The Board held a public hearing on the 10th day of November, 2008, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the special use permit. F. The Board of County Commissioners closed the public hearing on November 10th, 2008, and acted on the basis of substantial competent evidence produced at the aforementioned hearing. Resolution NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit has been approved based on these findings: 1. Proper posting and public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of special use permits within the Garfield County Zoning Resolution of 1978, as amended. 5. That all representations made by the Applicant in the application and as testimony in the public hearing before the Board of County Commissioners shall be conditions of approval, unless specifically altered by the Board of County Commissioners; 6. The northwest leach field was not operating properly during a site visit conducted. Therefore, the integrity of the leach field must be evaluated and repaired if necessary prior to the issuance of a Special Use Permit; 7. A licensed professional engineer shall evaluate the flows of both ISDS effluent pumping systems to determine flow rates to each leach field, and an engineers statement demonstrating flow rates to the two (2) leach fields shall be provided prior to the issuance of a Special Use Permit; 8. The Applicant and any future owners shall retain a qualified licensed PE ora minimum Class D certified wastewater treatment plan operator to conduct routine inspection and maintenance of the wastewater system. A report of routine inspections and maintenance activity shall be maintained with other system records for review by Garfield County upon request; 10. The Applicant and any future lot owners shall retain a qualified professional engineer or a minimum Class D certified water treatment plant operator to conduct routine inspection and maintenance of the drinking water system. A letter from a professional engineer certifying that modification and/or upgrades to the ISDS have been completed in accordance with the plans and specifications of the Special Use Pemrit application and explanation that sewage flows are balanced to the maximum extent possible; 12. At any time potable water flows average greater than 4,000 gallons per day over a 30 day period, the owner shall immediately report this information accompanied by the concurrent wastewater flow information, to Garfield County Building and Planning and Colorado Department of Public Health and Environment, Water Quality Control Division; 13: The camper park is limited to seventy-six (76) camper spaces; 14. Tents are only allowed within a designated camper space; 15. The camper park shall comply with all applicable Garfield County zoning regulations at all times; 16. All proposed improvements, including but not limited to utility expansion and fire protection requirements shall be constructed prior to the issuance of a Special Use Permit; 17. The camper park is limited to the existing fifty-six (56) camper spaces and shall not exceed this occupancy requirement until a Special Use Permit has been issued; 18. The Applicant shall obtain an approved Administrative Flood -Plain Permit prior to the issuance of the Special Use Permit; 19. Dear Jim: In accordance with the repair permit, and our letter of December 2", the following work has been completed on the Heron's Nest RV Park septic systems: 1. Delivery of at least two truck -loads (24-cubid yards +/-) of clean sand, either concrete sand or play sand, to be used to fill in the settled are at the south-west corner of the field. Clean sand was delivered, and placed as required under the settling area on the southwest corner of the System #2 absorption field. Six chambers, three in each of the two outer rows, were removed, and clean sand fill was placed. 2. Delivery or supply from on-site, of the fill material to be placed over the surface of the fields, to help promote runoff of surface water. On-site material was used for this purpose. 3. Notification of the residents that the laundry will be shut down for a 7 -day period starting on a given date. Notification should be given at least 48 - hours in advance, preferably longer. The laundry was shut off during the rehabilitation work. 4. Contract with a sewage pumping company, to have the absorption field for System #2 pumped completely dry on a given date. The absorption field and the septic tank for System #2 were both pumped. 5. Contract with an excavator to begin excavation of both ends of the absorption field on a given date. The owner may elect to perform this work himself. The owner elected to do the work himself. 6. Confirm the local availability of the piping necessary to repair or replace any piping found to be broken, or broken in the process of excavating the field ends. All piping consisted of standard pipe sizes, and was readily available. 7. Confirm the local availability of Infiltrator multi -port end plates and Quick4 chambers, in sufficient quantity to replace all elements at the end of the System #2 absorption field. (20 -multi -port end plates, and 20-Quick4 Chambers). This is to ensure the ability to quickly replace any multi -port end caps or chambers damaged during excavation. A number of multi - port end chambers and Quick4 Chambers were on hand before excavation began. 8. Prepare the necessary piping modifications to re -direct the effluent from the pump chamber on System #2 to the pump chamber on System #1. Install piping with ball valves to allow the reversion to normal operations Heron's Nest RV Park — Remediation substantially complete. Thursday, January 8'h, 2009 Page 1 of 4 immediately. This was not done, as it was determined to be un -necessary, the remediation work did not take more than 4 -days. 9. Pump out the existing concrete septic tank serving System #2, and pressure wash the interior of the tank. Follow all OSHA rules for any person who enters the tank, including gas monitoring, protective clothes, protective helmet, face protection, supplied air, tank ventilators, tripod stands and personnel hoists, etc. The tank was pumped dry twice during the rehabilitation, once of its full volume, the second time of several thousand gallons, to allow work to proceed inside the tank. 10. While the tank is being pumped and pressure cleaned, the absorption field for System #2 should also be pumped out, which may require pumping at all four of the inspection ports, and even opening up access to other rows of chambers. This was done, as previously noted. 11. Inspect the interior of the tank, and all components. Video the entire inside of all compartments of the tank. Advise owner if any infiltration, no matter how small, is found. Advise if any other repairs or modifications are recommended in order to improve operational functionality. Follow all OSHA rules for any person who enters the tank, including gas monitoring, protective clothes, protective helmet, face protection, supplied air, tank ventilators, tripod stands and personnel hoists, etc. The tank was inspected, and video taken by the owner. No leaks were found. The drop "WYE" on the inlet had been knocked off, and there was not an elbow installed in the baffle wall between the first and second compartments of the tank. A new wye and 45 -degree street elbow were installed on the inlet end of the tank. Discharge level was re-established at approximately 15 -in. below the inlet height. A pair of 45 -degree elbows and a short segment of pipe were installed on the baffle wall, between the first and second compartments. The flow- through will now occur at approximately 14 -in. below the baffle penetration, or 26'/2 -in. above the floor of the first compartment. 12. If any leaks are found, make a determination as to whether the tank can be repaired or if it must be abandoned and replaced. Repairs, if necessary and possible, should be made on both the interior and -exterior of the tank walls with non -shrink grout, and further sealed on the outside with Bituthane sheet foundation sealant, over the patched area. Repairs were not needed to prevent leaks. However, it was noted that there were areas in the tank where the reinforcing steel in the roof was visible. This steel will continue to corrode, and over time, can be expected to cause the roof of the tank to fail. Observation of the tank should be continued on at least a bi- annual basis, to confirm that the interior roof has not failed. The interior roof is not supporting any weight, other than its own, since the original design of the improvements to this tank had reinforced steel slabs placed over, and spanning the existing tank, and bearing on native soils, to distribute the earth loading. 13. If the existing tank can be put back into service, switch the effluent discharge from this tank to the absorption field serving System #1. If the tank is determined to not be sound, then replacement tank(s) should be ordered immediately. Replacement tank(s) should have the same, or greater capacity than the existing. The existing tank was placed back in service., with the modifications noted in item #11 above. 14. While this tank is filling, a process which should take approximately 41/2 -days (at the design rate of 1,901-gpd) evaluation of the condition and repair/remediation of the absorption field for System #2 should be conducted. Careful track of the amount of sewage flowing into the existing concrete tank should be taken, in the form of daily depth readings, to be used to confirm the actual use of the system. Daily sewage depths in the first compartment were taken until the tank was full to the design operational level. A spreadsheet, showing the daily height and corresponding volume readings, is attached. 15. If repairs to the absorption field serving System #2 cannot be made within the above stated 41/2 - days, careful observation of the condition of the absorption field at System #1, which will temporarily be serving both systems, should be kept, and at the first sign of overloading, the Heron's Nest RV Park - Remediation substantially complete. Thursday, January 8th, 2009 Page 2 of 4 concrete tank serving System #2 should be pumped out again. As stated previously, the remediation of the System #2 field was accomplished in less time than the concrete tank took to fill. System #2 Absorption Field Repair/Remediation Once both ends of the existing field have been exposed, the absorption level of the field should be examined thoroughly for signs of grease on the surface. Grease may appear grey in color. The depth of the biomat in the field should also be examined. The top surface of the entire field should be lightly scraped with hand tools to remove any grease. No chemicals shall be applied. Removal using vacuum equipment may be attempted, but great care must be taken to prevent excess removal of supporting soils. Scouring of the top surface with water pressure might be attempted, but only if a means of capturing and disposing of the materials removed is provided. Throughout the process of cleaning the top surface, disposable protective clothing, gloves, face shields and respirators shall be worn by all personnel to prevent contact with waste materials. All materials removed from the surface of the absorption field shall be safely disposed of in accordance with all applicable Federal, State and local regulations. The examination of the open ends of the absorption field revealed significant grease presence, in the form of white/grey staining at, or near the tops of the multi -port end caps, was seen. The biomat depth appeared to be approximately 4 -in. to 5 -in. Exact depth was impractical to determine, since the field was fully saturated, and the surface layer tended to "flow". The owners employed a modified concrete - working tool attached to a 40 -ft. long section of PVC tubing, to scrape the top surface of the field. Working from both ends, they were able to remove a significant portion of the saturated materials from the surface of the field. In some cases, removal of the biomat caused over -excavation of the first foot or so of absorption surface at the entrance to the chambers. In these areas, clean sand was used to re - level the surface. There is a section, approximately 20 -ft. long, wth middle of each chamfser row, where the tool could not reach. Discussions as to whether or not to attempt to reach this area were centered around the difficulty and practicality of any approach. The possibility of pulling the concrete tool through the chambers was discussed, but the possibility of the tool becoming stuck on the walls of the Quick4 chambers, or in the biomat, was real. Ultimately the owners decided not to attempt to reach this segment of the absorption field, and to leave the area in the middle of each row un -touched. The biomat and grease evident in the outer segments of the absorption field appeared to be quite fluid, and may disperse over time. The owners have advised us that the materials removed from the absorption surface have been taken from the site for proper disposal in a landfill. At each end of the field, the native soils immediately adjacent to the Quick4 multi -port end caps were removed and replaced with 3/4 -in. washed gravel, to help support the end caps and pressure piping, and reduce settlement. The surface over the fields was re -graded, by the application of native soils, to provide better drainage. The original depth of the chambers was deeper than anticipated, and, as a result, the fill amounts placed were modified from the plan, to be not more than 4 -ft. deep over the top of the chambers. Due to the ground slope, this meant that approximately 2 -ft. of fill was placed at the western end of the field, and approximately 1 -ft. of fill was placed at the eastern end. The new top surface was graded, as shown on the drawings, away from the centerline of the field, towards the outer edges on the north and south sides. THIS RE -GRADING OF THE SURFACE MUST BE RE -VISITED IN THE SPRING, AFTER THE SNOW MELTS, AND ANY LOW SPOTS FILLED. It is highly desirable to have the top surface of the field grade Heron's Nest RV Park — Remediation substantially complete. Thursday, January 8"', 2009 Page 3 of 4 at approximately the 8% shown on the plans, to carry surface water off the field. At this time, such grading is impractical, since the cold weather and clumpy soils made grading work extremely difficult. We will make a visit to inspect the field conditions in the spring, and make recommendations at that time. At this time, there is little chance of precipitation penetrating the fields. The trenches around the fields, designed to re -direct surface runoff from the fields, will also require re- visiting in the spring, when the ground surface is not frozen, and it is possible to establish a consistent grade. At this time, there is no surface runoff to be concerned with, and this work can wait to be completed. The owners have installed posts for fencing, but as of this writing, no fencing has been installed. Since no animals are currently in the area, and are unlikely to be present until spring, this task can wait. For the time being, it may be best to have the areas open for access by equipment to finish grading and complete the ditching. However, before any animals are turned loose in the field, the fences must be installed. Summary In conclusion, the work proposed under the rehabilitation permit has been completed in substantial compliance with the intent of the December 2"d letter, and the Garfield County permit. Items remaining may be safely delayed until spring. The owners will continue to monitor the conditions in both systems during the following months, as the new spaces come on-line. Any sign of flooding or failure in either system should be immediately reported to the County and to Gamba and Assoicates, Inc. The potential concerns include erosion and transport of sediment/contaminants to the river and contamination of the river from a failure of the wastewater treatment system. The wastewater treatment system for the project is two centralized primary treatment vaults with disposal through leachfield type systems. The wastewater facility was approved and is regulated by the Colorado Department of Public Health and Environment. The land use approval was granted by Garfield County on November 10, 2008 for up to 76 full service RV spaces (34 new spaces). The County approval requires compliance with floodplain regulations, CDPHE approval, and the Rifle Watershed District Ordinance. A Grading Permit is also required and Permit No. G-2008-71 was obtained for the project. The Grading Permit criteria include use of BMP's for erosion and sediment control. The proposed expansion activity is of a type and location that will have no negative impact on the City's waterworks or water supply provided the project construction follows the BMP's prescribed for - the -Grading Permit- and operation of -the wastewater- treatment -facility continues -to-meet CDPHE regulations.
