In accordance with and pursuant to the provisions of the Garfield County Zoning Resolution
of 1978, as amended, and Resolution No. 2008 - 51 of the Board of County Commissioners
of Garfield County, State of Colorado, hereby authorizes, by Special Use Permit, the
following activity:
"INDUSTRIAL SUPPORT FACILITY WHICH WOULD
INCLUDE: MATERIAL HANDLING, PUMPING
FACILITIES, STAGING AREAS, STORAGE AREAS AND
PROCESSING"
The Special Use Permit is issued subject to the conditions set forth in the above-mentioned
resolution, and shall be valid only during compliance with such conditions and other
applicable provisions of the Garfield County Zoning Resolution, Subdivision Regulations,

NW 1/4 of Section 36, Township 5 South, Range 98 West
of the 6th P.M, 2.5 miles northwest of the end of
County Road 211, part of 4311.69 -acre parcel
owned by Chevron USA.

In accordance with and pursuant to Section 6.00 of the Garfield County Zoning Resolution of
1978, as amended, and Resolution No. 2006 - 79 of the Board of County Commissioners of
Garfield County, State of Colorado, the Director of the Building and Planning Department
hereby authorizes, by Administrative Permit, the following activity:
The placement of construction grading in the
flood ;fringe of the designated 100 year floodplain
of Tom Creek, a first order stream that drains to
the Colorado River, near its confluence with Clear
Creek, for the construction of a pad on which to
build the Central Production Facility Area to serve
the output of several gas wells.
The Administrative Permit is issued subject to the conditions set forth in Exhibit A (attached
hereto), and shall be valid only during compliance with such conditions and other applicable
provisions of the Garfield County Zoning Resolution, Subdivision Regulations, Building
Code, and other regulations of the Board of County Commissioners of Garfield County,
Colorado.

EXHIBIT A
FLOODPLAIN PERMIT — Parcels #2137-321-00-008 and
2137-320-00-008 including portions of Tract 103 and 104,
T5s, R98 W of the 6th P.M Colorado, owned by Chevron
USA.
1. All representations made in the application shall be considered conditions of
approval, unless modified by this Exhibit A.
2. There are no regulated wetland areas associated with this permit.
3. No alterations of the floodplain may be made other than the specific
improvements noted in the application and shown on drawing by Gene
Rasmussen, labeled "Piceance Basin Development Central Production Facility
Pad Post Construction Floodplain Limits" (PBSR-59836AVF-CIV-PMT-
URS-00000-00002-00) submitted as a July 2, 2008, addendum to an
application signed and stamped by Sally Cuffin, P.E.
4. All new construction or substantial improvements shall be designed (or
modified) and adequately anchored to prevent flotation, collapse or lateral
movement of the structure resulting from hydrodynamic and hydrostatic loads,
including the effects of buoyancy.
5. All new construction or substantial improvements shall be constructed with
materials resistant to flood damage.
6. All new construction or substantial improvements shall be constructed by
methods and practices that minimize flood damage.
7. All new construction or substantial improvements shall be constructed with
electrical, heating, ventilation, plumbing, and air conditioning equipment and
other service facilities that are designed and/or located so as to prevent water
from entering or accumulating within the components during conditions of
flooding.
8. Safety plan measures submitted as Piceance Basin Natural Gas Development
Severe Weather/Flood Evacuation Plan submitted as a July 10, 2008,
addendum to the application shall be followed to help ensure safety to
workers.
