At a regular meeting of the Board of Adjustment for Garfield County, Colorado, held in the
Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday, the 22nd day
of October, 2001, there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. BOA 2001-1 .
A RESOLUTION CONCERNED WITH THE APPROVAL OF A VARIANCE APPLICATION FORTIS
ROAN CLIFF CORPORATION AND RICHARD L. AND GLADYS M. WITT, LOTS 8 & 9, BLOCK 2,
THE FAIRWAYS, PHASE I OF THE BATTLEMENT MESA PUD
WHEREAS, the Board of Adjustment of Garfield County, Colorado, has received application from
Roan Cliff Corporation and Richard L. and Gladys M. Witt concerned with a variance request to allow for the
encroachment of two dwelling units into the rear yard setback for lots 8 and 9,Block 2, The Fairways, Phase I
of the Battlement Mesa PUD;
WHEREAS, the Board held a public hearing on the 22nd day of October, 2001 upon the question of
whether the above-described variance should be granted or denied, at which hearing the public and interested
persons were given the opportunity to express their opinions regarding the approval or denial of said
variance; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:
1. That proper publication and public notice was provided as required by law for the hearing
before the Board of Adjustment.
2. That the application for variance was found to be consistent with the requirements and
standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended.

3. That the variance requested is the minimum necessary to alleviate such practical difficulties
on the property owner.
4. The hearing before the Board of Adjustment was extensive and complete, that all pertinent
facts, matters and issues were submitted and that all interested parties were heard at that
hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of Garfield County,
Colorado, that the variance request to allow for the encroachment of dwelling units into the rear yard setback
of 10.2 ft. for Lot 8 and 9.5 ft. for Lot 9, The Fairways, Phase I of the Battlement Mesa PUD, be and hereby
is approved.
