I. RELATIONSIDP TO THE COMPREHENSIVE PLAN
The site for the proposed accessory dwelling is located in District C, Rural Areas, Minor
Environmental Constraints, as designated by the 1984 Garfield County Comprehensive Plan,
Management Districts Map. This designation denotes minimal or no environmental
constraints and recommends that the minimum lot size for the area be five (5) acres.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site is located approximately three (3) miles west of Silt, on
the east side of CR 225. The proposed tract has CR 225 along the west side of the
lot and an existing house with various accessory structures. The properties located
in the area are generally large lots residential or agricultural operations. (See location
mappg. 6 )

B. Adjacent Land Uses: Land uses adjacent to and in the vicinity of the subject parcel
are single family residential and agricultural.
C. Development Proposal: The applicant proposes to develop the site with an Accessory
Dwelling Unit (ADU), in addition to the existing principal residence. The unit would
be 25' x 25' or 625 square feet of residential space and would utilize an existing well,
that is proposed to be shared. The ADU is proposed to conform to Section 5.03.0ll, v
of the Garfield County Zoning Resolution, which governs these units. {p:J~· ~6
III. MAJOR ISSUES AND CONCERNS
A. Zoning: The subject parcel is zoned NRIRD and was created as Lot #21 of the
Antlers Orchard Development Amended Subdivision. Section 5.03.021 of the
Zoning Resolution requires that the parcel meet certain criteria, to wit:
1 J The minimum lot size shall be four (4) acres containing a building site with slope
less than 40% at least two (2) acres in size.
The lot is over the four (4) acre minimum and is relatively flat.
2] The gross floor area for residential occupancy shall not exceed 1500 square feet.
According to the application, the proposed ADU, the floor area devoted to
residential occupancy will be approximately 625 square feet.
3} Approval from the subdivision homeowner's association and/or allowed by
covenant, if applicable.
There is no homeowners association for the Antlers Orchard Development
4} Proof of a legally adequate source of water for an additional dwelling unit.
The application contains a well permit application for a shared well for two (2) single
family dwellings and a proposed contract with the West Divide Water Conservancy
District. Based upon an enclosed letter the fmal contract has not been paid and
therefore the Division of Water Resources is not in a position to approve the
modified contract. If the modified permit cannot be issued, the proposed accessory
dwelling cannot be approved. See permit application, letter and contract, pgs. £

5} Compliance with the County individual sewage disposal system regulations or
proof of a legal ability to connect to an approved central sewage treatment facility.
The applicant proposes to expand the leach field of the existing ISD system.
6} Only leasehold interest in the dwelling unit is allowed.
The applicant is proposing to use the accessory dwelling as guest room/apartment
and there is no separation of the property proposed.

7] That all construction complies with the appropriate County building code
requirements.
If approved, the applicant would be required to apply for and receive the appropriate
building and ISDS permits.
Section 5.03 of the Zoning Resolution sets forth the requirements that all special uses
must meet, to wit:
1] Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Environmental Health Officer shall
either be in place or shall be constructed in corifunction with the proposed use;
According to the records of the Division of Water Resources, the well has been
drilled and found to produce 3 gpm, in a pump test. Technically, this is 4,320
gal/day for the property. Without some additional storage there may be demand
problems if both dwellings try to draw water at the same time. Staff presumes that
either an expanded conventional ISD system or an engineered system could be
utilized to treat wastewater. The actual type of system to be used is generally
determined after issuance of a building permit.
2] Street improvements adequate to accommodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either be in
place or shall be constructed in conjunction with the proposed use;
Access to the lot is via County Road 225, a fairly narrow County road, that presently
has a relatively low number of dwellings utilizing it. If this lot had been subject to
a subdivision action, it would be subject to a road impact fee of$2100. As a Special
Use permit, there is no authority to impose a road impact fee on the new dwelling.
3] Design of the proposed use is organized to minimize impact on and from adjacent
uses of land through installation of screen fences or landscape materials on the
periphery of the lot and by location of intensively utilized areas, access points,
lighting and signs in such a manner as to protect established neighborhood
character;
This provision is generally concerned with the aesthetics of development and the
application proposes to remodel an existing building. Given the established character
of the neighborhood, it is staff's opinion that the proposed land use would not alter
or degrade the neighborhood's aesthetic character.
IV. SUGGESTED FINDINGS
1. That proper publication and public notice was provided as required by law for the
hearing before the Board of County Commissioners.
2. That the hearing before the Board of County Commissionerws was extensive and
complete, that all pertinent facts, matters and issues were discussed within the
Special Use Permit application and the public hearing.

3. That the application is not in compliance with the Garfield County Zoning
Resolution of 1978, as amended.
4. For the above stated and other reasons, the proposed land use is not in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of
the citizens of Garfield County.
V. RECOMMENDATION
Based on the lack of an legal and adequate water supply, staff recommends denial of the
application. If the Board chooses to approve this application, then the following approval
conditions should be considered:
1. That all proposals of the applicant, made in the application and at the public hearing,
shall be considered conditions of approval, unless specified otherwise by the Board
of County Commissioners.
2. That the accessory dwelling unit shall adhere to all provisions of Section 5.03.021
of the Garfield County Zoning Resolution of 1978, as amended. Specifically, an
approved well permit for two (2) dwellings shall be received from the Colorado
Division of Water Resources and a well pump test shall be performed demonstrating
the following:
1) That a four ( 4) hour pump test be performed on the well to be used;
2) A well completion report demonstrating the depth of the well, the
characteristics of the aquifer and the static water level;
3) The results of the four (4) hour pump test indicating the pumping rate
in gallons per minute and information showing drawdown and
recharge;
4) A written opinion of the person conducting the well test that this well
should be adequate to supply water to the number of proposed lots;
5) An assumption of an average or no less than 3.5 people per dwelling
unit, using 100 gallons of water per person, per day;
6) The water quality be tested by an approved testing laboratory and
meet State guidelines concerning bacteria and nitrates.
3. That the accessory dwelling unit shall adhere to the following standards:
"One (I) dog will be allowed for each residential unit on this lot, and the dog shall
be required to be confined within the owner's property boundaries. Enforcement
provisions shall be developed for allowing the removal of a dog from the area, as a
final remedy in worst cases."
"No open hearth solid-fuel fireplaces will be allowed on this lot. One (1) new solid-
fuel burning stove as defined by C.R.S. 25-7-401, et. seq., and the regulations

promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will
be allowed an unrestricted number of natural gas burning stoves and appliances."
"All exterior lighting shall be the minimum amount necessary and all exterior
lighting shall be directed inward, towards the interior of the lot. Provisions may be
made to allow for safety lighting that goes beyond the property boundaries."
"The minimum defensible space distance for structures shall be 30 feet on level
terrain, plus appropriate modification to recognize the increased rate of fire spread
at sloped sites. The methodology described in "Determining Safety Zone
Dimensions, Wildfire Safety Guidelines for Rural Homeowners," (Colorado State
Forest Service) shall be used to determine defensible space requirements for the
required defensible space within building envelopes in areas exceeding five ( 5)
percent grade."

I have attached my completed application for a Special Use permit for a remodel
of my existing detached garage.
I am submitting to Garfield County plans for the remodel of our existing detached
garage as a accessory dwelling. This accessory dwelling is on our property at
0841 County Road 225, Rifle, CO 81650. or Tract #21 of the Antlers
Subdivision. ( see attached deed)
Our subdivision covenants allow for a guest house not to exceed 1500 square
feet in area. The proposed dwelling will be inside the existing gray garage.
There will be no exterior work done to the building it will be a remodel on the
interior. The proposed remodel will be a 25 x 25 guest room/apartment. It will
have only one bedroom and one bath with a kitchenette.
We have contacted the Colorado Division of Water Resources regarding the
impact on our existing well. (see attached letter dated 12/31/97 and well
application). We will be adding onto the existing leach field to accommodate the
extra sanitation needed.
The traffic impact will be minimal(Marvin Stephens came and approved current
driveway), no more impact than normal guests entering and leaving.
We are in an new subdivided area and the Assessors office does not have a
map. I have attached a list of the adjacent owners according to their office and a
county map outlining our area. The other attachments are our drawings of the
proposed remodel and our property.

Dear Mark,
Per our phone conversation on March 27, 1998 regarding the Aaberg application, request for a living unit above the
garage on lot 21 Antlers Orchard Development l like to note the following:
I) The current permit for this property is Pennit No. 201118, which is approved for Household Use Only
(one single family dwelling and no outside uses).
2) A Well Permit Application was submitted 12116/97 to expand the use of the existing well although it was
returned becau~e the West Divide Water Conservancy Disttict contract had not been approved. This
application was resubmitted 3/4/98 and is currently pending.
3) Additionally, per a phone conversation with Janet Maddock of West Divide Water Conservancy District on
3/27 /98, a contract has not been approved or finalized do to lack of payment by the Aaberg's.
At this time it appears that replacement water has not been purchased and lhe use of the existing well bu
not been expanded for the proposed uses for the upcoming hearing on April J3, 1998. Thus a legal water
supply has not been provided for the 11dditional dweUlng. If and when the pending appllcadon It
approved, the applicant should provide you with 11 copy showing that a legal water supply exists.

West Divide obtains its storage water from Ruedi Reservoir and
Green Mountain Reservoir. Current federal policy has made it
increasingly difficult to predict availability of water to West
Divide. While we cannot guarantee that we can make any water
available to you under this contract, we will continue to do
everything possible to assure availability of the federal water
while we develop alternative supplies.
This water allotment contract may require you to obtain a well
permit from the State Engineer's office. Once your well is drilled
you are required to install a measuring device and submit a meter
reading to West Divide. You will be provided with a special form
for this purpose upon notification that your well has been drilled.

Your application to lease water from West Divide Water Conservancy
District was approved effective January 1, 1998, at the Board of
Directors meeting on December 10, 1997.
However, your application was for one house and one acre foot of
water. A representative from the Water Resources office in
Glenwood was at the meeting. He stated that once you add a dwelling
unit to the existing permit, that permit looses its exempt status
and becomes a non-exempt permit which requires you to augment the
existing use.
Therefore, the Board approved your application and contract for two
acre feet instead of one.
Upon receipt of the following fees, I will forward you a copy of
the approved contract as well as send copies to the pertinent
agencies involved.

Applicant. hereby applies to the West Divide Water Conservancy District. a pofitical subdivision of the State
of Colorado. organized pursuant to and existing by vir·tue of C.R.S. 1973. §37-45:101. ~. <hereinafter referred to as
the "District") for an allotment contract/lease to beneficially and perpetually use water or water rights owned, leased. or
hereafter acquired by the District. By execution of this contract/lease and the attached application. Applicant hereby agrees
to the following terms and conditions:
1. Water Ri9hls: /\pplicant shall ow11 water rights at the point of diversion herein lawfully entitling
Applicant to divert water. which will be surµlementou anu auqrnenteu by water leased herein. If Applicant intends to divert
through a well. it must be understood by Applicant that no right to divert exists until a valid well permit is obtained from
the Colorado Division of Water Resources.
2. Ouanlity: Water applied ror by Lhe Applicant in the aroount set forth above shall be diverted at
Applicant's point of diversion from the District's direct flm; water rights. and when water is unavailable for diversion
pursuant to administration by the Colorado StJle E119ir1ecr duri119 periods when said direct flow water right is not in priority.
the District shall release for t11e use or Applicant up lo said quantity in acre feet per year of storage water owned or
controlled by the District. It is understood t11at any quantity allotted from direct flow. storage or otherwise. to the
Applicant by the District will be limited by the priority of the District's decrees and by the physical and legal availability
of water from District's sources. Any quantity allotted will only be provided so long as water is available and the Applicant
fully complies with all of the terms and conditions of this contract/lease. The District and the Applicant recognize that
some of the District's decrees may be in the name of the Colorado River Water Conservation District. and the ability of the
District to allot direct flow right to the Applicant may be dependent on the consent of the Colorado River Water Conservation
District. If at any time the Applicant determines it requi1·es less water than the arrount herein provided. Applicant may so
notify the District in writing. and t11e amount of water allotted under this contract/lease shall be reduced permanently in
accordance with such notice. Rates shall be adjusted accordingly in following water years only.
3. Beneficial Use and Location of Beneficial Use: Any and all water allotted Applicant by the District
shall be used for the following beneficial use or uses: municipal. domestic and related uses. or corrmercial (except to the
extent that Ruedi Reservoir water may not be available for crnrinercial as that term is defined on Page 5 of Contract No. 2-07-
70-W0547 between the United States and the West Divide Waler· Conservancy District). Applicant's beneficial use of any and
all water allotted shall be within or through facilities or upon land owned. leased, operated, or under Applicant's control.
4. Decrees and 0(>] ivrry: Exchange releases made by the District out of storage from Ruedi Reservoir
and Green Mountain Reservoir. or other works or f ac i l it i es of the District. or f ram other sources available to the District.
shall be delivered to the Applicant at the outlet '•<Jrks of said storage facilities or at the decreed point of diversion for
said other sources. and release or delivery of water at such outlet or points shall constitute performance of the District's
total obligation. Delivery of water by the District from Ruedi Reservoir or Green Mountain Reservoir shall be subject to
the District's lease contracts with t11e United States Btweau of Reclamation. Releases from other facilities available to
District shall be subject to the co11tr;1cts. lJws. rules. and regulations governing releases therefrom. Furtt1erITKJre, the
District hereby expressly reserves the riqflt l.o stun: wc1LPI' il11d to mJke exchange releases from structures lhat may be built
or controlled by the District in the futtll'e. su long as the water service to the Applicant pursuant to this agreement. is
not impaired by said action. Any quantity of the Applicant's allocation not delivered to or used by Applicant by the end
of each water year (October l). slli111 revert. t.o U1e water supplies of the District. Such reversion shall not entitle
Applicant to any refund of payment made lor such water.
Water service provided by the District shal 1 be 1 imited to the amount of water available in priority at the
original point of diversion of the District's applicoble water ri~1l1t. and neither the District. nor those entitled to utilize
the District's decrees. may call 011 any greater aroount at ric\" or alternate points of diversion. The District shall request
the Colorado Division of Water Resources to estimate any conveyance losses between the original point and any alternate point.
and such estimate shall be deducted from this amount in each case.
5. Alternate Point of Diversion and Plan of Augmentation: .Decrees for alternate points of diversion
of the District's water rights or storage water may be required in order for App 1 i cant to use the water service con temp 1 ated
hereunder. Obtaining such decree is the exclusive responsibility of Applicant. The District reserves the right to review
and approve any conditions which may be attached to judicial approval of said alternate point of diversion as contemplated
or necessary to serve Applicant's facilities or lands. Applicant acknowledges and agrees that it shall be solely responsible
for the procedures and legal engineering costs necessary for any changes in water rights contemplated herein. and further
agrees to indemnify the District from any costs ur losses related ther·elo. Applicant is solely responsible for providing
works and facilities necessary to obtain/divert tt1e waters at said alternate point of diversion and deliver them to
Applicant's intended beneficial use. Irr·espective of the amount of water actually transferred to the Applicant's point of
diversion. the Applicant shall make anrural payments tu lire District based upon the amount of water allotted under this
contract/lease.
In the event tt1e Appl itiHlt intends to Jpply for~ on alternate point of diversion and to develop an
augmentation plan and institute legal proceedings tor U1e approval of sucti augmentation plan to allow the Applicant to utilize
the water allotted to Applicant hereunder. the Applicant shall give the District written notice of such intent. In the event
the Applicant develops and adjudicates its oc.TI augmentation plan to utilize the water allotted hereunder, Applicant shall
not be obligated to pay any amount under Paragraph 18 belo·•. In any event. the District shall have the right to approve or
disapprove the Applicant's augmentation plan and the Applicant shall provide the District copies of such plan and of all
pleadings and other papers filed with the water court in the adjudication thereof.
6. Contract/lease Payment: Nrn1·refu11c.Jable. one time administrative charge, in the amount determined
by the Board of Directors of the District from time to tiwe. shall be submitted with the application for consideration by
the District.
Annual payment for lhe 'Nalcr service descritJed herein st1all be determined by the Board of Directors of the
District. The initial annual payment shall be made irr full. within thirty (30) days after the date of notice to the Applicant
that the initial payment is due. Said notice will .idvise U1e J\pplica11t. ilroong other things. of the water delivery year to

Annual payments for each year thereafter shal 1 be due and payable by the Applicant on or before each
January 1. If an annual payment is not made by the due date a flat $50 late fee will be assessed. Final written notice prior
to cancellation will be sent certified mail. return receipt requested. to the Applicant at such address as may be designated
by the Applicant in writing or set forth in tlris contract/lease or application. Water use For any part of a water year shall

require payment for the entire water year. Nothing herein shall be construed so as to prevent the District from adjusting
the annual rate in its sole discretion for future years only.
If payment is not made wil11in fifteen (15) days after the date of said written notice. Applicant shall at
District's sole option have no furLt1cr riql1t.. Lille or interest. under tt1is contract/lease v.:ithout further notice, and delivery
.may be immediately curtailed. The allotment of water. as herein made. may be transferred, leased, or otherwise disposed of
at the discretion of the Board of Di recto1·s of the Di strict.
Upon cancellution oft.his 'Nill.er allol.rner1L cunt.rilct/lease with the District. the District shall notify the
Division of Water Resources offices in Denver and Glenv.:ood Springs. The Division of Water Resources may then order cessation
of all water use.
7. Additional Fees and Costs: Applicant agrees to defray any expenses incurred by the District in
connection with the allotment of water rights hereunder. including. but not limited to. reimbursement of legal and engineering
costs incurred in connection with any water rights and adjudication necessary to allow Applicant's use of such allotted water
rights.
8. Assignment: This contract/lease shall inure to the benefit of the heirs. successors or assigns of
the parties hereto. Any assignment of the Appl icant.'s rights under this contract/lease shall be subject to. and must comply
with, such requirements as the District may l1ereaftcr adapt regarding assignment of contract/lease rights and the assumption
of contract/lease obligations by assignees and successors. Nothing herein shall prevent successors to a portion of
Applicant's property from applying to the District for individual and separate allotment contracts/leases. No assignment
shall be recognized by the District except upon completion and filing of proper forms for change of ownership.
Upon the sale of the rea I property to which this contract/lease pertains. Applicant has a duty to make buyer
aware of this contract/lease and proper forms for clliJnge of ownership must be completed.
9. Other Rules: Applicant shal 1 be bound IJy the provisions of the Water Conservancy Act of Colorado:
by the rules and regulations of the Boai·d of Directors of l11e District: and all amendments thereof and supplements thereto
and by all other applicable law.
10. Operation and Maintenance J\greemcnt.: Applicant shall enter into an "Operation and Maintenance
Agreement" with the District under terms and conditions determined by the board of Directors of the District. if and when.
the Board of said District determines in its sole discretion that such iln agreement is required. Said agreement may contain.
but shall not be limited to. provisions for additional annual monetary consideration for extension of District delivery
services and for additional administration. operation. and maintenance costs: or for other costs to the District which may
arise through services made available to the Applicant.
11. Change of Use· The District reserves tt1e exclusive right to review. re~pprove or disapprove any
proposed change in use of the water a I lotted hereur1dcr. J\11y use other tt1an that set forth herein or any lease or sale of
the water or water rights allotted heJ'm1de1· without the p1·ior written approval of the District shall be deemed to be a
material breach of this contract/lease.
12. Use ;111d Pl are of 1Jse: J\ppl icant a~irees to use the water in the manner and on the property described
in the documents submitted to the District at the time this contract/lease is executed. or in any operation and maintenance
agreement provided by Applicant. Any use 0Lt1er than as set forth thereon or any lease or sale of the water or water rights
herein. other tt1an as permitted in paragraph 8 above. sllatl be deemed to be a material breach of this agreement.

13. Title: It is understood and agreed t11at nothing herein shall be interpreted to give the Applicant
any equitable or legal fee title interest in or to any water or water rights referred to herein.

and water rights herein. and hereby iHJrccs to be bound by ;111y conservation plan adopted hereafter by the District for u~e

15. Restrict.ions: /\ppliciJnt. st1all restrict actual diversions to not exceed the Contract/Lease amount.
which provides water (on the formula of one acre foot. per {fv..'<'l ling) for ordinary l1ousehold purposes inside one single family
dwelling, the watering of domestic 1 ivestock. fire prutect.ion. and the irrigation of up to 6.000 square-feet of lawn and
garden.
Applicant shall also comply with al I restrictions and 1 imitations set forth in the well permit obtained from
the Colorado Division of Water Resources.
Watering of livestock shall be restricted to Applicant's domestic animals not to be used for commercial
purposes un 1 ess App 1 i cant obtains approva 1 from t11e Co 1 or ado Division of Water Resources for commerci a 1 use/Ii vestock watering
at a horse boarding facility, provided that in no event shall actual diversions exceed the amount of water provided by this
Contract/Lease.
Violation of this paragraph 15 shal 1 be deemed to be a material breach of this Contract/Lease.
16. Well Permit: If Applicant intends to divert through a well, then Applicant must provide to District
a copy of Applicant's valid well permit before District is obligated to deliver any water hereunder.
17. Menstiring Ocvir£~ or Meter: Appl icunt agrees to provide at its own expense an adequate measuring
device or meter to continuously and accurately measure at all times all water diverted pursuant to the terms of Applicant's
water right and the terms of this contract/lease. Applicant agrees to provide accurate readings from such device or meter
to District upon District's request. Applicant acknowledges that failure to comply with this paragraph could result in legal
action to terminate Applicant's diversion of wut.er by t11c Slate of Colorado Division of Water Resources.
18. Representations: By executing this contract/lease. Applicant agrees that it is not relying on any
legal or engineering advice that Applicant may believe has been received from the District. Applicant further acknowledges
that it has obtained all necessary legal and engineering advice from Applicant's own sources other than the District.
Applicant further acknowledges that the District makes no guarantees. warranties. or assurances whatsoever about the quantity
or quality of water available pursuant to this contract/lease. Should the District be unable to provide the water contracted
for herein. no damages may be assessed against the District. nor may Applicant obtain a refund from the District.
19. Costs of Water Court Filinq and AuCJmentation Plan: Should the District. in its own discretion.
choose to include Applicant's co11t.ract/le<1se t1erei11 in a •,.,iatPr court filing for alternate point of diversion or plan of
augmentation. then Applicant hereby agrees to pay to the District. wl1en assessed. an additional fee representing the
District's actual and reasonable costs and fees for Applica11t's share of the proceedings.
20. Binding AgrePmcnt: lhis agreement shall not be complete nor binding upon the District unless
attached hereto is the form entitled "Application and Data Form to Lease Water From West Divide Water Conservancy District"
fully completed by Applicant and approved by t/1e District's engineer. Said attachments shall by this reference thereto be
incorporated into the terms of this aurrcnK~nt..

TAKE NOTICE that MIKE & KIM AABERG have applied to the Board of County
Commissioners, Garfield County, State of Colorado, to grant a Special Use Permit, in connection
with the following described property situated in the County of Garfield, State of Colorado; to-

Said Special Use Permit is to allow the petitioners to construct an Accessory Dwelling Unit at the
above location.
All persons affected by the proposed Special Use Permit are invited to appear and state their

your views by letter, particularly if you have objections to such request, as the Board of County
