System C.R. 229 AIR/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The property is located in the Antlers Orchard subdivision which is an area shown to be an existing subdivision on the Garfield County Comprehensive Plan Management Districts map. IL DESCRIPTION OF THE PROPOSAL A. Site Description-The tract ofland is situated in an area northwest of Silt that is an open bench above the valley floor. The area is predominantly agricultural crop lands, with some low density residential development. The tract has a double-wide manufactured home with an attached addition. B. Project Description-The applicant has requested a Special Use Permit for an agriculture related business, specifically to process domestic and wild game meat in the attached building (See attached page-'/--). The processing operation would take place in a 28 ft. by 22 ft. building attached to the residence. The hours of operation are anticipated to be in the evening, due to other work obligations during the day. The average number of vehicles anticipated to come to the property is six, which was the number during previous hunting seasons. Sewage disposal would be provided by a 1250 gallon septic tank and 1000 gallon drywell. Water will come form a well which the applicant has a one third 1 interest. III. MAJOR ISSI JES AND CONCERNS A. Zoning· An Agriculture-Related Business is defined as: A business whose sole function is the provision of services or retail products, agricultural in nature. Meat processing would be considered a part of the agricultural process, subsequent to marketing the meat products. As such, the proposed meat processing can be construed to be an "agriculture-related business", allowed by Special Use in the NR/Rd zone district. B. Sewage· The proposed 1250 gallon septic tank and 1000 gallon drywell were installed in addition to an existing 1000 gallon septic tank with leach field forthe house. The 1250 gallon tank and drywell was installed without our inspections or a permit from the county. Any approval of the meat processing should be contingent upon an inspection by a licensed engineer with certification of the adequacy of the system being provided prior to issuance of a permit. C. Water: The applicant has a 1/3 interest in a domestic well, that is to be shared by two other lots. The Division of Water Resources said that the existing well is not properly permitted to include the use for the meat processing. An expansion of the use for the well permit by the acquiring of augmentation water will be necessary prior to approval of a Special Use permit. It appears that they may be able to purchase augmentation water from the West Divide Water Conservancy District. D. Traffic· The County road serving the property is very narrow, with one section having very poor site distance, due to topping out on a hill. Low volumes of traffic such as the proposed average of six vehicles per day during peak season, should not be a problem. Any increase in the size and scope of the operation could present a problem. E. Noise· Given that operations are proposed to occur primarily in the evenings or weekends, there is potential for complaints by neighbors of noise by the sawing operations. All noise must be contained on the property and within the building associated with the meat processing operation. F. Storage: All storage of equipment, materials and waste should be contained within the building. Of particular concern are waste by-products of the meat processing operation. G. Licenses-The Colorado Department of Agriculture will be required to approve the proposed facility. One of the requirements is that there will be a sewage disposal system approved by the County. The appropriate permits or licenses should be acquired prior to issuance of any permits. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and 2 complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, subject to the following conditions of approval: 1. That all proposals of the applicant shall be considered conditions of approval, unless specified otherwise by the Board. 2. That all approvals/permits from the Colorado Department of Agriculture and any other agencies requiring permits, shall be obtained prior to issuance of a permit. 3. The proposed I.S.D.S. system shall be inspected by a licensed engineer and a letter certifying the adequacy of the system shall be presented prior to issuance of a Special Use permit. 4. An approved well permit for the expansion of the use for commercial purposes shall be provided prior to issuance of a Special Use permit. 5. All material, equipment and waste shall be stored or contained within a building. 6. All use of this well will be curtailed unless the water allotment contract or a plan for augmentation is in effect. 5) The maximum pumping rate shall not exceed 15 GPM. 6) The average annual amount of ground waier to be appropriated shall not exceed 1.0 acre-foot (325,900 gallons). 7) A totalizing flow meter must be installed on this well and maintained in good working order .. Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 8) The well must be located not more than 200 feet from the location specified on this permit, and more than 600 feet from any existing well. 9) The owner shall mark the well in a conspicuous place with well permit number(s). name of the aquifer, and court case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. Water demand in the meat packing facility (the basement of the home) is estimated to be 150 gallons per day based on one employee and no bath. Furthermore, the District hereby expressly reserves the right to store water and to make exchange releases from structures that may be built or controlled by the District in the future, so long as the water service to the Applicant pursuant to tbia agreement ia not impaired by aaid action. Any quantity of the Applicant's allocation not delivered to or used by Applicant by the end of each water year (December 31), shall revert to the water supplies of the District. such reversion shall not entitle Applicant to any refund of payment made tor such water. Water service provided by the District shall be limited to the amount of water available in priority at the original ~oint ot diversion of the District's applicable water right, and neither the District, nor those entitled ~o utilize the District's decrees, may call on any greater amount at new or alternate points of diversion. INSPECTION Dear Mr. Bean: I have inspected the existing l.S.D.S. proposed for use by Mr. Antonelli in conjunction with his small commercial meat packing facility. I find that the system is adequate for the purposes intended and that it complies with the Colorado Department of Health Guidelines For Individual Sewage Disposal Systems and the Garfield County l.S.D.S. regulations (hereafter Guidelines) with one minor exception discussed below. The l.S.D.S. that will be used for the meat packing facility is the second system on the site. Another sewage disposal system consisting of a 1 ,000 gallon septic tank and an 11 foot square by 11 foot deep absorption pit serves the three bedroom primary residence. This system is adequately sized and constructed for the residential use and appears to be in conformance with the Guidelines. The l.S.D.S. for the meat packing facility will serve only the meat packing room and one bathroom located in an addition to the residence currently under construction. The l.S.D.S. for the meat packing facility and bathroom consists of a 1,250 gallon concrete septic tank and a 1 O' by 13' (average) diameter absorption pit. A percolation test was conducted in the pit over a 24 hour period and the perc rate was determined to be 1 inch per 20 minutes. Based design procedures outlined in the Guidelines the allowable hydraulic loading for the system is 456 gallons per day (gpd). The average hydraulic loading rate from the meat processing facility and the bathroom is conservatively estimated to be 300 gpd (150 gpd from the bath and 150 gpd from the meat processing facility) resulting in a design loading rate of 450 gpd. Therefore the system is adequately sized for the proposed uses. Uses in addition to those discussed herein should not be allowed on this l.S.D.S. without addition review. The l.S.D.S. for the meat packing facility and bathroom complies with all requirements for minimum horizontal separation from other facilities set forth in the Guidelines with the exception of a potable water supply line. A water line runs between the absorption pit and the residence and is approximately 1 5 feet from the edge of the absorption pit and slightly uphill from the pit. After review of the site, in my opinion this is not a hazardous situation. However if the water line is ever replaced it should be relocated a minimum of 25 feet from the edge of the absorption pit and preferably 50 feet from the edge of the pit. The vertical separation between the bottom of the absorption pit and the seasonal high water table is estimated to be 60 feet. This is based on review of static water levels in water supply wells located in the general vicinity.
