This letter confirms that on August 6, 2012, the Board of County Commissioners, as the Local
Licensing Authority, provided local verification to the Medical Marijuana Enforcement Division for
Green Natural Solutions, Inc.'s Optional Premises Cultivation Operation (OPCO).
You obtained local verification, in part, because you were operating in unincorporated Garfield
County prior to the June 21, 2010 moratorium. Because your OPCO was in place prior to the
amendments to the Unified Land Use Resolution (ULUR), your OPCO may be a pre-existing,
nonconforming use of the land.
Please contact the Garfield County Community Development Department to confirm your pre-
existing nonconforming status and to address the necessary building and other structure -related
permits. Please contact Gale Carmoney, Code Enforcement Officer, within 45 days to set up a time
for an inspection of your OPCO. Mr. Carmoney can be reached at (970) 945-8212, Ext. 1530.
Also please be advised that should you enlarge, expand, extend, or alter your operation, the right to
continue your OPCO at its current location terminates immediately. See ULUR section 10-103. In
such event, you would be required to apply for a land use change permit through the Community
Development Department, which, depending on where you are presently operating, may include
relocating your OPCO to a zone district where OPCOs are allowed. The ULUR discusses in detail
what constitutes enlarging, expanding, extending or altering a nonconforming use. For further
clarification and requirements, the ULUR is available at www.garfield-county.com.
If you are presently located within a Commercial General, Commercial Limited or Industrial Zone
District and would like to avoid the above restrictions, you may decide to apply for a land use change
permit at this time. The Community Development Department can provide you more information
about this process when you contact us to arrange for an inspection of your OPCO.
