APPLICATION SUBMITTAL REQUIREMENTS As a minimum, specifically respond to all the following items below and attach any additional information to be submitted with this application: 1. Please submit, in narrative form, the nature and character of the Special Use requested. Submit plans and supporting information (i.e. letters from responsible agencies). Include specifications for the proposed use including, but not limited to, the hours of operation, the number and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and the size and location of any existing and/or proposed structures that will be used in conjunction with the proposed use, and provisions for electric power service and any other proposed utility improvements. Be specific. 2. If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan to demonstrate that you have legal and adequate water for the proposed use. 3. Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all existing and proposed structures on the property, and the County or State roadways within one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. 4. Submit a vicinity map showing slope I topography of your property, for which a U .S.G.S. 1 :24,000 scale quadrangle map will suffice. 5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing all the subject property and public and private landowners adjacent to your property (which should be delineated). In addition, submit a list of all property owners, public and private landowners and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the Assessor's Office. We will also need the names (if applicable) of all mineral right owners of the subject property. (That information can be found in your title policy under Exceptions to Title). 6. Submit a copy of the deed and a legal description of the subject property. 7. If you are acting as an agent for the property owner, you must attach an acknowledgement from the property owner that you may act in his/her behalf. 8. Submit an statement that specifically responds to each of the following criteria from Section 5.03 of the Zoning Regulations: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery ( c ( of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; 9. Depending on the type of Special Use Permit requested, you may need to respond to additional review standards in the Garfield County Zoning Resolution Section 5.00 [Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 & 5.03.08], Accessory Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific sections of the Zoning Resolution which can be located on the Garfield County web site at http://www.garfield-countv.com/building and planninq/index.htm. or information can be obtained from this office 10. A $400.00 Base Fee: Applicant shall sign the UAgreement for Payment" form and provide the fee with the application. 11. Submit 2 copies of this completed application form and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the Special Use Permit application has been deemed technically complete. II. PROCEDURAL REQUIREMENTS (The following steps outline how the Special Use Permit Application review process works in Garfield County.) 1. Submit this completed application form, base fee, and all supplemental information to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical completeness. 2. Once the application is deemed technically complete, the Staff Planner will send you a letter indicating the application is complete. In addition, Staff will also send you a "Public Notice Form(sr indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Special Use. (If Staff determines you application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested Special Use and the public hearing . If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed special use and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described in the paragraph above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. ( c (_ c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 4. The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will consider the request. In addition, the Applicant shall provide proof, at the hearing, that proper notice was provided. 5. Once the Board makes a decision regarding the Special Use request, Staff will provide the Applicant with a signed resolution memorializing the action taken by the Board. Following the Board's approval, this office will issue the Special Use Permit to the applicant. If the Board's approval includes specific conditions of approval to be met, this office will not issue the Official Special Use Permit certificate until the applicant has satisfied all conditions of approval. The Special Use Permit approval is not finalized until this office has issued the Official Special Use Permit certificate signed by the Chairman of the Board of County Commissioners . ... Last Revised: 02/2006 c GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT FEE SCHEDULE Garfield County, pursuant to Board of County Commissioners ("Board") Resolution No. 98-09, has established a fee structure ("Base Fee") for the processing of each type of subdivision and land use applications. The Base Fee is an estimate of the average number of hours of staff time devoted to an application, multiplied by an hourly rate for the personnel involved. The Board recognized that the subdivision and land use application processing time will vary and that an applicant should pay for the total cost of the review which may require additional billing. Hourly rates based on the hourly salary, and fringe benefits costs of the respective positions combined with an hourly overhead cost for the office will be used to establish the actual cost of County staff time devoted to the review of a particular project. ( Actual staff time spent will be charged against the Base Fee. After the Base Fee has been expended, the applicant will be billed based on actual staff hours accrued. Any billing shall be paid in full prior to final consideration of any land use permit, zoning amendment or subdivision plan. If an applicant has previously failed to pay application fees as required, no new or additional applications will be accepted for processing until the outstanding fees are paid. ( Checks, including the appropriate Base Fee set forth below, must be submitted with each land use application, and made payable to the Garfield County Treasurer. Applications will not be accepted without the required application fee. Base Fees are non-refundable in full, unless a written request for withdraw from the applicant is submitted prior the initial review of the application materials. Applications must include an Agreement for Payment Form ("Agreement") set forth below. The Agreement establishes the applicant as being responsible for payment of all costs associated with processing the application. The Agreement must be signed by the party responsible for payment and submitted with the application in order for it to be accepted. The complete fee schedule for subdivision and land use applications is attached. ( c ( GARFIED COUNTY BUILDING AND PLANNING DEPARTMENT BASE FEES The following Base Fees shall be received by the County at the time of submittal of any procedural application to which such fees relate. Such Base Fees shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board for the consideration of any application or additional County staff time or expense not covered by the Base Fee, which have not otherwise been paid by the applicant to the County prior to final action upon the application tendered to the County. All applications shall be submitted with a signed Agreement for Payment form set forth below. 2. County staff shall keep accurate record of actual time required for the processing of each land use application, zoning amendment, or subdivision application. Any additional billing will occur commensurate with the additional costs incurred by the County as a result of having to take more time that that covered by the base fee. 3. Any billings shall be paid prior to final consideration of any land use permit, zoning amendment, or subdivision plan. All additional costs shall be paid to the execution of the written resolution confirming action on the application. 4. Final Plats, Amended or Corrected Plats, Exemption Plats or Permits will not be recorded or issued until all fees have been paid. 5. In the event that the Board determines that special expertise is needed to assist them in the review of a land use permit, zoning amendment, or subdivision application, such costs will be borne by the applicant and paid prior to the final consideration of the application. All additional costs shall be paid prior to the execution of the written resolution confirming action on the application. 6. If an application involves multiple reviews, the Applicant shall be charged the highest Base Fee listed above. 7. Types of"Procedures" not listed in the above chart will be charged at an hourly rate based on the pertinent planning staff rate listed above. 8. Condensate Transfer Facility located on County Road 246 (Anvil Points Road) Township 6 South, Range 94 West, Section 20, 6th P.M. 1. Project Description: SemCrude L.P . transfers condensate from William Production RMT Co. natural gas well sites to facilities outside of Garfield County. Natural Gas condensate is a complex combination of hydrocarbons separated and/or condensed from natural gas and containing carbon numbers in the range of CS. During Summer operations, SemCrude L.P. utilizes tankers to haul condensate from well pad sites to facilities outside of Garfield County. The remote locations and varying road conditions of these natural gas wells necessitate the use of two and one-half ton truck/multi-rude tank trucks (bobtails) during the Winter and Spring months. Please see pictures of the tankers and bobtails attached in Tab 2a-Site Pictures. SemCrude L.P . is proposing to construct a Condensate Transfer Facility on the East side of Anvil Points road approximately 0.7 of a mile North of the Anvil Points Road, U.S . Highway 6 & 24 intersection. The purpose of the facility will be to allow a centralized location to unload condensate from the bobtails and then to load condensate onto tankers for transport to locations outside of Garfield County. Currently, these 80,000 pound tankers are driven to each of the many natural gas well sites in Garfield County to service these areas. The new facility will allow 50,000 pound bobtails to access natural gas well sites and haul to the facility. Page I of 5 c (_ c The benefits of this proposed facility will be the fol1owing: A. Decreased tanker traffic on smaller roadways thus an improvement in safety and a reduction in road damage. B. A centralized location will al1ow for limited storage of condensate thus a net decrease of 30% in tanker truck trips should be realized. C. Decreased impact on County Roads. Decreasing the 80,000 pound tankers and instead utilizing 50,000 pound bobtails for hauling from natural gas well sites. The proposed location is a Williams Production RMT Co. well pad (Well 523-20) that has an existing access from Anvil Points Road. The proposed site will be approximately 400 feet x 450 feet, approximately 4.13 acres. Change size as per new site plan. The proposed facility will require two accesses from Anvil Points road to allow for circulation. There is proposed to be 10 -400 barrel tanks on-site for storage of NOL with a dedicated loading and unloading location. 1 Ox400 === 4,000 barrels. 1 barrel = 42 gallons. 4,000 barrels x 42 gallons= 168,000 gallons. As noted on the site plan and detailed in the Spill Prevention Control and Countermeasure plan, a perimeter berm will , be constructed around the storage area to allow for containment of 1.5 times the maximum storage capacity as per federal law. Two bobtail trucks will be parked on-site when they are not in use and will be plugged into electrical service for diesel engine block heaters. A 100 sq. ft. or smaller storage shed will be located on-site to store documents for use by personnel. This storage shed will not be occupied but will have a phone and fax for driver use. There will be a portable toilet on-site for use by the drivers. Currently, SemCrude L.P. anticipates a maximum of 8 trips per day by the bobtails and 4 trips a day by tankers. This number is planned to double within the next 2 years to 16 trips per day by the bobtails and 8 trips a day by tankers. The property encompassing the Condensate Transfer Facility will be leased by SemCrude L.P. from W.F. Clough. This executed lease document is attached. The proposed facility is well-placed within this property to reduce impacts on adjacent properties. Please see exhibit 6-Vicinity Map. This proposed facility will operate 24 hours a day, 7 days a week and 365 days per year. Please find attached pictures of the existing site and the surrounding area. 2. Existing zoning: The proposed plant expansion area is Resource Lands-Lower Valley Floor. The Garfield County Zoning Resolution Section 3.10.04 notes "Resource Lands-Gentle Slopes and Lower Valley Floor. Uses. special: allowed by permit only: Industrial support facilities which would include: material handling, pumping facilities, electric distribution, warehouse facilities/staging areas, water impoundments, utility lines, utility substations, extraction, processing, accessory uses to the above ... " Page 2of5 ( c ( We see that the proposed facility meets the Garfie)d County Resource Lands-Gent]e Slopes and Lower Valley Floor special use permit designations as a material handling industrial support facility. 3. Surrounding zoning: Resource Lands and the existing uses are Industrial and Agricultura]. 4. Garfield County Comprehensive Plan of 2000: The Garfield County Comprehensive Plan of 2000 notes this project in Study Area 3. Natural Resource extraction is detaiJed in Section 9 of the "Goals, Objectives, Policies and Programs" located on page 17. "Garfield County recognizes that under Colorado Law, the surface and mineral right interests have certain legal rights and privileges, including the right to extract and deveJop these interests. Furthermore, private property owners also have certain legal rights and privileges, including the right to have the mineral estate developed in a reasonable manner and to have adverse land use impacts mitigated." Policies Section 9.1 notes: "Garfield County, to the extent legally possible, will require adequate mitigation to address the impacts of mineral extraction on adjacent landowners. These measures may include the following: A. Landscaping and screening; B. Modification of phasing or area to be mined; C. Roadway improvements and signage; D. Safe and efficient access routes; E. Drainage improvements to protect surface and groundwater" We see that the proposed proposed facility meets the Garfield County comprehensive plan goals, objectives, policies and programs. We have addressed each of the policies stated in 9 .1. Additionally, the surrounding uses to this property include the Garfield County landfill, natural gas drilling operations and the oil shale processing facility located at the New Paraho. 5. Referral Agencies: We have had a pre-application meeting with Mr. Fred Jarman, Director of the Garfield County Building and Planning Department on December 7, 2006. We have met with many of the referral agencies to review the proposed plant expansion and to review agency concerns and issues. Garfield County Road & Bridge Department-Jake Mall December 11, 2006-Jake Mall and I discussed the project via phone. I. Mr. Mall noted that a paved apron will be required with a recommended 100 foot wide flared access to enable truck turning without running into borrow ditches. Mr. Mall noted that an 80 foot flared access design may be allowed depending upon our submitted site plan. 2. 24" diameter culverts will need to be installed at both entries with flare ends. 3. Paving depths and materials will need to be shown on the drawings from County Road 246 to the property line. 4. A stop sign will need to be installed at both accesses onto County Road 246. 5. An access permits for the proposed entry will need to be'Clpplied for from the Garfield County Road and Bridge Department. B. Rifle Fire Protection District-Kevin Whalen December 11, 2006-Kevin Whalen and I discussed the project via phone. The RFPD will review the application when they receive it in regards to fire safety. C. Colorado Division of Wildlife-J.T. Romatske December 12, 2006-Phil Vaughan left a phone message for Officer Romatske and has not heard back from him. D. Jesse Smith-Assistant County Manager/Acting Garfield County Oil and Gas Auditor- December 12, 2006-Jesse Smith and I discussed the project via phone. Jesse spoke about concerns of odor mitigation and camouflaging of the facility. E. Steve Anthony-Garfield County Vegetation Management- December 11, 2006-Steve Anthony and I discussed the project via phone. Steve indicated that he would review the application after receiving it and will comment. Phil Vaughan noted that the site will be kept devoid of vegetation. F. Jim Rada-Garfield County Public Health Department-Environmental Health Specialist. December 12, 2006-Jim Rada and I discussed the project via phone. We discussed odor mitigation, camouflaging and the necessity of an on-site portable toilet. Clough, with a current maiJing address of PO Box 686, Rifle, Colorado 81650, their successors and assigns (hereinafter called "Lessor") for and in consideration of the sum of Ten and No/100 Dollars ($10.00) and other good and valuable consideration, the receipt and sufficiency . of which is hereby acknowledged, does hereby lease, demise, and let unto SemCrude, L.P., a Delaware limited partnership, with a current mailing address of 11501 South 1-44 Service Road, Oklahoma City, Oklahoma 73173 (hereinafter called ''Lessee"), for the purpose, at the rental, for the term, and upon conditions herein set forth, the surface of that certain tract of land, (hereinafter called the "Premises") situated in the Garfield County, Colorado, and more particularly depicted on Exhibit "A" and described by metes and bounds on Exhibit "B" attached hereto and made a part hereof. TO HA VE AND TO HOLD said Premises unto Lessee, its successors and assigns subject to all public or private prior easemerrts, rights of ways and encumbrances associated with this property and to the restrictions, limitations and reserved rights herein provided. (I) Lessee shall use the Premises for the sole purpose of installing, maintaining, operating, altering, replacing, repairing, and removing electrical meters and pwnp facilities, tanks, outbuildings, office space, truck off-loading sites, pipelines, including appurtenances thereto and for oil and gas storage in tanks, shipment by trucks and pipeline, measurement and other purposes, including perimeter fencing, used exclusively in connection with the perfonnance of its existing and future contracts with Williams Production RMT Company. (2) Lessee shall be permitted to access the Premises directly from County Road No. 246 and install a gravel access road to and from the site. (3) This Surface Site Agreement (hereinafter called "Agreement") shall extend for an initial term of two (2) years from October 15, 2006, with an option to extend said initial term for three (3) additional one (1) year terms provided, however, that Lessee may terminate this Agreement at anytime by notifying Lessor in writing on or before sixty (60) days prior to the anniversary date of this Agreement. Termination of this Agreement as provided for herein shall relieve Lessor and Lessee of further obligations, except as provided in Section (6); (4) Notwithstanding the duration of this agreement as provided in Section (2) above, this Agreement shall automatically terminate commensurate with the termination of operations by Williams (5) As consideration for the first year of this Agreement and for the rights and interests conveyed hereby, Lessee shall pay Lessor, in advance, the sum of Two Thousand Dollars ($2,000.00). By the execution hereof, Lessor acknowledges receipt and sufficiency of the sum of Two Thousand Dollars ($2,000.00) covering the first year. (7) At the expiration or tennination of this Agreement for any reason whatsoever, Lessee may be required by Lessor to remove all or part of Lessee's facilities from the Premises at Lessee's expense and shall restore the land to as near its former conditions as practicable and to surrender the Premises to Lessor; (8) Lessee shall comply with all Federal, State and local laws, statutes, ordinances, orders, rules, and regulations applicable to its use of the Premises, and Lessee shall obtain all necessary governmental permits and authorizations for the installation, maintenance, operation, alteration, replacement, repair, and removal of all facilities hereunder; (9) Lessee shall keep the real estate of Lessor free and clear of any and all liens and encumbrances resulting from any work or act done by Lessee or on its behalf pursuant to this agreement. Onsite fuel tanks will be protected with at least a 2-foot, plastic~lined dirt berm completely surrounding the tank in case of a leak or spill. • Paints -Containers wilJ be tightly sealed when not in use, and excess paint shall be disposed of according to Colorado requirements and manufacturer's recommendations. D. Concrete Trucks • A designated, contained area onsite shall be provided for concrete trucks to washout. TI1e washout area will be deaned periodically to remove hardened concrete, the resulting waste wiJJ be disposed of according to the Waste Disposal section of this plan. E. Section 311 (j) of the Federal Water Pollution Control Act {FWPCA). {33. U.S.C. 132l(j), and as amended by, 2. Section 4202(a) (6) of the Oil Pollution Act (OPA) of 1990 (Pub. L. 101-390), and - 3. The Hazardous Materials Transportation Act, and specifically 4. USDOT-RSPA-49CFRPart 171.1, 171.5, 171.8, 171.11, 171.12, 171.12a and 171.15. This plan applies to transportation activities, including loading and unloading, of oil involving company transport units within the contiguous 48 states. This plan takes-into consideration that a worse case occurrence would involve a major accident in which the total contents of the tank trailer and the tractor fuel tanks would be released. -Based on current maximum capacities, the gross quantity of oil that could be released is 10170 gallons, which is equivalent to 242 barrels. Company Transport Unit: A company owned or leased tractor-tank trailer combination unit or a self propelled tank truck (bobtail unit) operated be a company paid driver. Oil: Means oil of any kind or in any form, including, but not limited to, natural gas liquids, petroleum, vegetable oil, animal oil, fuel oil, sludge, oil refuse, and oil mixed with wastes other than dredged spoil. In the event of an over-the-road release of oil or vehicle 11ccident that, bcc11usc of company unit damage or configuration (roll-over, etc.), may result in a release, or a release occurring during loading or unloading of a company unit, the driver, shall in the following order: , I. Stay wilh the unit, warning any other people in the immediate area to stay clear of the unit and any released oil. 2. Inform other people in the immcdiale area of the hazards involved. 3. Have someone call the state or local police or fire department 4. Take immediate action to stop the leak and/or contain released oil. 5. Upon arrival of the first responders (police/fire department), advise them of the potential for release. Have first responders seal off the involved area ftom entry by people or other vehicles. IF IN TEXAS: In the case of an emergency requiring immediate attention of the Texas Natural Resource Conservation Convnission (TNRCC) -Emergency Response Center (ERC) call 512-463-7727 -24 hour Examples of emergencies which require TWC-ERC assistance are: • Spill which potentially may endanger public health or safety • Leaked product from a tanker truck involved in a highway accident • Product storage tank catastrophic rupture • Product spill which threatens any surface water such as a stream or wetlands. A partial list of Emergency response companies is provided. and can be contacted directly. Contact the General Manager once the ERC has been contacted. More specific reporting procedures are attached which provide reporting information, follow-up procedures, contractors for spill mitigation and cleanup. The spill response plan is current with recent Federal Department of Transportation final rule 58 k:.B 33302 which requires preparation of oil spill prevention and response plans. The final regulation regarding this is found in the Federal Register Vol 58 no. 114, June 16, 1993 as regulation 49 CFR part 130 . Follow-up reporting and routine reporting of small spills at the facilities will continue to be handled by our established internal format. Page 6 ( c c SUMMARY OF TEXAS SPILL REPORTING REQUIREMENTS In the case of an emergency such as a transportation accident of spilled product or an emergency at a tank battery or L.A.C.T. location call: Texas Natural Resource Conservation Co111111ission Emergency Response Center (512) 463-7727 -24 hours The Texas Water Code, Chapter 26, defines a crude oil spill and response authority as follows: .. • A "harmful quantity" of crude oil is ~five (5) or more barrels (210 gallons) spilled on the ground, and any quantity of crude oil spilled into water. • The TWC has spill response authority over spills at refineries. • The TRC has spill r~sponse authority from activities associated with exploration, development, and production of oil and gas. • Both the TWC and the TRC have spill response authority over spills of harmful quantities of crude oil which occur during transportation or in coastal waters. • The TWC would be the lead agency in directing and approving cleanup of spills of crude oil from a truck involved in a highway accident. Page 7 III . ( ( (_ THE EMERGENCY RESPONSE COMMANDER A. Upon notification of an oi.l release or a non-release incident involving oil with a potential for release, the Operations Manager shall become the Emergency Response Commander (ERC). The ERC Shall: l . Assure all regulatory emergency response agencies, including Chemtrec, are notified, as required. 2. Assure immediate remedial and containment actions are being taken at the incident scene, including ordering in qualified remed i ation contractor personnel and equipment. 3. Dispatch back-up tractor-tank to scene for product transfer, if needed . 4. Notify Waste Control Managemttnt, if needed, to respond to assist in incident resolution. Page 8 ( c ( IV. DRIVER IMMEDIATE ACTION AT SCENE A. The purpose of driver inunediate action at scene is to: * Stop leakage * Capture leakage to prevent surface contamination. * Contain released oil to prevent further spread of surface contamination. a. The following steps should be followed by the driver: l. Put on required personal protective clothing and equipment. 2. Place containment barrier around released oil to keep such oil from spreading. Barrier can also be whatever materials are a~ hand, such as dirt, absorbent materials, etc. Block off nearby sewer openings. ) . Capture leakage from tank trailer by use of buckets, tubs, cans, etc. to prevent leakage from reaching ground surface. 4. Stop ~eakage if possible, by: a. Use of wood plugs or other imperv ious materials to plug holes in tank. b. Use of wood toothpicks placed into pinholes and small crack leaks. c. d. Batten and brace leaking dome lids with wood dunnage or dome clamps. Tight wrap and tape leaking fittings with impervious materials. V. EVACUATION A. In the event of a major release the possibility of evacuation may have to be considered. Refer to the Emergency Response Handbook for reconunended evacuation distances for involved product. B. The decision to institute an evacuation order will rest with the Emergency Response (Regulatory, fire, police) agencies. VI. CLEAN UP A. When releases occur onto impervious paved surfaces, standing liquid oil should be absorbed into a compatible material, such as sand, diatomaceous earth, absorbent pads, etc1 Contaminated absorbent materials must then be picked up with brooms and shovels, placed in approved and properly labeled drum~ or bags, sealed and properly transported to an approved EPA disposal site. B. When releases occur onto exposed soil, the contaminated soil will be removed or remediated by methods and to the extent required by the environmental regulatory _agency having jurisdiction over the release site. c. Sampling for contamination, as required, shall be handled by Waste Control Management personnel, and shall be by approved procedures of the jurisdictional environmental agency relative to sampling techniques, chain-of-custody requi r ements, and laboratory analytical methods utilized. DECONTAMINATION A. Tractor-Tank Trailer: Prior to being removed from the release site, a tractor-tank trailer, if contaminated with oil (exterior or tank interior) that could be released dur~ng the course of transportation to a location away from the -release site, must first be decontaminated. e. Equipment: contaminated equipment, used in the release clean-up will be properly washed at the release site, using solvents or neutralizers, if necessary. c. Protective Clothing: Contaminated protective clothing, if possible, will be properly cleaned and decontaminated at the release site. All contaminated clothing, protective and personal, unable to be decontaminated for reuse will be properly bagged and/or drummed, sealed, labeled and transported to an appropriate permitted disposal site. D. Measures shall be taken to prevent excessive soil erosion by wind or water including the Best Management Practices as detailed in the Stormwater Management Plan for the site. All excavated surfaces shall be maintained with adequate moisture to reduce wind erosion. During operation of the facility, care will be taken to review site conditions daily. The noise levels predicted from the facility are below applicable Garfield County and State of Colorado regulations. APPLICABLE REGULATIONS The applicable noise regulation per the Garfield County Zoning and Subdivision Regulations for this Special Use Permit is 5.03.08(1) Industrial Performance Standards for Conditional and Special Uses, which states ''Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. (A. 93-061 )". This refers to the Colorado Revised Statutes (C.R S .) §25-12-101 et seq. noise regulation. A second noise regulation that may be applicable is per the Colorado Oil and Gas Conservation Commission's (COGCq Rule 802 (updated November 2006). The noise limits contained in these two regulations are identical, and are shown in Table 1. The Special Use Permit (SUP) being applied for involves 24 hour operations, thus the maximum noise level will be defined by the nighttime (quietest) limit for each land use zone. For this project, the abutting land uses include the Garfield County Landfill to the north, lands with natural gas drilling and livestock grazing to the east, Interstate 70 to the south, and Bureau of Land Management lands to the west. The COGCC states that "light indusbial" may be applicable for lands in remote locations where there are no occupied structures or designated outside activities. Thus for this noise analysis, the open lands to the east and BLM lands to the west will be considered light industrial with a nighttime limit of 65 dBA. The landfill to the north and state highway to the south will be considered industrial with a nighttime limit of 75 dBA The nearest residential property line located 0.7 miles to the southwest and has a nighttime limit of 50 dBA. Oough property to the east (which is currently being used for natural gas drilling and livestock grazing), W.F. Oough property immediately to the west with open BLM land approximately 1,000 feet to the west, and 1-70 to the south. The primary noise aspect to consider from this facility is when the trucks are on site and transferring liquids between the storage tanks and trucks. The truck itseH makes most of the noise, with some contribution from the truck-mounted pumps. NOISE ANALYSIS RESULTS To determine if the proposed SemCrude Condensate Transfer Facility is in compliance with the Colorado State noise regulations, noise levels were measured at reference distances from a similar operation and then mathematically extrapolated to r~resent the appropriate distances at the proposed site (ie.: 25 feet away from the SemCrude property line and residential property line). Noise levels were measured from an operating SemCrude pump truck on March 28, 2007. Measurements were taken using a Larson Davis Model 824 Sound Level Meter with windscreen meeting American National Standards Institute Type 1 specifications. Noise measurements were taken at locations 125 feet, 25, feet, 50, feet, and 100 feet from the center of the truck and pump. A photograph taken during these measurements is provided in Figure 2 Wind speeds were generally greater than 5 miles per hour on this day, but care was taken to measure only downwind (loudest levels). The temperature was 60°F with a relative humidity of 55%. Both the idling truck and pump were distinctly audible. No distinct tones or low frequency rumbles were evident beyond 25 feet from the truck. Noise levels at the nearest residential property located 0.7 miles to the southwest were predicted using International Standards Organization (ISO) 9613-2 Attenuation of Sound During Propagation Outdoors. This method was used rather than the equation specified in COGCC Rule 802 as it includes the consideration for a barrier being in between the source and receiver. In this case there is some terrain that is 160 feet to 180 feet high between the proposed SemCrude facility and the nearest residence. Figure 3 shows a photograph of the site as viewed from the south with the location of the nearest residence and proposed SemCrude Site labeled. The source noise level for this calculation was taken from the previously described noise measurements. The geometric site information was taken from USGS topography information provided by the client The predicted level from one truck and pump operating at the residence is 25 dBA, which is well below the nighttime maximum of 50 dBA. The State Code allows for special p rovisions for impulsive and shrill type noises. Noise from the proposed operations has neither. Also, there are no significant low frequency components from this operation that would constitute a low frequency noise problem under COGCC Rule 802. In conclusion, our analysis shows that noise from the proposed SemCrude Condensate Transfer Facility is in compliance with Colorado Revised Statute (C.R. S.) §25-12-101 and COGCC Rule 802. The noise levels predicted from the facility are below applicable Garfield County and State of Colorado regulations. APPLICABLE REGULATIONS The applicable noise regulation per the Garfield County Zoning and Subdivision Regulations for this Special Use Permit is 5.03.08(1) Industrial Performance Standards for Conditional and Special Uses, which states "Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. (A. 93-061)". This refers to the Colorado Revised Statutes (C.R. S.) §25-12-101 et seq. noise regulation. A second noise regulation that may be applicable is per the Colorado Oil and Gas Conservation Commission's (COGCC) Rule 802 (updated November 2006). The noise limits contained in these two regulations are identical, and are shown in Table 1. The Special Use Permit (SUP) being applied for involves 24 hour operations, thus the maximum noise level will be defined by the nighttime (quietest) limit for each land use zone. For this project, the abutting land uses include the Garfield County Landfill to the north, lands with natural gas drilling and livestock grazing to the east, Interstate 70 to the south, and Bureau of Land Management lands to the west. The COGCC states that "light industrial" may be applicable for lands in remote locations where there are no occupied structures or designated outside activities. Thus for this noise analysis, the open lands to the east and BLM lands to the west will be considered light industrial with a nighttime limit of 65 dBA. The landfill to the north and state highway to the south will be considered industrial with a nighttime limit of 75 dBA. The nearest residential property line located 0.7 miles to the southwest and has a nighttime limit of 50 dBA. INTRODUCTION The rules and regulations in this section are promulgated to control aesthetics and noise impacts during the drilling, completion and operation of oil and gas wells and production facilities. Any Colorado county, home rule or statutory city, town, territorial charter city or city and county may, by application to the Commission, seek a determination that the rules and regulations in this section, or any individual rule or regulation, shall not apply to oil and gas activities occurring within the boundaries, or any part thereof, of any Colorado county, home rule or statutory city, town, territorial charter city or city and county, such determination to be based upon a showing by any Colorado county, home rule or statutory city, town, territorial charter city or city and county that, because of conditions existing therein, the enforcement of these rules and regulations is not necessary within the boundaries of any Colorado county, home rule or statutory city, town, territorial charter city or city and county for the protection of public health, safely and welfare. 802. NOISE ABATEMENT a. The goal of this rule is to identify noise sources related to oil and gas operations that impact surrounding landowners and to implement cost-effective and technically-feasible mitigation measures to bring oil and gas facilities into compliance with the allowable noise levels identified in subsection c. Operators should be aware that noise control is most effectively addressed at the siting and deslgn phase, especially with respect to centralized compression and other downstream "gas facilities" (see definition in the 100 Series of these rules). b. Oil and gas operations at any well site, production facility or gas facility, shall comply with the following maximum permissible noise levels. Operations involving pipeline or gas facility installation or maintenance, the use of a drilling rig, completion rig, workover rig, or stimulation is subject to the maximum permissible noise levels for industrial zones. The type of land use of the surrounding area shall be determined by the Commission in consultation with the local governmental designee taking into consideration any applicable zoning or other local land use designation. c. In the hours between 7:00 a.m. and the next 7:00 p .m. the noise levels permitted below may be increased ten (10) db(A) for a period not to exceed fifteen (15) minutes in any one (1) hour period. The allowable noise level for periodic, impulsive or shrill noises is reduced by five (5) db(A) from the levels shown . Pursuant to Commission inspection or upon receiving a complaint from a nearby property owner or local governmental designee regarding noise related to oil and gas operations, the Commission shall conduct an onsile investigation and take sound measurements as prescribed herein. The following provide guidance for the measurement of sound levels and assignment of points of compliance for oil and gas operations: 800-1 (1) Sound levels shall be measured at a distance of three hundred and fifty (350) feet from the noise source. At the request of the complainant, the sound level shall also be measured at a point beyond three hundred fifty (350) feet that the complainant believes is more representative of the noise impact. If an oil and gas well site, production facility or gas facility is installed closer than three hundred fifty (350) feet from an existing occupied structure, sound levels shall be measured at a point twenty~five (25) feet from the structure towards the noise source. Noise levels from oil and gas facilities localed on surface property owned, leased or otheiwise controlled by the operator shall be measured at three hundred and fifty (350) feet or at the property line , whichever is greater. In situations where measurement of noise levels at three hundred and fifty (350) feet is impractical or unrepresentative due to topography, the measurement may be taken at a lesser distance and extrapolated to a 350-foot equivalent using the following formula: db(A)DISTANCE 2 = db(A)DISTANCE 1 -20 x log10(distance 2/distance 1) as or January 30, 2006 c ( ( (2) Sound level meters shall be equipped with wind screens, and readings taken when the wind velocity at the time and place of measurement is not more than five (5) miles per hour. (3) Sound level measurements shall be taken four (4) feet above ground level. (4) Sound levels shall be determined by averaging minute-by-minute measurements made over a minimum fifteen (15) minute sample duration if practicable. The sample shall be taken under conditions that are representative of the noise experienced by the complainant (e.g., at night, morning, evening, or during special weather conditions). (5) In all sound level measurements, the existing ambient noise level from all other sources in the encompassing environment at the time and place of such sound lever measurement shall be considered to determine the contribution to the sound revel by the oil and gas operalion(s). d. In situations where the complaint or Commission onsite inspection indicates that low frequency noise is a component of the problem, the Commission shall obtain a sound revel measurement twenty-five (25) feet from the exterior wall of the residence or occupied structure nearest to the noise source, using a noise meter calibrated to the db(C) scale. If this reading exceeds 65 db(C), the Commission shall require the operator to obtain a low frequency noise impact analysis by a qualified sound expert, including identification of any reasonable control measures available to mitigate such low frequency noise impact. Such study shall be provided to the Commission for consideration and possible action. e. Exhaust from all engines, motors, coolers and other mechanized equipment shall be vented in a direction away from all occupied buildings. f. All facilities within four hundred (400) feet of occupied buildings with engines or motors which are not electrically operated shall be equipped with quiet design mufflers or equivalent. All mufflers shall be properly installed and maintained in proper working order. 803. LIGHTING To the extent practicable, site lighting shall be directed downward and internally so as to avoid glare on public roads and occupied buildings within seven hundred (700) feet. 804. CONDENSATE TRANSFER FACILITY COUNTY ROAD 246 RIFLE, CO Township 6 South, Range 94 West, Section 20, 5111 P.M. The SemCrude LP. Condendate Transfer Facility will be located on property owned by W.F. Clough. The parcel is approximately 4 acres and is immediately adjacent to County Road #246. The subject site appears to lie in the Arvada- Torrifluvents-Helt soil series as shown on the Garfield County Generalized Soils Types map dated 1/31/02. These soils are better classifi~ as a sandy, silty clay (CL) under the Unified Classification System. This soil is a stratified colluvial/debris flow soils which originate on the upper slopes to the North, stratified with alluvial soils deposited by the ancient Colorado River feature. Topsoil should be stripped to a depth of approximately twelve (12) inches and stockpiled at the facility margins. The maximum depth of stockpiled materials shall be 24• or less to preserve soil viability. Topsoil stockpiles will be seeded as described below in the section on seeding meth~s and times. RECLAMATION Two phases of reclamation are planned. Stabilization of the site will occur after construction of the facility . ( Driving surfaces will have class 6 road base installed to provide a driving surface. Slope fills will be planted as per the section on seeding methods and limes. Final reclamation will be performed within one year of the facility closure and removal of improvements from the site. The objectives of reclamation will be as follows: 1. Stabilization of the disturbed areas will be conducted by providing wind and water erosion control to reduce soil loss. 2. Utilize the prescribed seed mixtures and additional vegetation practices as described below to establish a self- sustaining vegetative rangeland cover for cattle pasture use. FACILITY REMOVAL The Condensate Transfer Facility will be abandoned in accordance with regulations in place at the time of facility abandonment. All improvements will be removed from the site. Page 1 of3 BACKFILLING, GRADING, AND RE-CONTOURING Reclaimed areas will be sloped to 3:1 or less. ( roP~OIL REPLACEMENT Soil salvaged during construction activities will be redistributed over the soil surf ace after subsoil has been replaced and additional backfilling; grading, and re-contouring steps have been completed as described below. Soil will be replaced by using front-end loaders, trackhoes, and dozers. Soil will not be replaced when it is excessively wet and frozen so as to jeopardize soil structure. SEEDBED PREPARATION/SOIL TILLAGE Seedbed preparation and soil tillage will be completed after the application of subsoil, topsoil, and any soil amendments. Soil tillage will be to a minimum depth of 4• utilizing a disk, chisel plow, or harrow. Seedbed preparation will also include removal of coarse fragments (rock material) that exceed 35% to 40% of the soil surface as well as rocks a· in diameter that occupy more than 10% of the soil surface. SEEDING METHODS AND TIMES If seeding is perfonned in the spring, it will be accomplished by May 15; if fall seeding is perfonned it will be completed ( ,fter August 30 and before the soil freezes. Seeding efforts will consist of drill seeding with a rangeland drill to a planting depth of%• to Yz• on slopes 3:1 or flatter. Broadcast seeding followed by harrowing or hand raking to lighHy cover the seed with soil will be used on slopes steeper than 3: 1, or on areas inaccessible for drill seeding equipment. ( All areas to be reclaimed will be mulched no later than 24 hours after seeding with a certified weed-free straw or grass hay material. Grass hay mulch will be applied at 1 Yz tons per acre, or straw mulch will be applied at 2 tons per acre. Mulch material will be crimped into the soil surface with a commercial mulch crimper, a straight disc, or bulldozer tracks if too steep to otherwise crimp mulch in place. A major area within the facility area will be class 6 road base and will be devoid of vegetation . Storage of flammable or explosive solids or gases. Loading Rack and Truck Drivers Truck drivers are given a safety briefing I safety orientation when they arrive to haul their first load from the facility. Truck drivers sign in and out the loads in the storage building on-site. They then go to the loading rack and hook-up. Once they have achieved a proper ground utilizing a ground strap, the truck drivers start the truck mounted pump. Fire Training Fire extinguisher training is provided to SemCrude L.P. employees on an annual basis. Emergency Response Plan The current emergency response plan (ERP) will be reviewed with the RFPD. A copy is also available via the Local Emergency Planning Committee (LEPC). Please find a copy of the Oil Spill Prevention and Response Plan for Shipments of Oil in Cargo Tank Trailers in tab 11.1.A.2 SPCC Plan. Perimeter access for RFPD will be provided. Access to the facility will be gained directly from County Road 246. Fire Department Walk-Through A walk-through will be scheduled with the RFPD prior to the facility startup. SemCrude L.P. will be installing a barb wire fence around the facility perimeter to keep cattle out of the plant and for plant security. No further berming or plantings have been planned for the site as the adjacent parcels are industrial uses. Benning or screening from Garfield County Road #246 would be ineffective because of the lower grade of the facility as compared to the higher grade of road #246. 5.03.08 (5)C. Materials or wastes transferred off-property. Vapor, dust, smoke, noise, glare and vibration have been addressed in I l. I .B in the application. The Construction stormwater management plan and the Spill Prevention Control and Countermeasure Plan have been addressed in I I. I .A in the application. As a part of the SemCrude L.P. safety regulations, notation is made to securing all loose materials and trash so that these items are not lifted by strong winds and subsequently provide a safety hazard or trash concerns off-site. This issue will be noted to all contractors and employees. Any trash items inadvertently allowed to blow off-site will be picked-up by SemCrude L.P .. In addition, the perimeter fence will aid in this effort. 5.03.08 (5)D. Storage of heavy equipment With the exception of construction of the facility, 2 bobtails with pup trailers will be on-site on a permanent basis. Two personal vehicles will be on-site during each shift. 5.03.08 (5)E. Storage Area Sizing-Not applicable. 5.03.08 (S)F. Lighting. As per Garfield County Regulations and COGCC rule 803, site lighting shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property.
