Washington Group International 7800 East Union Avenue Denver, CO 80237 RE: Chevron Piceance Basin 30 -inch Pipeline Dear Sally, Garfield County BUILDING & PLANNING DEPARTMENT Staff has reviewed the Pipeline ROW Application for the Chevron Piceance Basin 30 - inch Pipeline Plan submitted to this office on July 2, 2007. Staff understands that the project generally consists of the construction of an 8.1 mile, 30 - inch diameter natural gas pipeline, scrapper/ launcher facility, and a delivery facility. The pipeline is located 12.5 miles north of DeBeque. The proposal requires an Administrative Pipeline permit from Garfield County. The proposed pipeline will transport natural gas from the Piceance Basin area to regional pipelines. The route will disturb approximately 110.3 acres of land for the pipeline and related facilities. The pipeline route is situated entirely on Chevron property. The staff understands that the purpose of this proposed pipeline and related facilities is to transfer natural gas gathered from the Piceance Basin area to the regional market. The natural gas will be transported from the Central Compression/ Treat Facility through a 12 -inch pipeline to the Scrapper/Launcher Facility where the 30 -inch gas pipeline begins. The majority of the produced water and condensate is removed from the natural gas by the Central Compression/ Treat Facility. The Scrapper/Launcher Facility is used to control the remaining condensate and residual water collected along the pipeline. This activity is termed "pigging" which is essential for operation and to prevent damages to the pipeline. The pipeline ends at the Delivery Facility, where the amount of natural gas entering two regional pipelines is measured. [This site figure illustrates the layout for the Delivery Facility. Both of these streams are considered sensitive environments and will be included in the project specific USACE permit. Pipeline construction is expected to take about 16 weeks to complete. The pipeline delivering will require 170 trucks which will occur at three separate time periods. The pipeline will be transported to the regional area to Craig, CO by rail. About 30-50 deliveries will be required for the Delivery Facility and the Scrapper/ Launcher facility. Three delivery routes will be used, of which two routes include CR 215, CR 204, and CR 211. Workforce vehicles are estimated at 75 vehicles trips a day to and from the site. Upon an initial review, the Application was deemed technically complete on July 2, 2007 and has been substantively reviewed against the submittal requirements required in Resolution 2005 — 53 and required in Section 9.07 of the Zoning Resolution of 1978, as amended. This letter shall constitute Garfield County' s review of the project. The vicinity of the pipeline in the County is identified by the map below. [Photo: The pipeline begins in Clear Creek drainage at the mouth of Tom Creek] Staff referred the Application to the following Agencies / Departments whose comments are included here for review and attached to this letter which is required by Resolution 2005-53: A. DeBeque Fire Protection District: No Comments Received B. Garfield County Oil & Gas: Garfield County Oil & Gas Department has no objections to this application provided the Applicant submit an updated SPCC with site specific information, including Colorado and local government agencies. C. Garfield County Public Health: (See Exhibit A): 1. The stormwater permit submitted with this application is currently expired. Chevron should provide proof that they have renewed or applied for renewal of this permit as part of this application. 2. The inspection section of the stormwater management plan does not address the requirements of the current CDPHE WQCD Stormwater General Construction Permit to conduct post storm inspections of erosion controls within 24 -hours on active sites and within 72 hours on temporarily idle sites. As the new general construction stormwater permit has just gone into effect as of July 1, 2007, perhaps Chevron should be required to present an updated Stormwater management plan that reflects any changes in the new CDPHE General Construction Stormwater Permit. 3. The Spill Prevention, Containment and Countermeasure plan Page 84 addresses spill reporting requirements for the State of Texas. Chevron should be required to provide an updated SPCC Plan that references appropriate contacts for the State of Colorado and Garfield County. 4. No mention of sanitation needs at any facilities or for field construction operations. Portable toilets, if provided, must be managed in an appropriate manner, kept clean, and all waste disposed of to an approved disposal facility. D. Garfield County Road & Bridge: Garfield County Road & Bridge Department has no objections to this application with the following comments (See Exhibit B): 1. All entrances to Cr. 211 not already permitted with a driveway access permit/s will need to be permitted prior to accessing Cr. 211. Driveway access permit's, if needed will be issued by Garfield County Road & Bridge Department with conditions specific to the driveway access location. If driveway access/s are to be temporary for construction purposes they will be permitted and removed and reclaimed when construction is completed. All permanent driveway access/s will require a stop sign at the entrance to Cr. 211. 2. The stop sign/s and installation shall be as required in the MUTCD (Manual on Uniform Traffic Control Devices). 3. All vehicles hauling equipment and materials for the construction of the pipeline that exceeds the legal requirements shall require an oversize/overweight permit issued by Garfield County Road & Bridge Department. Prior to issuing these permits a letter from Chevron stating that such vehicles can operate under their road bond will be sent to Garfield County Road & Bridge Department. 4. Any permit/s needed for utilities within the County ROW will be permitted by Garfield County Road & Bridge Department upon request with conditions specific to each location and type. 5. Cr. 211 will be maintained to prevent dust and rough road conditions. This may include watering, grading and addition of a dust control agent. E. Garfield County Vegetation Management: Vegetation Management provided the following comments (Exhibit C): Weed Management 1. The noxious weed, tamarisk, is located in within 200 feet of the pipeline in many points along the pipeline. The applicant shall cut and treat the tamarisk prior to construction activities. Please forward a copy of the application records to the below address. Garfield County Vegetation Management POB 426 Rifle CO 81650 Reclamation 2. It is requested that the applicant provide a quantification of the surface area to be disturbed and subsequently reseeded. Once this figure is established, a revegetation security in the amount of $2500 per acre is recommended. The applicant shall provide the Vegetation Management Department with the original tags from each seed bag. The seed mix in the Plan shall match the seed mix used in the field. Do not use a seed mix containing yellow sweet clover (Melilotus offcinalis) or annual yellow sweetclover (M. indicus). The amount of seed specified to be planted in the Plan shall match the quantity of seed used in the field. 3. The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. Itis the responsibility of the applicant to contact the County, upon successful revegetation establishment, to request an inspection for security release consideration. Threatened, Endangered, and Sensitive Plant Species 4. In item 5.3 of the Biological Survey section, the applicant's consultant, WestWater Engineering, recommends a resurvey for threatened, endangered, and sensitive plant species. This department concurs with that, and we recommend that the survey occur as soon as possible, prior to construction activities. F. Mountain Cross Engineering: Reviewed the application and provided the following comments (Exhibit D): 1. Permitting is in various stages of completion. Copies of permits should be provided to Garfield County as they are obtained. 2. Streams are proposed to be crossed without permits obtained. Permitting with the US Army Corp of Engineers may require revisions to the proposed alignment depending on stream and wetland impacts. 3. Whether or not any of the jurisdictional drainages also have mapped floodplains is not discussed. Garfield County flood plain permits may be required. 4. The traffic impacts discuss construction traffic, which is temporary in nature. The application should also discuss the post construction traffic anticipated and if that traffic will have impacts on the surrounding roads. 5. The Spill Prevention, Control, and Countermeasure Plan is stamped as a draft version. A finalized version should be submitted. 6. The pre-engineered metal buildings may also need building permits with engineered foundations. 7. The application does not discuss whether or not sewer and water facilities will be necessary for any employees. 8. A grading and drainage plan for the building site should be submitted to determine any impacts on existing and surrounding topography. G. Town of DeBeque: No Comment Received Applicant Response to Comments The applicant has provided responses to the comments of the Garfield County Road and Bridge Department and the Garfield County Public Health Departments. (See Exhibit E): A. Garfield County Public Health: 1. The Applicant provided a copy of the reapplication the CDPHE Construction Activity Stormwater Discharge Permit. The Applicant states the permit has been approved, but has not received the permit. 2. The Applicant has stated an updated stormwater management plan will be submitted, but an updated plan has not been received. 3. The Applicant has stated an updated Spill Prevention, Containment and Countermeasure plan containing appropriate contacts will be submitted, but an updated plan has not been received. 4. The Applicant has established contracts for sanitation waste disposal during construction of this pipeline. Redi Services, located in Meeker, will provide services for the plateau area and Down Valley Septic will be responsible for the valley area. B. Garfield County Road & Bridge: 1. The Applicant states that Garfield County evaluated the road and determined that a driveway permit was not required for access off of CR 211. The entrance to the valley pipeline staging area is off an existing ranch road that is a continuance of CR 211 (north of the end of CR 211), which does not require the driveway access permit. 2. The Applicant states that appropriate signage has been installed in the valley area. 3. The Applicant states that the pipeline route does not cross any existing county roads. Determination of Review Upon substantive review of the documents submitted, Staff has made a determination of approval with conditions for the Chevron Piceance Basin 30 -inch Pipeline Project. The specific conditions include the following: 1. Any equipment used in construction or operation of a pipeline must comply with the Colorado Oil and Gas Conservation Commission Rules and Regulations, Section 802, Noise Abatement. Additionally, all power sources used in pipeline operations shall have electric motors or muffled internal combustion engines. 2. Pipeline operations shall be located in a manner to minimize their visual impact and disturbance of the land surface. Facilities shall be painted in a uniform, non - contrasting, non -reflective color, to blend with the adjacent landscape. Right-of- way shall be located in existing disturbed areas unless safety or visual concerns or other adverse surface impacts clearly dictate otherwise. 3. All access and oversize or overweight vehicle permits shall be obtained from the County Road & Bridge Department prior to beginning operation. Any new roads or intensified driveway accesses created as a result of the pipeline construction, intended to be permanent for maintenance and repair operations shall be placed behind a locked gate or other barriers preventing use by recreational vehicles. Any gates or barriers need to be consistent with the surface owner's preferences. 4. All accesses to Cr. 211 not currently permitted must obtain an access permit from the County Road & Bridge Department prior to beginning operation. All permanent driveway accesses will require a stop sign at the entrance to Cr. 211. Permitted temporary driveway accesses will be removed and reclaimed when construction of this project is completed. 5. All vehicles working within Garfield County Right of Ways will be licensed and registered in the State of Colorado. All vehicles hauling equipment and materials for the pipeline construction will abide by Garfield County Road & Bridge Departments oversize/overweight regulations. All vehicles requiring an oversize/overweight permit will send a letter showing proof that they can operate under a known bond holder on file with Garfield County Road & Bridge Department before a permit will be issued. 6. Please summit a renewed stormwater permit. The Applicant shall provide a final stormwater management plan which reflects the most recent CDPHE General Construction Stormwater Permit changes. 7. Please submit a new SPCC Plan which contains local and State of Colorado contacts and information. 8. Any proposed waste disposal or treatment facilities shall comply with all requirements of the County Individual Sewage Disposal System Regulations. 9. The Applicant shall cut and treat the tamarisk with the right-of-ways prior to construction activities. Please submit records documenting the removal of the tamarisk to the Garfield County Building and Planning Department and the Garfield County Vegetation Management, POB 426, Rifle, CO 81650. Approval by the Garfield County Vegetation Management is required prior to issuance of the pipeline permit. 10. The Applicant shall conduct a resurvey of this pipeline corridor for threatened, endangered, and sensitive plant species prior to construction activities. Please submit the resurvey report to the Garfield County Building and Planning Department and the Garfield County Vegetation Management, POB 426, Rifle, CO 81650. Approval by the Garfield County Vegetation Management is required prior to issuance of the pipeline permit 11. The Applicant shall provide the County with a revegetation security for fee lands in the amount of $275,750 for 110.3 acres disturbed prior to issuance of the pipeline permit. Additionally, the Applicant shall submit the original tags from each seed bag. The seed mix in the Plan shall match the seed mix used in the field. Seed mix containing yellow sweet clover (Melilotus offcinalis) or annual yellow sweetclover (M. indicus) shall not be used. The amount of seed specified to be planted in the Plan shall match the quantity of seed used in the field. The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the responsibility of the applicant to contact the County, upon successful revegetation establishment, to request an inspection for security release consideration. 12. Garfield County has not received all required permits for this pipeline plan. The Applicant shall submit all permits as they are obtained. These permits shall be submitted to the Garfield County Building and Planning Department prior to issuance of the pipeline permit. 13. Streams are proposed to be crossed without permits obtained. Permitting with the US Army Corp of Engineers may require revisions to the proposed alignment depending on stream and wetland impacts. The applicant shall submit evidence acceptable to the Garfield County Building and Planning Department as to whether the stream crossing require an Army Corps of Engineers permit prior to issuance of the pipeline permit. 14. The Applicant shall provide the County with a digital alignment of the pipeline once constructed in a format readable to the County. 15. In no case shall an operator engage in activities which impact Federal or State threatened and endangered species. 16. Air contaminant emissions shall be in compliance with the applicable permit and control provisions of the Colorado Air Quality Control Program, Title 25, Resolution 7, C.R.S. 17. All operations shall comply with all applicable Federal and State Public Health and Environment, Noise, and Air and Water Quality Control standards. 18. Any proposed waste disposal or treatment facilities shall comply with all requirements of the County Individual Sewage Disposal System Regulations. 19. Should an abandoned pipeline be removed, it will be subject to the original revegetation and weed management requirements in the original application. Finally, this determination shall not be final, and no permit based upon the determination shall be issued, for 14 calendar days after the date of the determination (August 13, 2007) in order to allow time for the Applicant to appeal, or for the Board of County Commissioners to call up the determination for further review, pursuant to Sections 9.07.08 and 9.07.09 of the Pipeline Resolution. This determination shall become final, and permits applied for in accordance with the determination may be issued, only after the expiration of this 14 -day period, and only if the determination is not reviewed and acted upon by the Board of County Commissioners at a subsequent appeal or call-up hearing. This determination has been sent to the Board of County Commissioners to determine if they wish to call up the matter. Staff will let you know if this matter is called up within the next 14 days. Katy, Still trying to pry loose some of the information you requested but I thought I would pass on what I have at this point. Attached is a revised Figure 1 showing the location of the pig launcher and receiver. Hopefully that will help clarify the facilities. There's also an attachment of the reapplication for the storm - water permit, but when I last checked they still hadn't received the official letter from CDPHE. Earlier we had the County evaluate the transition from CR 211 to the ranch road and they did not require a driveway permit for that location. f. The stop sign/s and installation shall be as required in the MUTCD (Manual on Uniform Traffic Control Devices). Still checking on this up on the plateau but the valley has appropriate signage. g. All vehicles hauling equipment and materials for the construction of the pipeline that exceeds the legal requirements shall require an oversize/overweight permit issued by Garfield County Road & Bridge Department. Prior to issuing these permits a letter from Chevron stating that such vehicles can operate under their road bond will be sent to Garfield County Road & Bridge Department. Had a statement to this effect in section 15 of the application. Ell check to make sure project planning has included all necessary oversize/overweight permits. h. Any permit/s needed for utilities within the County ROW will be permitted by Garfield County Road & Bridge Department upon request with conditions specific to each location and type. None of the pipeline route crosses existing county roads.
