Dear Cathi , This letter is in response to your request for additional information to make our application for the referenced project technically complete. A specific requirement set forth in Section 9 .07.04(10) of the Garfield County Zoning Resolution o f 1978, as amended, "List the types and areas of concern along the pipeline right-of-way, such as: sensitive plant populations, cultural, archaeological or paleontological resources and wetlands identified during pre- construction environmental surveys, if applicable." No information was included related to archaeological or Paleontological resources and the regulations require this to be addressed. A Class Ill Cultural Resource Survey (Archaeological) and Paleontological Survey was conducted on BLM lands. No cultural or paleontological resources were identified during the surveys. Section 4.4 on pg . 19 discusses procedures to be im plemented should cultural or pa leontological resou rces are encountered during construction . A specific requirement is set forth in Section 9. 07. 04 (11) of the Garfield County Zoning R esolutions of 1978, as amended, states "Attach a copy of any land grant, permits and authorizations including stipulations." No approved 299 Permit is enclosed from the Bureau of Land Management to cross their land. The BLM 299 permit application was submitted on February 5 , 2008. We have not received the R ight-of- Way grant from the BLM . The approved Right-of-Way grant will be provided to Garfield County as soon as EnCana receives it. No construction will occur on BLM property until approval has been granted. A copy of the Army Corps of En gineers Nationwide General Permit #12 will be a condition of approval. The ACoE preconstruction packet compiled by Cordilleron Compliance Services , Inc. will be prov ided to Garfield County. This packet was submitted to the ACoE . MAR 0 n 2008 Section 9.07.04(16) Staging Areas, the County Staff would suggest placement of the construction/contractor's yard down by the current plant location which includes the evaporation pond and compressor station to avoid disturbing additional ground. An area near the Middle Fork Compressor Station was considered. However, EnCana is planning on restoring the area west of the station known as "the meadow" for wildlife habitat improvement. The area proposed is surrounded by three existing well pads and would be closer to the project area via the Exxon Colony road which EnCana has permission to use. Additionally, the added volume of semi-truck and vehicle traffic near the Middle Fork Compressor Station site would cause problems. A question arose concerning Section 9. 07. 06(3)(b) during our review. This section states "Pipeline operations shall be located in a manner to minimize their visual impact and disturbance of the land surface. Right-of-way shall be located to avoid crossing hills and ridges, and wherever possible, shall be located at the base of slopes." We// Connect Pipeline shown in Sections 3, 34 & 27 (H04 596 up to K22 496) appears to be straight up the ridge line. Please explain why this location was chosen. This route was chosen because it will be following the access road that ConocoPhillips is planning on building to access their well pads. The route south of the H04 596 was chosen because a much wider right-of-way would be needed to construct along the slopes and keeping soil out of the intermittent drainage would be very difficult. Another question we have is approximately how many acres that are currently undisturbed will be disturbed through this process? It is estimated that approximately 128.4 acres of previously undisturbed area will be disturbed by the proposed project.
