The utility corridor will run between Clear Creek to the east and the toe slope of Skinner Ridge to the west. The southern terminus of the utility corridor is where the Clear Creek road crosses Clear Creek in the SW 1/4 Section 15, T6S, R98W. The northern terminus is the Water Management System Facility (598 -35 -BV) in the NW 1/4 Section 35, T5S, R98W. WWE biologists reviewed raptor nest data from 2007, 2008, and 2009 biological survey reports and conducted an additional raptor nest field survey on June 2nd and 3rd, 2009. Biologists used spotting scopes, binoculars, and the recorded call play -back methodology during the survey. Two occupied raptor nests were found within 0.5 mile of the proposed Lower Clear Creek Utility Corridor. An occupied (active),golden eagle nest is 0.4 miles from 598 -35 -BV at an azimuth of 214 degrees. It is called Nest #18 in the 2008 Chevron Clear Creek Biosurvey Report and is situated in a cliff 'pothole' at approximately UTM (NAD83) 12S 727280mE 4383100mN. On April 28 this nest was occupied by two adult golden eagles. On May 19 a single eagle chick was observed. On June 2 WWE biologists observed that the chick was noticeably larger, and two adult eagles, presumably the chick's parents, were seen soaring above Skinner Ridge. An occupied Cooper's hawk nest was found about 0.45 miles upstream from 598 -35 -BV. An adult Cooper's hawk was observed to be sitting on the nest, possibly incubating eggs. The nest is located in a boxelder tree at UTM (NAD 83) 12S 727143mE 4384126mN. No raptor activity was observed along Clear Creek across from Buck Gulch. During an earlier survey (May 19) a Cooper's hawk was seen sitting on a nest in that vicinity. WWE biologists will reinspect the area during the week of June 7. The Colorado Division of Wildlife (CDOW) has not published buffer zone guidelines for Cooper's hawks. 1 For golden eagles the CDOW guidelines recommend "no surface occupancy (beyond that which hi torically occurred in the area) within 0.25 mile radius of active raptor nests". Furthermore it is &commended that human encroachment within a 0.5 mile radius of active nests be restricted from December 15 through July 15. These recommendations are identified in the CDOW publication, "Recommended Buffer Zones And Seasonal Restrictions For Colorado Raptors", revised 2008. This publication also advises that there are exceptions to tolerance limits demonstrated by individuals within a raptor species. It is apparent that the golden eagle pair mentioned above has chosen to nest within 0.4 miles of the pre-existing Water Management System Facility (598 -35 -BV) and its related activities. The success of this golden eagle nest is not expected to be affected by the activities of the existing facility. To ensure nesting success human activities, including utility corridor construction, should not advance any closer than current distances to this eagle nest between the present date and July 15, 2009. If further human encroachment toward this nest is expected after July 15 the nest should be re -surveyed to determine if the nest is still occupied and if further timing restrictions are warranted. The workspaces need to be reclaimed at the end of corridor construction. (b) The workspaces can only accessed via existing roads or through the utility corridor. The approval of the application does not allow the widening of existing roads or the creation of new roads. Provide easement documents for where the corridor crosses BLM parcels. On the plans show the easements across the BLM parcels. The easement documents allow a 50' wide permanent easement and a 75' construction easement on Shell property. The construction corridor shown on the erosion control plans (but not shown on the site plans) shows a 100 -foot wide construction corridor across Shell property. Correct the plans to show the correct width and location of the easement and re -submit the relevant plans. On the site plans show the boundaries of the Shell and BLM properties. Comment The site plans need to delineate the edges of the - corridor. Why are there two centerlines shown for the corridor? The intent ofh t e reclamation plan is to reclaim all disturbed areas including the staging areas. All staging areas are adjacent to the corridor or existing ranch roads. No new roads would be constructed as part of the corridor installation. With the exception of one subsurface rights parcel (BLM confirmed they have no surface rights), none of the corridor passes through BLM property. The_assessor's-map has been updated to show that the corridor- is not on BLM property. -Drawings PBSR-ALL-ALN (&ERO)-URS-0606B-00001-00 & -00002-00 have been modified to reflect the smaller Shell property easement. The Shell property boundary line has been added to both drawings. All BLM properties are reflected on the original and updated alignment drawings. With the exception of one subsurface rights parcel (BLM confirmed they have no surface rights), none of the corridor passes through BLM property. Corridor is delineated_on the Erosion Control Drawings provided with the application. The two labeled centerlines reflect the proposed corridor and the previously installed 8 -inch gathering pipeline that services the delineation wells. An existing fiber optic cable center line is shown on the drawings with the appropriate label. The County Westwater needs a letter/report from Westwater that provides Report their recommendations for the corridor. Specifically, I need to know if the corridor lies within raptor nest buffers and if there needs to be a construction prohibition during certain times of the year (a) Only 7 launcher/receivers are shown on the plans and, as such, only 7 can be approved as part of the application. An eight launcher/receiver is mentioned but its location is currently unknown. When the location of this launcher/receiver is determined, Chevron can request an amendment to the application. (The County recommends that Chevron include this launcher Launcher / (b) The permitted land disturbance area by each Receivers launcher/receiver is 50'x50' (at crossovers) except for the launcher/receiver at the north end which requires an 100'x100' disturbance area. Label the location of the launcher/receiver on site plan sheet 10. (b) The launcher/receivers can only be accessed via existing roads or through the utility corridor. The approval of the application does not allow the widening of existing roads or the creation of new roads. Subject Comment What do you mean by permanently disturbed? The County will want the entire corridor re -vegetated after the pipelines/conduits are installed. The application proposes no `permanent' surface disturbance except the launcher/receivers. Here's how I understand your numbers: 53.1 acres were bonded through the 2006 8" pipeline project 51.8 acres of additional `permanent' disturbance 9.2 acres of temporary disturbance TOTAL: 114.1 acres Permanent disturbance indicates that a Tong -term facility (i.e., launcher / receivers) would be placed at that location and would not be re - vegetated until the depletion of the gas field. The intent of the original calculation was to differentiate between URS existing and proposed corridors; however, the width discrepancy was overlooked. Agree - the total disturbance is 114.1 acres as stated. Chevron action. We need to establish a date when the construction needs to be completed. A condition of approval will be 'All work must be completed by the October 2011 such that the corridor and workspaces will be reclaimed and seeded prior to winter. The bond can released after vegetation is adequately reestablished - - typically after two growing seasons.' A revised estimate suggests that all work would be complete by the December 2011. Please reference that date in the condition of approval. Calculations are correct per the combination of the two corridors. However, a portion of the 8 -inch pipeline corridor extends further south from the southern termination of the Clear Creek Utility Corridor. It would appear that the 8 -inch bond would need to be prorated. - Using the preliminary route map for total distances, it appears that . about 40% of the 8 -inch corridor is located south of the end of the proposed Clear Creek corridor. �„�� sic e, 0.40 x $97,500 = $39,000 the area of the 8 -inch corridor that lies outside of the Clear Creek corridor. However, the area should be evaluated to determine if the re -vegetation has achieved sufficient density to allow release of the bond.
