when the following proceedings, among others were had and done, to-wit:

A RESOLUTION CONCERNED WITH THE APPROVAL OF 3 SPECIAL USE PERMIT
APPLICATIONS BY BONNEVILLE FUELS CORPORATION
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has received application from Bonneville Fuels Corporation for 3
Special Use Permits for natural gas wells on the following described

WHEREAS, the Board held a public hearina on the 23rd day of May,
1988, upon the question of whether the above-described Special Use Permits
should be oranted or denied, at which hearing the public and interested
oersons were given the opportunity to express their opinions regarding the
issuance of said Special Use Permits~ and

required by law for the hearinq before the Board of County
Commissioners.
That the hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that hearing.
3. For the above stated and other reasons, the proposed use is in
the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Garfield County, Colorado that the Special Use Permits be and hereby
are authorized permittina the use of the above described tracts of land
for natural gas wells upon the following specific conditions:

In addition, the applicant shall provide on-going maintenance to
County Road 320, under supervision of the Road and Bridge
supervisor, including, but not limited to, returning the County
road to not less than its• condition prior to the commencement of
drilling activities, at such time as the wells are drilled,
completed, and eouipped for production. Dust control measures,
including mist drilling, will be utilized as needed.
4. The applicant shall submit a road restoration bond, or other
security acceptable to the Board of County Commissioners,
consistent with the prov1s1ons of Resolution No. 82-83, as
amended, in the amount of $90,000, to ensure compliance with
Condition #3. Said security shall be maintained in place until
such time as the wells have been drilled, completed, and equipped
for production.
5. The applicant shall submit lease agreements for mineral rights,
including authorization for surface use and access. Restoration
shall be addressed by these agreements or separate restoration
aoreements submitted.
6. The applicant shall comply with all applicable State and Federal
Agency reauirements and obtain all appropriate permits.

8. That prior to the issuance of a Special Use Permit for the well
site located in the NW 1/4 NW 1/4, Section 27, T6S, R94W, the
applicant shall submit information certifying that the well site
and associated structures will be elevated l' above the 100 vear
floodplain, identified on the Preliminary Floodplain mapping done
by the Army Corps of Engineers, as provided hy the CWCB, and that
a statement from a registered engineer be submitted certifying
that such fill will not adversely affect any upstream or
downstream properties.
9. The applicant shall have 120 days from the date
of Conditional Approval to meet all conditions
Resolution. The Special Use Permits shall be

unless construction or use has commenced.
