PROCEDURAL REQUIREMENTS (The following steps outline how the variance application review process works in Garfield County.) 1. Submit this completed application form (pages 1-3), base fee, and all submittal requirements to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical compliance. 2. Once the application is deemed is technically complete, the Staff Planner will send you a letter indicating the application is complete and will request additional copies for the board to review. In addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of Adjustment. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested variance. 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested variance and the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed variance and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described under paragraph (1) above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 4. The Applicant is required to appear before the Board of Adjustment at the time and date of the public hearing at which time the Board will consider the variance request. In addition, the Applicant shall provide proof at the hearing that proper notice was provided. 5. Once the Board makes a decision regarding the variance request, Staff will provide the Applicant with a signed resolution memorializing the action taken by the Board. APPLICANT has submitted to COUNTY an application for (hereinafter, THE PROJECT). 2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended, establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the administration of the fee structure. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional payments upon notification by the COUNTY when they are necessary as costs are incurred. 4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board of County Commissioners for the consideration of an application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY for the processing of the PROJECT mentioned above. Although the site is over 2 acres, the distance from the high water line of the creek to the toe of an 80% slope is only 60'. It would be expensive, but more importantly unwise, to make any significant cuts into this slope, especially in light of the fact that its vegetative cover is still recovering from the Coal Seam Fire. The 30' remaining after deducting a 30' setback just isn't wide enough to accommodate a floor plan that works. 1.) This is the minimum variance necessary, as the house as proposed would still be about 25' from the creek at the closest point. 2.) Such relief may be granted without detriment to the public good and without substantially impairing the intent of the setback regulation, as the house would still be well above the 100 year flood plain of the creek (see letter from Michael Erion of Resource Engineering). 3.) The circumstances of the hardship were not caused by the applicant, and are shared only by other people who lost houses on the creek to the fire. The home which was lost to the fire was just barely 30' from the creek, and was able to fit on the site because it had a smaller footprint than the proposed house, because it was two stories. The proposed 3 -bedroom house is not huge (approximately 2400 square feet), and it is not unreasonable for a retired couple to desire a one level home, when they hope to be in it for many years to come. II. The bridge which accesses the Rachesky property and the Rader property to the north used to be on this property. Years ago it was necessary for the Raders to own the bridge, so the northeast corner of what is now the Rachesky property was deeded to the Raders, in exchange for a triangle of land to the south. The zoning code measures the front setback from this new property line, which is not really appropriate in this case. 1.) The variance is the minimum necessary; the corner of the house closest to the new front lot line would still be more than 15' away. 2.) Such relief may be granted without detriment to the public good and without substantially impairing the intent of the setback regulation because the house would still be almost 60' back from Mitchell Creek Road. The corner of the house closest to the shared driveway would be hidden by an existing rock wall. The garage doors would be set back well over 25', so there is not a safety issue of vehicles backing out right into a roadway. 3.) (RESOURCE) has reviewed the technical aspects related to the Garfield County regulations regarding a 30 foot set back from the mean high water line of Mitchell Creek. Our review included a field investigation on July 29, 2003, review of the proposed site plan for reconstruction of the bed and breakfast structure, and review of the FEMA flood insurance rate map and flood insurance study for Mitchell Creek, both dated January 3, 1986. The property is located at 1686 Mitchell Creek Road. The structure on the property burned in the 2002 Mitchell Creek fire and it is proposed to build a new structure on the site. Our review is summarized below. SUMMARY Based on our review the proposed structure, which has a minimum setback of approximately 25 feet from Mitchell Creek, will have no impact on the Mitchell Creek flood plain, riparian vegetation, and wetland vegetation. The proposed structure is located on an existing disturbed bench 4 to 8 feet above the 100 year flood plain elevation. The proposed structure will generally overlay the original structure, sidewalks, patios, etc. and will not impact riparian vegetation or wetlands. Therefore, from a technical perspective, we believe that the proposed variance from the 30 foot setback will not result in impacts to the environment and that the proposed project meets the intent of the 30 foot setback (i.e. no impact to flood plain, riparian habitat, wetlands, etc. to provide a protected greenbelt area).
