A RESOLUTION OF THE BOARD OF ADJUSTMENT OF GARFIELD COUNTY
APPROVING AV ARIANCE FOR MINIMUM SETBACK, PROTECTION OF
WETLANDS AND WATERBODIES, FOR A PROPERTY LOCATED AT 1962 COUNTY
ROAD 132, A.K.A. MITCHELL CREEK ROAD IN SECTION 27, TSS, R89W OF THE
6rn P.M., GARFIELD COUNTY
PARCEL NO# 2119-273-00-013
Recitals
A. R alph E. & Renae D. Bes ler Revocable Trust made an app licati on to the Board of
Adjustment of Garfield County, Co lorado, (th e "Board") requesting the Board grant a variance from
Unified Land Use Resolution of2008, §7-203 A. I . Minimum Setback, Protecti on of Wetl ands and
Waterbodies.
B. The Ralph E. & Renae D. Besler Revocable Trust is the owner of real property as
identified in a Quitclaim Deed recorded at Reception No. 596423 in the Office of the Garfield
Co unty Clerk & Record er, more practically described as I 962 CR I32 (Mitchell Creek Road) and
encompassing an area of I. I 84 acres and as identified in .
C. The subject property is contained within the Rural Zo ne District and issuance of the
requested variance will not effect the r equiremen t for the parcel to comply with the zone district
standards contained within the Unified Land Use Resolution of 200 8 (ULUR).
D. The Ra lph E. & Renae D. Bes ler Revocable Trust specifically re quests the Board grant a
variance from §7-203 A. I. of the ULUR which requires a minimum setback of thirty-five feet (35 ')
from the typical and ordinary hi ghwater m ark on eac h sid e of a waterbody, to fifteen (15 ') as
indicated b y the building envelope id entified in attached Ex hi bit A .
E. Garfield County is a l egal and political sub divi si on of the State of Colorado , for whi ch the
Board of County Commi ssioners is authorize d to act.
F . The Board of Co unty Com m issioners of Garfie ld County has appointed the Garfield
Co unty Board of Adjustment.
H . The Board of Adjustment cond ucted a p ublic h earing on Augu st 3, 2009, up on the
question of whether the req ue sted variance sh ou ld be approved , denied , or whether any action should
be taken on this m atter.

I. Proper posting and public notice were provided as required for the meeting before the
Board of Adjustment.
2. The m eeting before the Board of Adjustment was extensive and complete, that all
pertinent facts, matters and issues were s ubmitted and that a ll interested parties were
heard at that mee ting .
3. The above stated and other reaso ns, the proposed Variance has been determined to be in
the best interest of the health, safety, morals, convenien ce, order, prosperity and welfare
of the citizens of Garfield County.
4. The application has m et the standards and requirements fo r Varian ce pursuant to Article
4, Division 3 of the Garfield County Unified Land Use Resolution of 2008.
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment, Garfield County,
Colorado, that:
A. The forgoing Rec itals are incorporated by this reference as part of the re so lution.
B. The Variance from §7 -2 03 A. l. Minimum Setback, Protection of Wet lands and Waterbodies
is hereby ap proved s ubject to compliance with the following conditions:
1. Construction of a si ngle family home on the parcel sha ll comply with the building
enve lop e restriction attached as Exhibit A and that all activities related to construction of
the single family home occur inside of the designated envelope.
