The application was submitted by Hunter Ridge Energy Services LLC, in conjunction with Encana Oil and Gas. The site is approximately 21 miles north of Parachute and is accessed off of County Road 215. It is located in Section 24, T4S, R96W on a portion of that property known by Assessor's Parcel no. 1917-274-00-012. The purpose of this letter is to inform you that the application has been deemed technically complete. Please understand that a determination of technical completeness by this office shall not be deemed a recommendation of approval, finding of adequacy of the application, or a finding of general compliance with any goal or objective of the Garfield County Land Use Resolution of 2008 as amended (ULUR) or the Comprehensive Plan 2030. The application will be reviewed by Staff and a staff report will be generated and sent to you. The Board of County Commissioners will discuss and review the application at a public hearing which has been scheduled for Monday, August 12, 2013 at 1:00 p.m. The public hearing will be held in the County Commissioner's Meeting Room, Garfield County Plaza Building, 108 8th St., Glenwood Springs, CO 81601. The Board of County Commissioner's public hearing will be duly noticed and advertised in accordance with the ULUR. The Applicant shall be solely responsible for the publication, property posting, and mailing of all notices. The Applicant shall present proof of publication and mailing at or before the meeting. The item cannot be heard if correct noticing requirements have not been met. The standard notice procedures for the public hearing shall be given as follows pursuant to Section 4101 (E) of the ULUR as summarized below: 1. Notice by Publication. At least thirty (30) and not more than sixty (60) calendar days prior to the date of a scheduled public hearing before the Planning Commission or BOCC, the Applicant shall publish notice of a hearing in a newspaper of general circulation.... (Note: The Rife Telegram is the newspaper for publication of legal notices and publishes only weekly on Thursdays) 2. Written/Mailed Notice to adjacent Property Owners. Written notice shall be provided at least 30 but not more than 60 calendar days prior to the date of a scheduled public hearing. The Applicant shall send written notice by certified mail or by a nationally recognized overnight courier, return receipt requested. Written notice shall be provided to the owners of record of all adjacent property within a 200 foot radius of the subject parcel, as shown in the office of the County Clerk and Recorder or Assessor, at least 30 days prior to sending notice. Within the same time period, written notice shall be provided to owners of mineral interests in the subject property.... 3. Posting of Notice. At least 30 and not more than 60 calendar days prior to the date of a scheduled public hearing, the Applicant shall post a notice of the public hearing on the property. Posted notice shall consist of at least 1 sign facing each adjacent road right-of-way, and located so as to be fully visible from the road right-of-way generally used by the public. The notice signs shall be provided to the Applicant.... Attached is a draft public notice form which will also be provided by email. Please review the required information and insert additional details as necessary, including the legal description. Also enclosed is the public notice poster for your review and use. The posting and public notice documents are provided as a courtesy and the Applicant must verify that all information provided in these documents is correct. It is the obligation of the Applicant to correct any deficiencies such that proper notice in form and substance can be established. All notice including publication, posting and mailing must be completed by July 12th To meet the publication deadline your request will need to be submitted to the Rifle Telegram no later than Friday, July 5th by noon. The mailing must be by certified return receipt requested and the receipts must be provided to the County Prior to the hearing. Photographic evidence of the posting on the property should also be provided. In addition, please submit 14 copies of the completed/updated application to this office no later than Friday, July5th. 8 copies can be provided on compact disk along with 6 paper/hard copies. The digital version should include a pdf of the entire application organized in sections consistent with the hardcopies. Sincerely, Glenn Hartmann Senior Planner Enclosures: Public Notice Form Public Notice Poster 3 PUBLIC NOTICE TAKE NOTICE that Hunter Ridge Energy Services LLC, in conjunction with Encana Oil and Gas (USA) Inc. has applied to the Board of County Commissioners, Garfield County, State of Colorado, to request approval of a Land Use Change Permit, Limited Impact Review (File Number LIPA-7589), Compressor Station with Material Handling, and Storage Facility. The site is located within the County of Garfield, State of Colorado, to -wit: Legal Description (See Attached Exhibit "A" - to be inserted by the Applicant) Practical Description: The site is located approximately 21 miles north of Parachute, accessed off of County Road 215 and located in Section 24, T4S, R96W. The site is located on a part of that property known by Assessor's Parcel No. 1917-274-00-012. Request: Limited Impact Review for the proposed Wolf Ranch Compressor Station, with Material Handling, and a Storage/Laydown yard. The facility is to be located on approximately 15.1 acre site within an overall parcel of approximately 15,800 acres owned by Encana Oil and Gas (USA) Inc. The proposal includes 3 initial compressor units, 3 future compressor units and a future Amine Plant along with accessory facilities. The property is zoned Resource Lands — Plateau. The Applicant's designated representatives are Lorne Prescott, Craig Richardson, Jeff Hofman, Tilda Evans, and Olsson Associates. All persons affected by the proposed use are invited to appear and state their views, protests or support. If you cannot appear personally at such hearing, then you are urged to state your views by letter, as the Board of County Commissioners will give consideration to the comments of surrounding property owners, and others affected, in deciding whether to approve, approve with conditions or deny the request for a Land Use Change Permit. The application may be reviewed at the office of the Community Development Department located at 108 8th Street, Suite 401, Garfield County Plaza Building, Glenwood Springs, Colorado, 81601, between the hours of 8:30 a.m. and 5:00 p.m., Monday through Friday. A public hearing on the application has been scheduled for the 12th day of August, 2013 at 1:00 PM and will be held in the County Commissioners Meeting Room, Garfield County Plaza Building, 108 8th Street, Glenwood Springs, Colorado, 81601.
