Request for Variance
Mara and Robert Meyers are requesting a one-time variance to the
building height restriction in the St. Finnbar Farm Subdivision.
This lot was purchased in August of 2005. A considerable amount
of architectural design work has been completed resulting in over
$8,000 in fees to date.
A soil test was commissioned by the local builder, and given the
high level of ground water, and the proximity to the Roaring Fork
River, it is deemed necessary to build the house on a 4 foot
concrete crawl space to mitigate any water problems. This allows
a proper drainage plan to be put in place and keep water away from
the house.
Currently, the highest mid -point of the roof gable is approximately
25 V2 feet tall. When we add the 4 feet to the base, this puts it at
nearly 30 feet high in the center gable. (please refer to architectural
plan).

•oject, it is not possible at this time to ascertain the full extent of the costs involved in processing the
plication. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
ereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
tyments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
insulting service determined necessary by the Board of County Commissioners for the consideration of an
plication or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs

in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday, the

IESOLUTION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR THE ST.
u1NBAR SUBDIVISION.
WHEREAS, St. Finnbar Land Company filed an application with the Board of County
Commissioners of Garfield County for approval of Preliminary Plan for the St. Finnbar Subdivision; and
WHEREAS, the Garfield County Planning Commission reviewed the St. Finnbar Preliminary Plan
application and recommended approval to the Board of County Commissioners; and
WHEREAS, based on the material submitted by the applicant, the recommendation of the Planning
Commission and the comments of the Garfield County Planning Department, this Board finds as follows:
1. That proper publication, public notice and posting was provided as required by law for the
hearings before the Planning Commission and Board of County Commissioners.
2. That the hearings before the Planning Commission and Board of' County Commissioners
were extensive and complete, that all pertinent facts, matters and issues were submitted and
that all interested parties were heard at that hearings.
3. That the Garfield County Planning Commission recommended approval of the Preliminary
Plan.

4. That the proposed subdivision of land is in compliance with the recommendations set forth
in the Comprehensive Plan for the unincorporated area of the County.
5. That all data, surveys, analyses, studies, plans and designs as required by the State of
Colorado and Garfield County have been submitted, reviewed, and found to meet all sound
planning and engineering requirements of the Garfield County Subdivision Regulations.
6. That the proposed subdivision of land conforms to the Garfield County Zoning Resolution.
7. That for the above -stated and other reasons, the proposed subdivision is in the best interest
of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfield County.
NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of St. Finnbar Subdivision for
the unincorporated area of Garfield County described in the application, be approved with the following
conditions:
1. All representations made by the applicant at the public hearing and in the Application shall
be considered conditions of approval, unless specified otherwise by the Board including, but
not limited to, the following items listed below.
2. The Homeowner's Association shall be incorporated in accordance with Colorado Revised
Statute requirements.
3. The applicant shall prepare and submit a Subdivision Improvements Agreement addressing
all on-site improvements, prior to the submittal of a final plat.
4. The applicants shall submit improvement plans for all roads, bridges, utilities, fire protection,
improvements signage and drainage structures prior to the submittal of the final plat. That
all roadways shall be constructed in accordance with the design standards in effect at the time
of submittal of the Final Plat, except for the variances approved by the Board
5. That the applicant shall pay the appropriate School Site Acquisition Fees prior to the
approval of the Final Plat.
6. Prior to the approval of the Preliminary Plan, the Applicant shall submit documentation that
would allow the State Department of Water Resources to recommend approval of the
project's water supply.
7. That the building envelopes be in an additional 10', to resolve the potential conflicts with the
floodplains designations.
8. That the fisherman's easement be made a public easement very clearly in the covenants and
on the plat and consistent with the Division of Wildlife comments.

9. That a favorable response be received from the Carbondale and Rural Fire Protection
District.
10. That accessory dwellings subject to the standards in the Zoning Resolution, be approved as
a part of the subdivision approval for the lots at least four (4) acres in size.
11. That the applicants shall prepare and submit protective covenants, articles of incorporation
and other Homeowner's Association documents including by-laws will be submitted for
review by the County Attorney prior to the approval of the Final Plat.
12. All mitigation proposed by the Division of Wildlife contained in their letter of July 6, 1990
and September 24, 1991 shall be considered conditions of approval . All grazing is limited
to historic hay fields and individual catch pens will be limited to 7500 sq. ft..
13. That the applicant shall submit applicable School Site Acquisition Fees for the subdivision,
prior to or at the time of approval of the final plat.
14. That the following plat notes shall be included on the final plat:
"Prior to the issuance of a building permit, each lot will be staked and certified by a R.L.S.
:verifying building location within approved envelope."
"Portions of subdivision are in areas defined by FEMA as regulated floodplain. Minor
channel shifting has occurred in the past, and will likely continue in the future. These shifts
can occur in events less than the theoretical 100 -year flood event."
"The minimum defensible space distance shall be 30 feet on level terrain, plus appropriate
modification to recognize the increased rate of fire spread at sloped sites. The methodology
described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural
Homeowners," (Colorado State Forest Service) shall be used to determine defensible space
requirements for the required defensible space within building envelopes in areas exceeding
five (5) percent grade."
"The individual lot owners shall be responsible for the control of noxious weeds."

II. PROCEDURAL REQUIREMENTS
(The following steps outline how the variance application review process works in Garfield County.)
1. Submit this completed application form (pages 1-3), base fee, and all submittal
requirements to the Garfield County Planning Department. It will be received and given to a
Staff Planner who will review the application for technical compliance.
2. Once the application is deemed is technically complete, the Staff Planner will send you a
letter indicating the application is complete and will request additional copies for the board
to review. In addition, Staff will also send you a "Public Notice Form(s)" indicating the time
and date of your hearing before the Board of Adjustment. Prior to the public hearing, Staff
will provide you with a Staff Memorandum regarding your requested variance
3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested variance and the public hearing. If proper notice has not occurred, the public
hearing will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed variance and nature of the hearing, and the date,
time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.
b. Notice by mail, containing information as described under paragraph (1) above,
shall be mailed to all owners of record as shown in the County Assessor's Office of
lots within two hundred feet (200') of the subject lot and to all owners of mineral
interest in the subject property at least thirty (30) but not more than sixty (60) days
prior to such hearing time by certified return receipt mail, and receipts shall be
presented at the hearing by the applicant.
c. The site shall be posted such that the notice is clearly and conspicuously visible
from a public right-of-way, with notice signs provided by the Planning Department.
The posting must take place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applicant to post the
notice, and ensure that it remains posted until and during the date of the hearing.
4. The Applicant is required to appear before the Board of Adjustment at the time and date of
the public hearing at which time the Board will consider the variance request. In addition,
the Applicant shall provide proof at the hearing that proper notice was provided.
5. Once the Board makes a decision regarding the variance request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board.
