WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Barrett Resources Corporation concerned with a Special Use Permit for a construction and operation of a produced water evaporation pit; WHEREAS, the Board held a public hearing on the 22nd day of Jnne 1998 upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opp011unity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: l. That proper publication and public notice was provided as required by law for the hearing before the Board of Cotmty Commissioners. 2. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Penni! be and hereby is approved to allow for the construction and operation of a produced water pit, upon the following specific conditions: l. That all representations of the applicant, both in the application and verbally at the hearing, shall be considered conditions of approval, unless approved otherwise by the Board. 2. The operation of the facility be done in accordance with any federal, state or local regulations governing the operation of this type of facility. 3. The issuance of this Special Use Permit is subject to submittal of copies of any quarterly water analysis submitted to the COGCC for water in any of the proposed monitoring wells. Any determination of contamination of the groundwater, will result in the immediate discontinuance of the facility, subject to a determination of mitigation in a public hearing before the Board in the same procedure required for the initial hearing. 4. All vehicles accessing the facility and other mobile equipment shall be registered with the Garfield County Clerk & Recorders office, as required by law. 5. Any seed used for revegetation, shall be certified weed free seed and the applicant shall be responsible for maintaining the site in a weed free manner. 6. The facility is for the sole use of the applicant. If any other companies are to be added as users, a new special use permit must be obtained. 7. An emergency plan will be filed with the County Emergency Preparedness Office and the Rifle Fire District. 8. The applicant will mitigate all documented road damage to CR 246 caused by water trucks accessing the facility. Datedthis_2_1_dayof July , A.D. 192_L.
