A final Electrical Inspection from the Colorado State Electrical Inspector; 2. Permanent address assigned by Garfield County Building Department posted where readily visible from access road; 3. A finished roof, a lockable house, complete exterior siding, exteri or doo rs and windows installed, a complete kitchen with cabinets, a sink with hot & co ld running water, non-ab so rbent kitchen floor coverings, counter tops and finished walls, ready for stove and refrige ra tor, all necessary plumbing; 4. "'f l,\;r-.~t-\ /7?:57z .s+ ( GARFIELD COUNTY BUILDING AND PLANNING 970-945-8212 MINIMUM APPLICATION REQUIREMENTS For SINGLE FAMILY DWELLING CONSTRUCTION Including NEW CONSTRUCTION ADDITIONS ALTERATIONS And MOVED BUILDINGS In order to understand the scope of the work intended under a permit application and expedite the issuance of a permit it is important that complete information be provided. When reviewing a plan and it's discovered that required information has not been provided by the applicant, this will result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor shall be required to provide this information before the plan review can proceed . Other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. Any project with more than ten (10) occupants requires the plans to be sealed by a Colorado Registered Design Professional. To provide for a more understandable pl an in order to det ermi ne compliance with the building, plumbing and mechanical codes, applicants are requested to review the following checklist prior to and during design. Applicants are required to indicate appropriately and to submit the completed checklist at time of application for a permit. Plans to be included for a Building Permit, must be on drafting paper at least 18"x24" and drawn to scale. Plans must include a floor plan, a concrete footing and foundation plan , eleva tion s all sides with decks, balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line and original grade. A section showing in detail, from the bottom of the footing to the top of the roof, including re-bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation, sheeting, house -rap, (which is required), siding or any approved building material. Engineered foundations may be required. A window schedule. A door schedule. A floor framing plan, a roof framing plan, roof must be designed to withstand a 40 pound per square foot up to 7,000 feet in elevation, a 90 M .P .H. wind speed, wind exposure B or C, and a 36 inch frost depth. All sheets to be identified b y number and indexed . All of the above requirements must be met or your plans will be returned. All plans submitted must be incompliance with the 2003 IRC. 1. 2. 3. It is our understanding that hori zontal insulation has been placed extending from the bottom of the trench b eams. The Post Tensi oned Slab-on-G rade found at ions designed by this office do n o t require the hori zontal in sulation to be placed. Requirements for th e h orizo ntal installation per the International Residential Code, 2003 Edition (2003 IRC) are based on the Air Freezing Index at the proposed s lab lo cation . The 100-year Air Freezing Index for Glenwood Springs is 1180 per the Air Freezing Index-USA Method prepared by NOAA - National C limatic Da ta Center. Based on Table R403.3 of the 2003 IRC, horizontal insulation is not required for th e above subject si tes. From our observations, we have concluded that this foundation has been constructed in accordance with the approved construction documents and guidelines set forth by the Post Tensioning Institute. All required observations and their subsequent letters by this office for the Post Tensioned Slab-on-Grade Foundation System which includes the Trench Beam and Steel Observation including Ufer Rod, Tendon Placement (pre-pour) Observa tion, and Tendon Stressing Observation have been approved by thi s office. We also note that the required insulation ha s been ins talled per our structural details and the Intern ational Residential Code, 2003 Edition. No further observations are required. The stressing of the tendons were conducted within acceptable tolerances and appeared to be in general conformance with the construction. At this time, tendon tails may be cut off and the anchor cavities grouted with a high strength, non-sh rink grout. This concludes the construction of the post-tensioned foundation system . The contractor assumes responsibility for the accuracy of a ll building dimensions , locations on lot, foundation elevations, and the slab step layout. The installation of the tendon s and interior sti(fened beams appeared to be in general conformance with the construction plans . We observed the top of grade appeared to be at the correct elevation to maintain the slab thickness per plan. It is the responsibility of the contractor to verify slab thickness and tendon layout remain as observed during concrete placement. No other item s were observed at this time. T erms defined in t he I Freedom Program Purchase and Sales Ag reement and used in this Contract shall hold the same definition in this Contract. The constru cti on of the Residence on the Lot, each as defined in the Freedom Program Purchase and Sa le Agreement shall be referred to herein as (the "House"). 1. Contactor's Scope of Work . Contractor's scope of work shall consist of construction services for the House as set forth below, wh ich collectively sha ll be referred to herein as the "Work." 2. Plans a. Contractor has prepared the following dr awings, consistent wit h other homes in t he Project, as defined in the Freedom Program .Purchase and Sale Ag reement, and constru cted by Contractor: i. t l OL 1! ii. iii. _____ (coll ectively, the "Plans"). 3. Constru ct ion Services a. Contractor shall procure and pay for all permits, licenses, approvals and inspections required for the House. b. Con tr actor shall provide or ca u se to be provided all labo r , materials , equipment and serv ices to constr uct the House in a workmanlike manner, co nsis tent with homebuilding industry standa rd s in Garfield County, pursuan t to the Plans. Contractor sha ll not be responsible for furnishing or constructing any improvements or performing any work unless t he same are spec ifi ca ll y set forth in the Plans or in th is Contract. 4. Owne r's Responsibilities a. Owner sha ll cooperate with Con tr actor in securing any permits, li censes, approva l s and inspecti ons for the House . b. Upon Contractor's request, Owner sha ll provide all "Requested Information" to Contractor in a timely m anner, a nd sha ll be ava il ab le to meet with Contrac tor to approve plans and review t he pr ogress of the Work. Requested Informati on sha ll include, but not necessarily be limited to : i. proof of financing ii. c hange order r equests iii. proof of necessary insurance c. Owner specifically agrees and acknowledges that f in ancing for the House is the sole and exclusive obligation of Owner, and Owner's ab ility to obta in financing is not a condition precedent to Owner's ob li gations set forth in t his Contract. Owner represents tha t Owne r is q ualified to obtain such financ ing and/or has available funds in the amount necessary to complete the House. Owner agrees to promptly seek and obtain any and all required financing for the Ho use. Owne r agrees to provide Contractor with proof , sa ti sfactory to Contractor, that Owner's financing f or the House has been f inalized, and agrees that Contractor is not obligated to proceed with construct ion on th e House until such proof is delivered to Contractor and the Closing of the Lot Page 1 of 8 5. 6. 7. has occurred. d. Owner agrees not to let or enter into any ot he r contrac ts in co nnec ti on with the House or t he Lo t w it hout the prior written approval of Contractor. Owner acknowledges and agrees that entering into any contract or pe rmitting any other contractor onto the Lot may impede the Contractor's abi lit y to manage th e cost of the House a nd timely co mpl ete performance of th e Work as con te mplated herein. Violation of this provision, shall, in addition to any other remedies set f orth herein, permi t Contractor to exercise its te rminati on rights as specified herein . e. Within three (3) days afte r substa ntial completion of the Work, Owner shall notify all utility suppliers that Owner is respon s ible for utility expenses from and after th e date of sub stantial completion. T ime a. Without limiting the foregoing, Owner agrees to provide all Requested Informat ion to Contractor to s tart construction within three (3) months of the date on which th e Closing of the Lot occu rs. Should Owner delay commencement construction beyond sa id thr ee (3) mo nth s, Owner shall pay Contractor t he sum of Five Thousand Dollars ($5,000.00) per month , allocated for fractional portions of months ("Extension Fee"). T he parties he reby agree th a t Contractor's actu al damages for such Owner delay cannot be ca lcu lated now with certainty, and that Liquid ated Dam ages are a reasonable estimate t hereof. b. Prov ided tha t Owner has complied with all of its obligations hereunder, including but not limited to timely payment of all sums due to Contractor, and Owner has secured financing for the House and delivered sat is factory proo f thereof to Contractor, and C losing of th e Lot has occu rred, Contractor shall commence construction at the House Site within sixty (60) days after th e issuance of a building permit (the "Commencement Date"). c. Su bs tantial Completion of the House shall occur within eight (8) months after t he Commencement Date (the "Completion Date "). Th e Completion Date may be extended on account of: i. labor di spu tes ; ii. fire or other damage to the Hou se; iii. material or labor shortages; iv. transportation delays; v. gove rnmental action ; vi. unu sua l w ea th er conditions ; vii. change orders or del ays caused by Owner; viii. the f a ilure of Owner to provide inform ation and/or approvals i n a t ime ly manner ; o r ix. any other causes whic h are beyond Contractor's co ntro l or whi ch may otherwis e ju sti fy t he delay; and x. Force Majeure events. d . Without limiting the foregoing, Owner ag rees to pr ovide a ll req uired inform atio n to Contractor t o s ubsta nti all y com plete co nstruction by the Completion Date. Should either party delay Substantial Comple t ion of the House beyond the Completion Date, the delaying pa rty shall pay the other party the sum of Five Thousand Doll ars ($5,000.00) per month , a lloca ted for fracti ona l portions of mon ths as an Extension Fee. The parties hereby ag ree th at actua l damages for such delays can not be calcu lated now with certainty, and that these · Liqu id ated Dam ages a re a reasonabl e estimate thereof. Ownership of Plans. Owner agrees and acknowledges th at the Plans, and any amendments or rev isions thereto, are a nd sha ll rem ain the sole and exc lu s ive property of Contractor, and Owner ag r ees not to se ll , transfer, assign, use, copy or share the same with any person or entity without the pr ior and express wr itten conse nt of Contractor , which may be withheld in Con tra cto r's sole di screti on. Pa yme nt Proced ure. Page 2 of 8 a. Owner shall make, or cause Owner's lender to make, progress payments for the Work in accordance with the schedule attached hereto as Exhibit A ("Draw Schedule") or at any intermediate point based on the percentage of completion of work at that time identified by inspection. Progress payments shall be delivered to Contractor within five (5) days after Owner's receipt of Contractor's request for payment, which requests for payment shall include appropriate lien waivers from all parties who provided labor and/or materials applicable to the previous request for payment. b. In the event that at any time the amount of Owner's loan available for distribution is less than the amount of the Contract Price remaining to be paid, Owner shall deposit the difference into a construction cqntrol account and execute a customary construction control agreement with respect to the holding and distribution of said sum prior to Contractor's obligation to commence or continue construction at the House Site. Owner shall be responsible for the payment of any fees in connection with the construction control. c . Within ten (10) days after substantial completion of the Work, Owner shall pay all remaining amounts due under this Contract. d. All monies not paid when due as provided herein shall bear interest at the rate of eighteen percent (18%) per annum. e. In the event any installment is not paid when due, Contractor may exercise any remedy set forth in this Contract or exercise any other legal and/or equitable rights which may be necessary or appropriate to enforce this Contract. · 9. Changes in the Work a. Buyer understands, acknowledges and agrees that the Contract Price includes only the items set forth in the document attached hereto as Exhibit B ("Features List"). These are referred to herein as ("Standard Selections"). b. Additions, upgrades, and/or optional items which are made available to Owner shall be selected, contracted and paid for in a separate contract with Contractor or by Change Order. c. Contractor may offer pre-designed and priced options for each Residence to Owner. i. Options which change the architectural design of the Residence, such as an additional garage bay, are referred to as architectural options ("Architectural Options"). ii. Options which change the materials and colors of the Residence, such as carpet type and/or color, are referred to as design options ("Design Options"). iii. Together these are often referred to as ("Options'). d. Changes to the Work that are not a pre-designed and priced Architectural Option or Design Options are referred to as change orders ("Change Orders"). i. All change orders shall specify the following : 1. the change in the Work, 2 . the adjustment to the Contract Price, if applicable, and 3. the adjustment to the Completion Date, if applicable. e. Changes in the Work can only occur by purchasing an Architectural Option, purchasing a Design Option or by written Change Order prepared and approved by Contractor. f . Options will be offered to the Owner, provided the following conditions have been adhered to: i. Options must be selected in a timely manner. Each Option is assigned one of three dates which are referred to as design selection 1 ("DS1 "), design selection 2 ("DS2") and design selection 3 ("DS3"). DS1 is six weeks prior to the start of construction, DS2 is prior to the start of construction and DS3 is 45 days after the start of construction . ii. Should Owner fail to select Options on or before the applicable design selection date, Seller shall have the right to either install the standard selection or deny the Option. iii. Architectural Options shall be selected concurrently with the execution of this Agreement, and the cost of each Architectural Option shall be added to and included in the Purchase Price. iv. Design Options shall be selected subsequent to the execution of this Agreement. Payment in the amount of 100% of the price of each Design Option shall be due when each Design Option is ordered. g. ALL PAYMENTS FOR DESIGN OPTIONS ARE NON-REFUNDABLE TO OWNER h. All Option purchases and change orders shall be executed by both the Owner and the Contractor and paid for by Owner, prior to the commencement of the work set forth therein . i. In the event that any increase in the cost of construction arises because of a change in applicable governmental regulations taking effect after the date of this Contract, such revision or condition shall be the Page 3 of 8 ·basis f or a change ord er and Contractor sha ll rece ive appropriate compensation for making such change . 10. Possess ion a nd Use of the Lot. Upon the Closing of the Lot , Owner is deemed to have conveyed to Contractor an absolute and exclu sive right to possess an d use th e Lot. Owner s hall not enter the Lot unless accom panied by an authorized rep re sentative of Contractor. Owner sha ll not in struct , direct or ot herwise contact Contractor's laborer s, subcon tracto rs or consultants. Contractor shall permit access to the Lot by inspectors of Owner's lender. Contractor sha ll return possessi on of the Lot to Owner at the time that all payments and obligations r eq uired of the Owner have been fully paid and performed by the Owner. If po ssess ion of the Hou se and Lot is taken by the Owner before Owner's obligations set forth in th is Contract a re fully performed an d without the prior written co nsent of Contractor, Owner shall be deemed to have accepted th e Work as co mplete a nd sati sfactory, in co mplian ce of all of Contractor's obligations hereunder. 11. Walk Through . a. Upon notice from Contractor to Owner, Owner and Contractor shall schedule a walk-through of Owne r's home and shall compile a li st of any item s which are m aterially not in accordance with approved pl a ns and specifications, or do not m aterially con form to Garfield County standards. Contractor shall rep a ir, repl ace or otherwise remedy the items within a rea so nabl e time afte r Substantial Completion. b. Notwith standing the fact th at additional work may be r equ ired to co rrect the items, if the H ou se ha s reach ed Substantial Completion, th e n no funds shall be withheld from Contractor for th ese items. c. After Substantial Completion, the Limited Seller's Warranty includ ed in the Fre edom Program Purc ha se a nd Sal e Agreement shall apply. 12. No Assignment. Thi s Contract shall not be assigned by Owner or Contractor to any other party except after th e prior written consent of Owner or Contractor, which consent may be reserved in Owner's or Contractor's sole di sc retion. If Owner or Contractor assigns any of Owner's or Contractor's right s under this Contract t o any other party in violation of th is provision , said assignment shall be void and of no effect, and Owner shall be in default he re und er . Notwithstand ing th e foregoing, Co ntractor co nsents to a colla ter al assignme nt of thi s Contract to Owner's lender pursuan t to Own er's ag r eeme nt with its lender . 13. Insurance. a. Owner shall procure a nd maintain during th e term of thi s Contract th e followin g policies of insurance: i. Course of Construction insurance in the amount of the Contra ct Price; ii. Ho meowner's in su r ance , and a f ire and extended ri sk in surance policy, cove ring th e House and Lot, in an amount not less th an the Purchase Price, to geth e r with in su r ance cover ing loss or damage to Owner's personal property , and Owner's personal li ab ility for injuries which m ay be sust ained within th e Property; and iii. Compre hensive General Li ab ility insurance in the amount of $1,000,000 . b. Contractor sha ll maintain during th e term of thi s Co ntract: i. Workers co mpensa ti on insu r ance , as r equi red by law. 14. Termination of the Contract u po n Termination of the Freedom Plan Purchase and Sa le Agreement. Thi s Contract sha ll be deemed termin ated upon the termin ation of th e Freedom Pl an Purchase and Sale Agreement f or any reason. In such event, unl ess th e cause of such term in ation is th e default of Contractor as seller under the Free dom Plan Purch ase and Sale Agreement, Contractor sha ll be entitled to retain all other amount(s) previ ous ly paid to Contractor or oth erw ise due to Con tra cto r under this Contract. .... 15. Co ntrac tor 's Right to Stop Work an d Termin a te Contract. In add ition to a ll other remed ies se t forth in this Co ntract, in the event th at any payment is not m ade in full within five (5) days after suc h paym e nt is due, or Owner fai ls to perform any of it s dutie s under thi s Contract within ten (10) days after writte n noti ce fro m Con tractor, Contractor may stop th e Wo rk until payment is made or Owner fulfill s its duties. S hould th e Work be stopped f or a period of fift een ( 15) days or more upon Owner's failure to make a progress payment or as a result of any other act, om iss ion or neglect of th e Owner, th en Contracto r may, upon providing writte n no tice to Owner, te rm ina te this Contract. Notic es . All notices required by thi s Contract sha ll be in writing and shall be given by any of the following means to the bel ow li sted add resses or fax numbers: a. certified or regi ste red m a il , postage prep aid , return rece ipt req u ested, in which case notice shall be deemed delive red three (3) busi ness days a fter th e postm ark date; b. recognized commercial overnight courier, in which case notice shall be deemed delive red one (1) bus iness day aft e r receipt for de li ve ry by the courier; c. te lecopy tran sm ittal ("fax"), in which case notice sha ll be deemed delivered upon fax confi rmation of transmi ss ion to the intended party; or d. pers o nal delivery, in which case th e notice s hall be effective when rece ived. e. Contractor's Discl aim ers. Contractor makes no representati o n or w arranty, and shall in no event be r esponsib le fo r the foll owing: a. Ha za rdous materials (as defined by app li cable law) in the Ho use or on th e Lot ; b. Hom eowner's association assessments and/or property taxes applicable to the Lot; c. Owner's financing of th e Work; d . Any work or mate rials not supplied or in sta lled by Contractor pursuant to thi s Contract; or e .
