A RESOLUTION OF THE BOARD OF ADJUSTMENT OF GARFIELD COUNTY
APPROVING A VARIANCE FROM THE MINIMUM FRONT YARD SETBACK OF 25',
FOR A PROPERTY LOCATED AT 1254 COUNTY ROAD 127, A.K.A. THREE MILE
ROAD IN SECTION 28, T6S, R89W OF THE 6TH P.M., GARFIELD COUNTY
PARCEL NO# 2185-282-00-018
Recitals
A. David S. Dodson and Beth A. Williams made an application to the Board of Adjustment
of Garfield County, Colorado, (the `Board") requesting the Board grant a variance from the Unified
Land Use Resolution of 2008, as amended. Specifically the Lot Size and Setback Requirements
Table, Section §3-503. This section contains setback requirements for all zone districts, including
Residential Suburban which requires a twenty-five foot (25') setback from the front property line
when fronting on a local road.
B. David S. Dodson and Beth A. Williams are the owner(s) of real property as identified in a
Warranty Deed recorded at Reception No. 615366 in the Office of the Garfield County Clerk &
Recorder, more practically described as 1254 CR 127 (Three Mile Road) and encompassing an area
of2.2-acres.
C. The subject property is contained within the Residential Suburban Zone District and
issuance of the requested variance will not affect compliance with the other zone district standards
contained within the Unified Land Use Resolution of 2008, as amended (ULUR).
D. David S. Dodson and Beth A. Williams specifically requests the Board grant a variance
from §3-503 of the ULUR which requires a minimum front yard setback of twenty-five feet (25')
from the front property line, to five (5') as indicated on the site plan attached as Exhibit A.
E. Garfield County is a legal and political subdivision of the State of Colorado, for which the
Board of County Commissioners is authorized to act.
F. The Board of County Commissioners of Garfield County has appointed the Garfield
County Board of Adjustment.
H. The Board of Adjustment conducted a public hearing on April 26, 2010, upon the question
of whether the requested variance should be approved, denied, or whether any action should be taken
on this matter.

I. The Board on the basis of substantial competent evidence produced at the aforementioned
hearing, has made the following determinations of fact:
1. That proper posting and public notice were provided as required for the meeting before
the Board of Adjustment.
2. The meeting before the Board of Adjustment was extensive and complete, that all
pertinent facts, matters and issues were submitted and that all interested parties were
heard at that meeting.
3. That for the above stated and other reasons, the proposed Variance has been determined
to be in the best interest of the health, safety, morals, convenience, order, prosperity and
welfare of the citizens of Garfield County.
4. The application has met the standards and requirements for Variance pursuant to Article
4, Division 3 of the Garfield County Unified Land Use Resolution of 2008, as amended.
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment, Garfield County,
Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Variance from §3-503 Minimum Front Setback in the Residential Suburban Zone
District on the Dodson/Williams parcel shall be reduced to five feet (5') due to the existence
of special circumstances and existing conditions, including site topography and location of
Three Mile Creek, and is hereby approved subject to compliance with site plan attached as
Exhibit A.
