Staff will request additional copies V once the Special Use Permit application has been deemed technically complete. II. PROCEDURAL REQUIREMENTS (The following steps outline how the Special Use Permit Application review process works in Garfield County.) 1. Submit this completed application form, base fee, and all supplemental information to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical completeness. 2. Once the application is deemed technically complete, the Staff Planner will send you a letter indicating the application is complete. In addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Special Use. (If Staff determines you application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested Special Use and the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed special use and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described under paragraph (1) above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 4. The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will consider the request. In addition, the Applicant shall provide proof, at the hearing, that proper notice was provided. 5. Once the Board makes a decision regarding the Special Use request, Staff will provide the Applicant with a signed resolution memorializing the action taken by the Board. Following the Board's approval, this office will issue the Special Use Permit to the applicant. If the Board's approval includes specific conditions of approval to be met, this office will not issue the Official Special Use Permit certificate until the applicant has satisfied all conditions of approval. Screened Rooftop CMRS Facility - an unstaffed wireless facility consisting of antennas, equipment cabinets, and related equipment integrated into the design of the existing upholstery shop. Request and Justification Verizon Wireless phone customers have complained of dropped phone calls or a lack of adequate service along Highway 82 in both directions as well as throughout much of the southern area of Glenwood Springs. Our objective is to provide the traveling public, residents, visitors, and business owners of Glenwood Springs and Garfield County as well as the surrounding areas with seamless phone coverage. In order to ensure adequate coverage in this area, Verizon Wireless is proposing the installation of a new screened roofto wireless telecommunicatio s facility along Highway 82 on the south side of Glenwood prings. This new facility will serve to fill a large gap in coverage and off-load the high volumes of call traffic in this area. By providing this coverage, we would also be complying with statutory requirements as mandated by the FCC for both coverage and E-911 compliance. Coverage Objective The purpose for this application and need for a new CMRS facility in this area is due in part to two major factors. The first is that Verizon Wireless has poor service along Highway 82 at the south end of Glenwood Springs (gap in coverage). The second is that the amount of call traffic in this area has been increasing significantly over the past couple of years due in part to expanding development and increasing amount of traffic traveling through this area. Verizon Wireless 8350 Crescent Parkway, Suite 200 Greenwood Village, CO 80111 being placed while in this area are being blocked and the existing sites Verizon Wireless has in this area (north Glenwood Springs & Red Canyon) to provide service are at their limits. Unfortunately due to technological limitations, these existing sites cannot be modified any further to accommodate this high level of call traffic warranting a new site to be constructed. Further, the problem is compounded with the diverse topography. The proposed site will intern reduce/eliminate the number of dropped calls currently experienced by the residents, visitors, business owners, and the traveling public along Highway 82. The gap in coverage (or area of weak signal) extends from approximately 23rd Street to the north and just past Red Canyon Road to the south where Verizon Wireless has existing sites. This new site at the proposed height will fill this coverage gap with just one new facility. Given that our PCS digital technology operates at extremely low power, it is critical that the optimal site location be found. In order to provide our customers with good phone coverage while they are in this "gap" or in areas where the number of calls is exceeding that facilities' limit, we need to place a new wireless telecommunications facility at the subject property. Facility Siting As noted above, this site has been designed in response to the concerns of a gap in service as a result of high call traffic as well as poor service in this area. It is always the policy of Verizon Wireless to seek out collocation opportunities prior to settling on a new freestanding facility. Not only are they generally cheaper facilities to build versus new freestanding facilities, but there are typically zoning incentives for collocated sites. Verizon Wireless also tries to optimize its existing sites in an area to get better coverage prior to settling on constructing a new site. However in this case, optimizing the surrounding sites did not solve the coverage problem. In this case, Verizon Wireless was unable to identify any existing structure suitable for collocation. An existing commercial building (Colorado West Upholstery) was identified as the primary site location for the new facility given the sites location with respect to the coverage area and limited number of physical obstructions. The building is at sufficient height that the antennas can be mounted to the roof without a need for any additional height extension. Further, by utilizing an existing structure for collocation, the proposed site will blend in with the architecture of the building with the antennas screened. Further, the surrounding mature trees and topography will help reduce the visibility of the site as the attached photo simulation demonstrates. The Verizon Wireless system works similar to a puzzle in that each CMRS facility must fit into the system exactly. This requires each site to be in the optimal location and be at the optimal height. This means constructing a site that is not too high otherwise interference with other sites will most likely occur and if too low, the site will not meet its coverage objective and additional sites would be required. At the above referenced location, the proposed facility will be able to provide adequate coverage throughout much of the surrounding area as well as provide the required coverage needed with only one new facility. Facility Design & Details Thus, Verizon Wireless is proposing the construction and operation of an unstaffed screened rooftop wireless telecommunication facility at the above location. The proposed installation consists of mounting a maximum of 12 panel antennas to the rooftop of the building. All antennas shall be fully screened from view and the screening around the antennas shall be painted to match the building giving the appearance they are architectural elements or typical rooftop mechanical equipment screening (penthouses). These new screen walls shall not stick up above the existing roofline more than 5 feet 2 inches. Therefore the ground based equipment will be fully screened from view. No landscaping has been proposed at this time due to the fact that the site will be fully screened from view by either the antennas rooftop screen wall or the building itself hiding the equipment. No part of the facility will be illuminated whatsoever. Further, there is no need for any signage other than the required FCC safety signage. Given the nature of the proposed design, this site will easily accommodate collocation by other carriers. The proposed building mounted design will help minimize the amount of visual impact resulting from a need to provide service to this area of Garfield County. Compliance with the Garfield County Zoning Resolution SETION 5.00 — SUPPLEMENTARY REGULATIONS 5.03 CONDITIONAL AND SPECIAL USES As listed under the Zone District Regulations, conditional and special uses shall conform to all requirements listed thereunder and elsewhere in this Resolution plus the following requirements: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use; (A97- 60) All necessary utilities required for the proposed wireless telecommunications facility are already in place and of sufficient capacity to serve our needs. The proposed site does not require any water or sanitation services. Therefore this requirement has been met. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safer convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; The proposed use does not require any additional street improvements to accommodate traffic. Wireless telecommunication facilities are not staffed and only require periodic visits for routine maintenance and service. Therefore this requirement has been met. (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas access points lighting and signs in such a manner as to protect established neighborhood character; As stated above, the proposed site shall utilize several design elements to screen the facility from view and effectively blend the site in with its built surroundings. Such design elements include the use of screen wall painted to match building to screen antennas and placement of the equipment cabinets inside the existing building. Through the use of these design elements, the established neighborhood character shall be protected while a valuable service is provided to this area of the County. 5.03.13 Broadcasting Studio and/or Communication Facility: Such broadcasting studios and/or communication facility shall be approved by the Federal Communication Commission and the Federal Aviation Administration, where appropriate. (A. 84-78;97-60) In addition, the following standards will be used in the review application for a communication facility: 1. All facilities shall comply with the radio frequency emission requirements of the Federal Communications Commission and any facility in compliance cannot be denied. All of Verizon Wireless's sites are regulated by the FCC regarding emissions. We are rewired to periodically monitor our site for emission levels and report those levels to the FCC. Therefore, we will ensure this site meets this requirement. The co -location of telecommunication facilities on one site is encouraged and the denial of a landowner/lessor of the co -location of a site shall be based on technical reasons, not on competitive interests. It is the County's policy to minimize the number of communication facilities by the encouragement of co -locating such facilities. There are no existing freestanding telecommunication facility in this area that will meet our needs. Therefore we were able to identify and design a site that utilized an existing structure. Therefore, we have met this requirement and will not prevent another carrier from collocating on this building's rooftop as well. 3. A freestanding telecommunication facility, including antennas, shall not exceed the maximum structure height in the applicable zone district unless an exception is approved by the Board based on the applicant demonstrating the following: (A97-60) (a) Use of existing land forms, vegetation and structures to aid in screening the facility from view or blending in with the surrounding built natural environment. Verizon Wireless is not proposing a freestanding facility. However the proposed site will still utilize the existing land forms to the greatest extent possible along with the built structures on the property to hide the site. Therefore this requirement has been met. (b) Design, materials and colors of antennas and their support structures, shall be compatible with the surrounding environment, and monopole support structures shall taper from the base to the tip. Theproposed design shall be compatible with the surrounding environment with respect to design, materials, and colors. Therefore this requirement has been met. c) It is consistent with existing communication facilities on the same site. Currently there are no other exiting communication facilities on the same site. Summary Compatibility with the site and surrounding area will be ensured with this proposed collocated and screened design which will at the same time eliminate a need for a new freestanding facility in this area. It is the policy of Verizon Wireless to always consider collocation or building mounted designs first and such a design was possible and therefore eliminated the need for a new freestanding facility. The proposed design would also permit additional collocation on the building's rooftop if deemed appropriate by the County. There are numerous Verizon Wireless subscribers living, working, and traveling through this area who depend on adequate wireless coverage not only for personal use but also for businesses to keep in contact with their employees and customers. Ensuring adequate coverage in residential and rural areas is also becoming a significant priority for many carriers as more and more people are using their wireless phones as their primary means for communication and will be achieved with this proposed facility. This is further evidenced with the growing trend of residents discontinuing their land line based telephone service for wireless service and will continue to become more of a concern in residential areas now that Local Number Portability (LNP) is in place. There is also a significant safety factor involved in having this service in this area especially for E-911 capabilities in both the urban and rural areas. Request and Justification Verizon Wireless phone customers have complained of dropped phone calls or a lack of adequate service along Highway 82 in both directions as well as throughout much of the southern area of Glenwood Springs. Our objective is to provide the traveling public, residents, visitors, and business owners of Glenwood Springs and Garfield County as well as the surrounding areas with seamless phone coverage. In order to ensure adequate coverage in this area, Verizon Wireless is proposing the installation of a new screened rooftop wireless telecommunications facility along Highway 82 on the south side of Glenwood Springs. This new facility will serve to fill a large gap in coverage and off-load the high volumes of call traffic in this area. By providing this coverage, we would also be complying with statutory requirements as mandated by the FCC for both coverage and E-911 compliance. Coverage Ohjectiv_e The purpose for this application and need for a new CMRS facility in this area is due in part to two major factors. The first is that Verizon Wireless has poor service along Highway 82 at the south end of Glenwood Springs (gap in coverage). The second is that the amount of call traffic in this area has been increasing significantly over the last couple of years due in part to expanding development and increasing amount of traffic traveling throw.;, i this area. Unfortunately due to technological limitations, these existing sites cannot be modified any further to accommodate this high level of call traffic warranting a new site to be constructed. Further, the problem is compounded with the diverse topography. The proposed site will intern reduce/eliminate the number of dropped calls currently experienced by the residents, visitors, business owners, and the traveling public along Highway 82. The gap in coverage (or area of weak signal) extends from approximately 23rd Street to the north and just past Red Canyon Road to the south where Verizon Wireless has existing sites. This new site at the proposed height will fill this coverage gap with just one new facility. Given that our PCS digital technology operates at extremely low power, it is critical that the optimal site location be found. In order to provide our customers with good phone coverage while they are in this "gap" or in areas where the number of calls is exceeding that facilities' limit, we need to place a new wireless telecommunications facility at the subject property. Facility Siting As noted above, this site has been designed in response to the concerns of a gap in service as a result of high call traffic as well as poor service in this area. It is always the policy of Verizon Wireless to seek out collocation opportunities prior to settling on a new freestanding facility. Not only are they generally cheaper facilities ` build versus new freestanding facilities, but there are typically zoning incentives for collocated sites. Verizon Wireless also tries to optimize its existing sites in an area to get better coverage prior to settling on constructing a new site. However in this case, optimizing the surrounding sites did not solve the coverage problem. In this case, Verizon Wireless was unable to identify any existing structure suitable for collocation. An existing commercial building (Colorado West Upholstery) was identified as the primary site location for the new facility given the sites location with respect to the coverage area and limited number of physical obstructions. The building is at sufficient height that the antennas can be mounted to the roof without a need for any additional height extension. Further, by utilizing an existing structure for collocation, the proposed site will blend in with the architecture of the building with the antennas screened. Further, the surrounding mature trees and topography will help reduce the visibility of the site as the attached photo simulation demonstrates. The Verizon Wireless system works similar to a puzzle in that each CMRS facility must fit into the system exactly. This requires each site to be in the optimal location and be at the optimal height. This means constructing a site that is not too high otherwise interference with other sites will most likely occur and if too low, the site will not meet its coverage objective and additional sites would be required. At the above referenced location, the proposed facility will be able to provide adequate coverage throughout much of the surrounding area as well as provide the required coverage needed with only one new facility. Facility Design & Details Thus, Verizon Wireless is proposing the construction and operation of an unstaffed screened rooftop wireless telecommunication facility at the above location. The proposed installation consists of mounting a maximum of 12 panel antennas to the rooftop of the building. All antennas shall be fully screened from view and the screening around the antennas shall be painted to match the building giving the appearance they are architectL -I elements or typical rooftop mechanical equipment screening (penthouses). Therefore the ground based equipment will be fully screened from view. No landscaping has been proposed at this time due to the fact that the site will be fully screened from view by either the antennas rooftop screen wall or the building itself hiding the equipment. No part of the facility will be illuminated whatsoever. Further, there is no need for any signage other than the required FCC safety signage. Given the nature of the proposed design, this site will easily accommodate collocation by other carriers. The proposed building mounted design will help minimize the amount of visual impact resulting from a need to provide service to this area of Garfield County. Compliance with the Garfield County Zoning Resolution SETION 5.00 - SUPPLEMENTARY REGULATIONS 5.03 CONDITIONAL AND SPECIAL USES As listed under the Zone District Regulations, conditional and special uses shall conform to all requirements listed thereunder and elsewhere in this Resolution plus the following requirements: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use; (A97- 60) All necessary utilities required for the proposed wireless telecommunications facility are already in place and of sufficient capacity to serve our needs. The proposed site does not require any water or sanitation services. Therefore this requirement has been met. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; The proposed use does not require any additional street improvements to accommodate traffic. Wireless telecommunication facilities are not staffedandonly require periodic visits for routine maintenance and service. Therefore this requirement has been met. (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas access points lighting and signs in such a manner as to protect established neighborhood character; As stated above, the proposed site shall utilize several design elements to screen the facility from view and effectively blend the site in with its built surroundings. Such design elements include the use of screen wall painted to match building to screen antennas and placement of the equipment cabinets inside the existing building. Through the use of these design elements, the established neighborhood character shall be protected while a valuable service is provided to this area of the County. 5.03.13 Broadcasting Studio and/or Communication Facility: Such broadcasting studios and/or communication facility shall be approved by the Federal Communication Commission and the Federal Aviation Administration, where appropriate. (A. 84-78;97-60) In addition, the following standards will be used in the review application for a communication facility: 1. All facilities shall comply with the radio frequency emission requirements of the Federal Communications Commission and any facility in compliance cannot be denied. All of Verizon Wireless's sites are regulated by the FCC regarding emissions. We aro required to periodically monitor our site for emission levels and report those levels to the FCC. Therefore, we will ensure this site meets this requirement. The co -location of telecommunication facilities on one site is encouraged and the denial of a landowner/lessor of the co -location of a site shall be based on technical reasons, not on competitive interests. It is the County's policy to minimize the number of communication facilities by the encouragement of co -locating such facilities. There are no existing freestanding telecommunication facility in this area that will meet our needs. Therefore we were able to identify and design a site that utilized an existing structure. Therefore, we have met this requirement and will not prevent another carrier from collocating on this building's rooftop as well. 3. A freestanding telecommunication facility, including antennas, shall not exceed the maximum structure height in the applicable zone district unless an exception is approved by the Board based on the applicant demonstrating the following: (A97-60) (a) Use of existing land forms, vegetation and structures to aid in screening the facility from view or blending in with the surrounding built natural environment. Verizon Wireless is not proposing a freestanding facility. However the proposed site will still utilize the existing land forms to the greatest extent possible along with the built structures on the property to hide the site. Therefore this requirement has been met. (b) Design, materials and colors of antennas and their support structures, shall be compatible with the surrounding environment, and monopole support structures shall taper from the base to the tip. Theroposed design shall be compatible with the surrounding environment with respecttodesign, materials, and colors. Therefore this requirement has been met. (c) It is consistent with existing communication facilities on the same site. Currently there are no other exiting communication facilities on the same site. Summar Compatibility with the site and surrounding area will be ensured with this proposed collocated and screened design which will at the same time eliminate a need for a new freestanding facility in this area. It is the policy of Verizon Wireless to always consider collocation or building mounted designs first and such a design was possible and therefore eliminated the need for a new freestanding facility. The proposed design would also permit additional collocation on the building's rooftop if deemed appropriate by the County. There are numerous Verizon Wireless subscribers living, working, and traveling through this area who depend on adequate wireless coverage not only for personal use but also for businesses to keep in contact with their employees and customers. Ensuring adequate coverage in residential and rural areas is also becoming a significant priority for many carriers as more and more people are using their wireless phones as their primary means for communication and will be achieved with this proposed facility. This is further evidenced with the growing trend of residents discontinuing their land line based telephone service for wireless service and will continue to become more of a concern in residential areas now that Local Number Portability (LNP) is in place. There is also a significant safety factor involved in having this service in this area especially for E-911 capabilities in both the urban and rural areas.
