COUNTY OF GARFIELD ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the County Administration Building in Glenwood Springs on the 4th day of August , 2008, there were present: Tresi Houpt Commissioner Larry McCown Commissioner John Martin Commissioner Chairman Don K. DeFord County Attorney Ed Green County Manager Jean Alberico Clerk to the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 08- 94 A RESOLUTION CONCERNED WITH VACATING PORTIONS OF A PUBLIC ROAD RIGHT-OF-WAY OTHERWISE KNOWN AS PORTIONS OF COUNTY ROAD 118 AND ACCEPTANCE OF NEW PUBLIC ROAD RIGHT-OF-WAY WHEREAS, Garfield County is a legal and political subdivision of the State of Colorado for which the Board of County Commissioners ("BOCC") is authorized to act; and WHEREAS, the Board of County Commissioners has received a request to vacate a portion of a dedicated public road right-of- way, as such lies adjacent and across the property of the requesting party as set forth below; and WHEREAS, the public road right-of-way as set forth below is no longer needed as a public road right-of-way; and WHEREAS, the BOCC is entitled to vacate a public road right- of-way by resolution pursuant to the provisions of § 43-2- 303(1)(b), C.R.S., as amended; and WHEREAS, to the extent necessary, a duly noticed public hearing was conducted by the BOCC concerning the need and appropriateness of vacating said public road right-of-way under the provisions of § 43-2-303(2)(b), C.R.S., as amended and the provisions of Resolution 2003-7; and WHEREAS, the purpose of this proceeding is to consider the vacation of the portion of the dedicated road right-of-way of County Road 118, which is no longer required for public road purposes; and Commissioners of Garfield County, as follows: 1. The public hearing leading to the vacation of this roadway was the subject of necessary notice to landowners adjacent to the right-of-way and other concerned parties to the extent such notice was required by the provisions of § 43-2-303(2) (b), C.R.S., as 9 ■IIIKP'iROMif,1411ilWriltler i V*411111 Receptlon4: 753649 08/06/2008 10:19:43 RM Jean Alberico 2 of 9 Ree Fee40.00 Doc Fee:0.00 GARFIELD COUNTY CO amended, and Resolution 2003-7(IX)(8). 2. The public hearing was conducted at which testimony and evidence was presented concerning the vacation of portions of County Road 118. No testimony or evidence was presented objecting to said vacation. Exhibits were presented supporting the finding of proper notice and all interested parties, if any, were given an opportunity to attend, testify and present evidence. 3. That portion of the public road right-of-way of County Road 118 no longer needed for public road purposed and described in Exhibit A attached hereto should be and hereby shall be vacated effective in a manner consistent with the requirements of this Resolution and the provisions of Resolution 2003-7(IX) (F). 4. The vacation of a portion of County Road 118 is contemplated herein, shall vest title in the adjoining property owner on the effective date of this Resolution as determined under 2003-7(IX)(F). 5. The foregoing vacation, when effective, will notleave any property adjoining said public road right-of-way without an established public road connected said land with another established public road. 6. This vacation, when effective, will not leave any public land without access to a public road. 7. To the extent necessary, the public road right-of-way vacated pursuant to this Resolution shall contain a reservation for the continued use of all existing sewer, gas, water, ditch, canal, electric, telephone or other utility purposes. Neither the requesting party nor the County are aware of any such existing utility lines or similar appurtenances. 8. The foregoing vacation is in the best interest and for the health, safety and welfare of the general public. 9. The Board of County Commissioners hereby accepts as a new public road right-of-way for use as a turn -around, the property deeded through the quit -claim deed attached hereto as Exhibit B. The acceptance by this Resolution is limited to the descriptions contained therein.
