5. Evaluation by Director/Staff Review. Upon determination of completeness, the
Director shall review the application for compliance with the approval standards set
forth in Section 4-301 C, Standards for Approval of Variance Requests. A staff report
shall be prepared pursuant to Section 4-103 E.

6. Review and Action by the Board of Adjustment. The final decision to approve,
approve with conditions or deny a request for a variance shall be made by the Board of
Adjustment at a public hearing.
a. Decision by Board. Following a public hearing conducted pursuant to Section 4-
103 G, Conduct of Public Hearing, the Board Adjustment shall approve, approve
with conditions or deny the application based upon compliance with the approval
standards set forth in Section 4-301 C, Standards for Approval of Variance
Requests.
(1) Approval of Application. If the application satisfies all of the applicable
standards, the application shall be approved. The application may be
approved with conditions determined necessary for compliance with
applicable standards.
(2) Denial of Application. If the application fails to satisfy any one of the
applicable standards, the application shall be denied.
7. Written Notice of Decision. The Director shall provide the applicant with a copy of the
Resolution approving, approving with conditions or denying the application within (30)
working days of the date of the decision.

2. OWNER understands and agrees that Garfield County Resolution No. 98-09, as
amended, establishes a fee schedule for each type of subdivision or land use review
applications, and the guidelines for the administration of the fee structure.
3. OWNER and COUNTY agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. OWNER agrees to make payment of the Base Fee,
established for the PROJECT, and to thereafter permit additional costs to be billed to
OWNER. OWNER agrees to make additional payments upon notification by the COUNTY
when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or
cost of consulting service determined necessary by the Board of County Commissioners
for the consideration of an application or additional COUNTY staff time or expense not
covered by the Base Fee. If actual recorded costs exceed the initial Base Fee, OWNER
shall pay additional billings to COUNTY to reimburse the COUNTY for the processing of
the PROJECT mentioned above. OWNER acknowledges that all billing shall be paid prior
to the final consideration by the COUNTY of any land use permit, zoning amendment, or
subdivision plan.

Location of Property
The property is located in Section 27 T5S R89W at the end of County Road 132 (Mitchell Creek
Road). The property is 1.184 acres with Mitchell Creek bisecting the western portion and a very
steep hillside dominating the eastern third of the property. The Southern portion of the
property is described as steep hillside with multiple retaining walls. The elevation gain between
on the Southern portion of the property at the bridge to the building envelop is 16 feet. (See
picture 4 in section 10).
History of Property
The original house was built in 1935 along the banks of Mitchell Creek. The property was
passed down through family ties to Ralph and Renae Besler. In 2001 Ralph and Renae Besler
filed for a building permit for a new house in the location of the original building. The permit
was approved, the old structure was removed, and the new house was built which included a
new septic system. The house was built with approximately a 20 foot setback from the water
and 15 foot setback from the Mitchell Creek bank. Please see tab 10 showing pictures of the
house demonstrating the location of the house and the proximity to the creek. A year later, in
2002, the Coal Seam Fire completely destroyed the house. Ralph and Renae immediately filed
for a building permit to rebuild the house. The permit was approved by the County but the
Forest Service recommended waiting for a period of 5 years to rebuild the house to insure that
all debris flow had stabilized. A house has not been rebuilt on the property at this time.
Mitchell Creek runs the length of the property with historic rock walls that line both sides of the
creek. (See picture 3 in section 10). Mrs. Besler whose family has owned the property since the
1930s, states that the creek has never come out of the existing creek bed. The structures that
were built on the banks of the creek have not experienced any flooding since they were built.
Purpose of the Application
The applicant desires to rebuild a house on the property to be utilized as a primary residence.
With the current setback of 35 feet from Mitchell Creek it would be very difficult if not
impossible to build a house on the property.
A. The special conditions that exist on the property are Mitchell Creek on the West side of
the property along with a steep hillside on the East side of the property (see attachment
B). The southern portion of the property is also steep as the road cross the creek and
approaches the old home site. In several areas the distance between Mitchell Creek and
the hillside is less than fifty foot with an average distance of the buildable area being 65
feet. As previously mentioned, the house would have been rebuilt but the owner taking
advice from the Forest Service waited to rebuild the house.
B. These conditions exist due to nature and are not a result of the applicant.
C. If the 35 foot setback is enforced the difficulties in rebuilding the house would not only
create undue hardship but would prevent the house from being rebuilt on any area of
the property. The two original houses were both built in locations that infringed on this
setback restriction.
D. The Variance is necessary for a house to be rebuilt. Granting this variance would allow
the owner to rebuild the house.
E. Since there has been in a existing house built within the setback for the last 74 years,
granting the variance will not be detrimental to the public health.
F. Granting the variance will not substantially impair the intent and purpose of the Land
Use Code.
Action Requested
The applicant desires to rebuild a house on the property to be utilized as a primary residence.
To accomplish this, the applicant requests that the 35 foot stream setback be reduced from 35
feet to 15 feet.

I. GENERAL PROJECT DESCRIPTION
1.184 acre parcel in Rural Zone District -want to construct a single-family home on the site but
the physical qualities of the site -steep slopes on east side of site and Mitchell Creek on west
side of site, does not leave adequate room to comply with 35' stream setback.
The site had a home on it -septic and spring (for potable water), however that home burned
down in the Coal Seem Fire in 2001 (?). The owner was told by the Forest Service to wait to re-
build so that vegetation could grow and provide erosion control on the steep slopes. Code
requires non-conforming structure to be rebuilt within 6 months of it being destroyed -
therefore Applicant seeks relief from the 35' stream setback.
Applicant must determine floodplain and if encroachment occurs, a floodplain permit will be
required.

1. Minimum Setback. A setl)ack of thirty-five (35) feet measured
horizontally from the typical and ordinary high water on each side of
a waterbody is required.
2. Structures Permitted In Setback. Irrigation and water diversion
facilities, flood control structures, culverts, bridges and other
reasonable and necessary structures requiring some disturbance
within this setback may be permitted.
3. Structures and Activity Prohibited in Buffer Zone. Unless
othe1wise permitted or approved, the following activities and
development shall be prohibited in the restrictive inner buffer zone
include:
a. Placement of material, including without limitation any soil,
sand, gravel, mineral, aggregate, organic material, or snow
plowed from roadways and parl<ing areas.
b. Construction, installation, or placement of any obstruction or
the erection of a building or structure.
c. Removal, excavation, or dredging of solid material, including
without limitation any soil, sand, gravel, mineral, aggregate,
or organic material.
d. Removal of any existing live vegetation or conducting any
activity which will cause any loss of vegetation, unless it
involves the approved removal of noxious weeds, non-native
species, dead or diseased trees.
e. Lowering of the water level or water table by any means,
including draining, ditching, trenching, impounding, pumping
or comparable means.
f. Disturbance of existing natural surface drainage
characteristics, sedimentation patterns, flow patterns, or
flood retention characteristics by any means including
without limitation grading and alteration of existing
topography. Measures taken to restore existing topography
to improve drainage, flow patterns and flood control must be
approved.

This letter is regarding the Individual Sewage Disposal System for the Besler Residence
located at the north end of Mitchell Creek Road. Our recommendations are based meetings
with the owner, Ralph Besler, our site visit and percolation testing.
The percolation testing was performed at a depth of approximately 18 inches in an area
southeasterly of the proposed residence. The percolation rate recommended for design was
17 minutes per inch. We recommend that a standard absorption bed be utilized, and that it
be placed parallel to and adjacent to the east side of the driveway.
We understand that this ISDS would serve a single family residence that currently has two
bedrooms, but the owner wishes to size the system for three bedrooms in case of future
expansion. Therefore, the estimated average wastewater flow would be 450 gallons per day.
The design flow, per regulation, is l.5 times the average, or 675 gallons per day.

The required standard absorption area (based on 17 minutes per inch) is 557 square feet.
Less 40% for using "Infiltrator" units in a bed would give 334 square feet. At 18. 75 square
feet per unit, 18 units would be required. The Owner should consider using traffic rated
Infiltrator units als.o, since there will possibly be some additional load transferred to them
from the adjacent retaining wall. The minimum size of septic tank required is 1000 gallon,
however, we recommend that a 1250 gallon tank be considered. If the tank is to be installed
in the driveway, it should be of traffic rated construction.
