You obtained local verification, in part, because you were operating in unincorporated Garfield County prior to the June 21, 2010 moratorium. Because your OPCO was in place prior to the amendments to the Unified Land Use Resolution (ULUR), your OPCO may be a pre-existing, nonconforming use of the land. However, since that time, as you are aware the BOCC has passed the Garfield County Ordinance 13-2 prohibiting any growing, selling, testing or manufacture of recreational marijuana in Garfield County. There is no non -conforming use for these prohibited activities. The Community Development Department conducted a site visit on March 29, 2013 and you were provided the information you needed to bring your OPCO into compliance with the County land use and development codes. Your architect has submitted plans for your required building permits and the Community Development Department is currently reviewing those plans. No building permits have been issued. At this point, your OPCO is not in full compliance due to the nine months it has taken to submit the required plans; however, it appears you are working toward that goal. Further, you mentioned when you stopped by my office that you were going to file a Change of Ownership. Please also file a copy of the State Change of Ownership Application with the Garfield County Clerk and Recorder once that has been submitted to the State Marijuana Enforcement Division. Thank you.
