2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the
administration of the fee structure.

3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to he hilted to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision
plan.

SUBMITTAL REQUIREMENTS:
A. Sketch map: showing all improvements on the site, building sizes, locations, setbacks,
and access points.
B. Vicinity map: showing general geographic location.
C. Legal description of site - Copy of Deed of Ownership.
D. Practical description of site - including address.
E. Names and addresses of property owners adjacent to or within 200 ft. of the site
(available at the Assessor's Office).
F. Where applicable: description of domestic water source, sewage disposal and other utility
facilities.
G. Plans and specifications for the proposal.
H. Narrative explaining why the variance is being requested.
I. It should be demonstrated by the above information and statements that, "...where by
reason of exceptional narrowness, shallowness or shape of the specific piece of property
at the time of enactment of this Resolution, or by reason of exceptional topographic
condition of such piece of property, the strict application of any regulation enacted under
this resolution would result in peculiar and exceptional hardship upon the owner of such
property". (Section 9.05:03)
J. Subject to the above findings, the Board of Adjustment may authorize a variance
provided:
9.05.03 (1): That the variance granted is the minimum necessary to alleviate such
practical difficulties or undue hardships upon the owner of said property;
9.05.03 (2): That such relief may be granted without substantial detriment to the public
good and without substantially impairing the intent and purpose of the general plan or
this resolution;
9.05.03 (3): That the circumstances found to constitute a hardship were not caused by the
applicant, are not due to or the result of general conditions in the district and cannot be
practically corrected.
4C. A $250.00 fee must be submitted with the application.
PROCEDURAL REQUIREMENTS:
I. Submit applications to the Garfield County Planning Department no later than the last
Friday of the month in order to be included on the following month's agenda. Regular
meeting of the Zoning Board of Adjustment scheduled on the fourth Monday of each
month at 7:00 p.m..
2. You will receive, from the Planning Department, a "Public Notice Form(s)" indicating
the time and date of your hearing.
3. Notice by publication (of the public notice form), including the name of the applicant,
description of the subject lot, a description of the proposed variance and nature of the

hearing, and the date, time and place for the hearing shall be given once in a newspaper
of general circulation in that portion of the County in which the subject property is
located, at least thirty (30) but not more than sixty (60) days prior to the date of such
hearing, and proof of publication shall be presented at the hearing by the applicant.
(Section 9.05,04 (1)).
4. Notice by mail (of the public notice form), containing information as described under
item #3 above, shall be mailed to all owners of record as shown in the County Assessor's
Office of lots within two hundred feet (200') of the subject lot and to all owners of
mineral interest in the subject property at least thirty (30) but not more than sixty (60)
days prior to such hearing time by certified return -receipt mail, and receipts shall be
presented at the hearing by the applicant. (Section 9.05.04 (2)).

H. Narrative
The variance request for this application is for reduction of the rear yard setback from 25 feet to sixteen
feet. Due to the shallow dimension of the lot in the East/West direction; the location of the existing
dwelling on the lot; and the present plan configuration of the dwelling, possibilities for alternate locations
of additions to the common living area of the dwelling are not feasible. Also, due to the fact that the lot is
bounded on two sides by streets, the dwelling has two front yards and the West side of the property could
be considered a side yard. Additionally, other lots in the same P.U.D. have been granted variances for
reduction of rear yard setbacks.

addition will not come closer than 18 feet from the back property line_ Please also
obtain approvals from your neighbors.
This approval from the Architectural Committee is for the setback only, but
