1. On June 12, 2014, I mailed a copy of a Public Notice, a copy of which is attached
hereto as Exhibit A, via certified mail, return receipt requested, to all landowners within 200 feet
of subject lots in Ironbridge Phase II, Blocks 2 and 3 and all mineral owners. A list of the
landowners and mineral right owners is attached hereto as Exhibit B. Copies of all Return
Receipts received as of June 27, 2014 are attached as Exhibit C. Seven (7) Notices were
returned undeliverable or not picked up.

TAKE NOTICE that Blue Heron Properties, LLC has applied to the Garfield County Director of Community
Development, to request a Final Plat Amendment Block 2 and 3 Phase II of Ironbridge excluding Lots 250, 254,
258, 259, 260, 268, 271, 274, 288, 290, and 296 also known as the Club Villas (alternatively known as the
Aspen Collection) situated in the County of Garfield, State of Colorado; to -wit:

Description of Request:
Ironbridge Phase II Filings 1, 2 and 3
Ironbridge Development
To amend Block 2 and 3 Phase II of Ironbridge (excluding Lots 250, 254, 258,
259, 260, 268, 271, 274, 288, 290, and 296); also known as the Club Villas
(alternatively known as under the Aspen Collection). This request is to correct lot
line configurations and does not increase the number of lots or decrease the
amount of open space.
All persons affected by the proposed amendment are invited to comment regarding the application. You may
state your views by letter, or you may call the Community Development Department at (970) 945-8212
regarding the application. The Director will give consideration to the comments of surrounding property
owners, and others affected, in deciding whether to grant or deny the request. The application may be reviewed
at the office of the Planning Department located at 108 8th Street, Suite 401, Garfield County Administration
Building, Glenwood Springs, Colorado between the hours of 8:30 a.m. and 5:00 p.m., Monday through Friday.
The Director will issue a decision on this application on June 30 2014, therefore any comments to be
considered must be received prior to that date.

The current developer of Ironbridge, Blue Heron Properties, requests an amendment to Blocks
2 and 3 of the Final Plat for Ironbridge Phase 11. The PUD requires a minimum lot size of 4,000
square feet and it appears that the final plat was approved with lots that did not meet this
minimum. Several of the lots in Blocks 2 and 3 had been sold and homes constructed on
them, these Tots are not part of plat amendment. Those lots that are part of the plat
amendment are vacant and therefore the developer seeks to bring the lot sizes into compliance
with PUD requirements.
B. APPLICABLE REGULATIONS
The Amended Final Plat process contained in Section 5-305 of the 2013 Land Use and
Development Code, as amended (LUDC) stipulates an Administrative review procedure, with
the Plat being presented to the Board of County Commissioners for signature followed by
recording in the Office of the Clerk and Recorder. Criteria for the review have been satisfied as
listed below:
5-305 Review Criteria
1. Does not increase the number of Tots;
Staff Comment: This application does not increase the numbers of lots but solely
amends the lots lines.
2. Does not result in a major relocation of a road or add 1 or more new roads; and
Staff Comment: No new road or relocation of roads is proposed.
3. Will correct technical errors such as surveying or drafting errors.
Staff Comment: This plat is not correcting technical errors.
C. REFERRAL AGENCY COMMENTS
1. The County Surveyor has reviewed the proposed amended plat and provided
comments to the applicant's surveyor. A condition of approval is recommended to
assure that the comment is adequately addressed prior to signature of the plat.
D. ADJACENT PROPERTY OWNER COMMENTS
A letter was received from an owner that resides within the area being amended, however her
lot was not among those being amended. This owner is concerned that their property does not
meet the 4,000 square foot minimum lot size and seeks to have the current developer correct
this lot as well. These comments relate to a civil issue between the owner and the Property
Owners Assocation and the developer and do adversely impact the review criteria for an

amended plat.
E. RECOMMENDATION
Staff recommends that the Director of Community Development approve the requested plat
amendment with the following conditions:
1. That all review comments received from Community Development and the County Surveyor
have been adequately addressed and the plat amended accordingly.
2. Prior to scheduling the plat for Board of County Commissioner signature, the applicant shall
submit a mylar signed by all required entities except the Board of County Commissioners,
Clerk & Recorder and County Surveyor.
3. Within 90 days of this determination the Amended Plat shall be signed by the Chairman of
the Board of County Commissioners and recorded in the office of the Garfield County Clerk
and Recorder. The Plat shall meet the minimum CRS standards for land survey plats, as
required by Colorado state law, and approved by the County Surveyor.
4. Submittal of the mylar to Community Development must be accompanied by sufficient
recording fees to record the plat.

Dear Kathy,
My husband and I live in Ironbridge, lot 286, at 306 Blue Heron Vista. I
came in a spoke with Tamara yesterday (Wednesday, June 25, 2014)
about our concerns about the proposed changes.
The proposal shows our lot as having no changes made to it, yet our
original ILC and the proposed lot 286 do not have the same
measurements (see attached files). The directions are different (N, S, E,
W), the back of the lot is different and part of the front of the lot is
different. Tamara was unable to indicate why this is. We would like to
know what our actual plat is and which one is correct? We will be letting
Karl Hanlon know that we are requesting clarification on this.
In my discussion with Tamara, our concerns are as follows:
1. They are bringing all of the lots up to the required 4000 sq. ft. Yet,
our lot is 3378 sq. ft. and they are not making ours larger. This is going
to devalue our home in comparison with the others. Don't they need to
make all of the lots conform with PUD?
2. The overall square footage on our street along is increasing by 19%
due to the change of the homes and floor plans on the new proposal.
3. We would like our lot to go out to the street as do the other lot lines
and we will be contacting Karl Hanlon about this today (6-25-14).
We are trying to understand all of this and we appreciate your time.

correct it. If you look at the plat, our lot could be made close to 4,000 sq. ft.
by extending it to the street. We are told that this is between the
owners/builders and ourselves, but it was the county that allowed for the
noncompliant lot in the first place. We are trying to speak with Karl Hanlon
about this as well with little success.

Dear Mary and Bruce:
Enclosed please find a revised plat showing the dimensions of your lot. As you will note
on the plat there are two segments called out relative to your lot, one being 16.24 feet and the
other being 1.80 feet. In order to come up with the full 18.04 feet of your lot, you need to add
the two together. However, to make this easier and more understandable we have included an
interior dimension listing the full 18.04 feet on lot 286.
Hopefully this resolves any issues you have with regard to your ILC in the amended plat.
As to your request to have your lot made larger you would need to have that conversation with
the Ironbridge Property Owners Association Board as the Property Owners Association is the
owner of the property immediately in front of your lot that you are interested in acquiring.
Unfortunately, this is not something that Blue Heron Properties can provide to you, or which is
appropriate at this time to include in the amended plat filing.
