Re: Request for Amendment to an Approved Special Use Permit
Dear Mr. Dennison,
This office has reviewed your application to amend the approved Perry Rodreick Special Use
Permit, to increase the number of water storage tanks from 10 to 20.
When considering Amendment of a Special Use Permit the Director must first determine that
there is "No Substantial Change" using the criteria listed in Article 16: Definitions as listed in the
Unified Land Use Resolution of 2008 (ULUR). If the application does not meet the criteria listed
the Director has the authority to approve your application. After careful consideration of your
application and the detailed report prepared by Planning Staff, I hereby Approve your
requested amendment to the previously approved Special Use Permit for Perry Dan Rodreick.
I've attached specific conditions to my decision as noted in the attached Land Use Change
Permit.
Under the ULUR you have specific appeal rights as listed in Section 4-107 of the ULUR. Under
item 7 of the noted section, you have 10 calendar days to appeal the decision and/or conditions
imposed as part of the Director's decision. Please note that any appeal should be in writing
stating the reason for appeal and also include the required documents for public notice including
an assessor's map showing the site and identifying all properties within 200 feet of the
property's full ownership. Also, a list of property owners should be attached listing all of the
property owners, with their addresses, that are identified on the assessor's map. Section 4-103
of the ULUR discusses the Public Notice requirements.
